ENSTAR Natural Gas Company has no objections to the existing septic system absorption bed and four
inch (4 in) PVC drain encroachments into the Ten Feet (10 FT) wide utility easement situated adjacent to
and coincident with the easterly boundary .line of Lot 15, Block, 3, Aspen Highlands Addition No. 3
Subdivision, Records of the Anchorage Recording District, Third Judicial District, State of Alaska.
Acceptance and use of this letter of non-objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
· Landowner/Contractor is working near ENSTAR gas facilities will contact the Alaska Digllne, Inc., (907)
278-3121 or 811 for line locating two (2) business days prior to any related excavation.
· ENSTAR will be held harmless, now and forever for any damages or injury to any person or property as a
result of this encroachment.
· Any ENSTAR facility damaged or deslxoyed, as a result of this encroachment will be repaired at no cost to
ENSTAR.
Any costs incurred by ENSTAR for special construction necessitated by this encroachment will be borne
by the land owner.
· All applicable safety code regulations will be observed and maintained.

This letter of non-objection in no ,,va)' precludes GCI Communication Corp from full use
and enjo3anent of any rights it may have within an), portion of the utility easement and or
the right-of-way, including unlimited access for servicing its facilities. Also any
additional and extraordinary costs incurred during any future required construction, repair

Request for Letter of Non-objection to Encroachment (Tax ID# 017-013-71)
The Anchorage Water and Wastewater Utility received a request from your representative on July
18,2011 in regards to a new septic drainage field encroaching into the utility easement along the
east property line of ASPEN HIGHLANDS ~ BLK 3 LT 15.
AWWU is currently not using this utility easement and has no objection to the encroachment.
AWWU hereby issues this letter with stipulations to allow the encroachment of a new septic
drainage field into the utility easement, the property owner(s) agrees to the following:
1. AWWU will be held harmless, now and forever, for any damages or injury to any person
as a result of the encroachment;
2. The property owner(s) shall call for utility locates before excavation in the easement;
3. All applicable codes and regulations will be observed and maintained within the
easement;
4. This letter will in no way preclude AWWU from full use and enjoyment of its rights within
any portion of the easement;
5. The property owner(s) shall pay any additional and/or extraordinary costs incurred to
accommodate the encroachment during any future required construction or
reconstruction of AWWU facilities;
6. AWWU's non-objection does not imply other approvals that may be required for this
encroachment; and,
7. AWWU does not provide a position for any other parcel or utility impacted by the
encroachment.

absorption, bed that encroaches approximately. Five Feet.(5') into said Easement at a
depth of approximately Six Feet (6') for a distance of approximately Ten Feet (10'),
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the Encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
~eal property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This permit~
creates no interest in the real property subject to the easement.
7. Modification of Utility_ Facilities. If the electric utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty (30) days of written demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.

Well and Septic System Permit
We have revised the septic system design for the subject lot based on our
conversations. The absorption bed has been redesigned to be 2 beds each 15'
wide and 30' in length. In addition, the bottom of the bed has been raised to 2'
above existing ground. We also intend to remove a minimum of 2' of the existing
silty soil material and replace it with clean gravel and sand to provide additional
surge capacity to the system. Extensive landscaping will be provided to insure
positive drainage.
A cross section of the absorption bed area including the subdrain is attached for
your review. We have also added the second drain to the north of the house as
added protection from surface water intrusion. Please review the attached
information and advise if you have further comments.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The owner of Lot 15, Block 3, Aspen Highland Subdivision No. 3 intends to construct a
three-bedroom home on the lot. We are therefore requesting a permit be issued for a
well and septic system to serve the new home. The available area for the septic system
is limited by the presence of a well close to the eastern lot line and the proposed well
on the lot. In addition soil conditions on the lot indicate slow percolation rates and
groundwater elevations close to the surface which make it difficult to place a
conventional septic system. We have therefore propose to place an Advantex
Treatment System on the lot to provide the most effective treatment of the septic
effluent prior to discharge into the surrounding soil strata. The location of the
absorption system is shown on the attached Site Plan. A subdrain will also be placed to
control surface and subsurface drainage in the area of the new absorption bed.
Drainage patterns are also shown on the plan and will be modified somewhat as a
result of the proposed construction.
The test holes placed on this lot revealed silt with some sand and gravel. The
percolation rate in the materials encountered was between 60 and 120 minutes per
inch. Groundwater was found between 4.5' and 7.5' below the surface during the
monitoring period. Our design provides for the bottom of the absorption trench to be at
2' above the ground surface. We are therefore proposing to place a four-bedroom
Advantex Treatment System. The absorption beds will be 2 - 30' long x 15' wide for a
total of 900 square feet of absorption area. The distribution line in the trench will be
placed at 2.0' above the existing ground level. 2' of fill and 2" of insulation will be
placed above the bed and 4' over the septic tank to meet Municipal Code and prevent
freezing. The side slopes of the mound will be at 4:1 and extensive landscaping and fill
will be required to insure positive drainage away from the finished mound.

The ground surface of the lot slopes from the northeast to the southwest at gradual
slopes. The bed will be constructed parallel with the contours of the slope as much as
possible in conformance with Municipal requirements. All components of the new
septic system will be constructed a minimum of 100' from any surface water and 100'
from the well proposed for this lot. No conflicts exist between the proposed well and
septic system and those in the area.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
Ti -IIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and

Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.3365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as AN ADVANTEX SYSTEM

2. Maintenance, Repairs and Alterations.

with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.

repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically 5400 to 5600).

or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

repairs from the manufacturer's representative or maintenance provider.

3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof" or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the

7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

The Municipality of Anchorage Development Services Department (DSD) issues Certificates of On-Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On-Site Systems Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also issues COSAs upon request to homeowners. Certificates of On-Site Systems Approval
are valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

Dear On Site Services Engineer:
The southeast end of the northernmost absorption bed recently constructed on Lot 15,
Block 3, Aspen Highlands Subdivision was constructed within 3' of the eastern lot line.
Placement of the bed in this area will not conflict with other septic systems or wells in
the area. We therefore recommend a waiver be issued to allow placement of the
trenches at 3' from the east property line.
