Ail construction must be in accordance with: 1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska Wastewater
Disposal Regulations (18AAC72) and Drinking Water Regulations (18AACS0).
3. The wastewater code requires inspections during the installation. The engineer must notify the Development Services

4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather must either:
A. Open and Close on the same day.
B. Covered, sealed, and heated to prevent freezing.
Special Provisions:
Due to the proposed Engineered Receiving Soils design, the following items are required (See
proposed AMC 15.65)
1. Fill shall not be installed on top of organic soils.
2. Additional test holes required to confirm continuity of the accepting stratum.
3. Preconstruction meeting between the contractor and engineer.

Well and Septic System Permit Request
Design Narrative
This is a design narrative for a permit to install a well and septic system to be issued for this property. The
proposed systems will serve a proposed three bedroom (3) bedroom house. Currently the lot is
undeveloped. The surrounding developed lots are served by private wells. There are no wells within 100'
of the proposed septic system.
Soils. One test holes were performed on this lot by PES in August of 2013, and groundwater was
monitored for at least seven days. Ground water was observed at a depth of 1.0~ below the surface in
the test hole monitor tube in August of 2013. Bedrock was not encountered in the test hole. The soils
sieve analysis shows greater than 50% passing a #4 Sieve and less than 5% passing a #200 sieve with an
uneven gradation, which classifies it as an SP soil per the Unified Soil Classification System. The ADEC
installers manual rates an SP soil at 150 square feet/bedroom which corresponds with 1 gpd/sf for a
conventional system, or a i MPI soil. For a CAT III system we used a more conservative application
rate because of the inability to percthe soil. Based on the results of the sieve analysis, and overall
soils appearance; an application rate of 4 gallons/day/square feet was used for a CAT Iit wastewater
system in the area of the test hole.
2. Soil Absorption System Design.
a. See Sheet 1 ofthe design package.
3. Surface Water: There is a mapped "unclassified drainageway' in the area of the drain field, but no
surface water was observed in the feature at the time of the test hole. The municipality's wetlands
mapping employee has stated that he believes there is surface water in this drainageway which will be
located 12 feet from the drain field. There is a small stream Iocated,,E~Tfeet from the drain field see
waiver request. The lot owner has received a permit for all constructio~ in the wetlands includingthe re-

4. Topography: The existing topography generally slopes from the south to the north in the area
surrounding the septic system at approximately 6%. There are no steep slopes within 50' of the proposed
drain field. The proposed drain field will maintain 50' separation all steep slopes.
5. Drawing Markings: The Drawings are marked "For MoA Review Only". When written notification that
the review is complete and that there are no further comments is received from MoA On-Site
Department, the note wilt be removed and "Issued for Construction" drawings will be issued.

Waiver
Request: We are requesting a waiver for the separation distance from the septic system to
potential surface water of 10 feet. The surface water is approximately +12 feet from the field a nd/?~ feet#~--
from the tank. The wastewater system will consist of a 1500g Advantex tank with an Ax20RTN-UV
treatment system. This system will utilize standard Advantex treatment followed by a UV stage for
disinfection. The system was designed to utilize a surface discharge after the disinfection stage, but due to
concerns voiced by the Municipality a drain field will still be used to dispose of effluent. Any potential
overflow from the system will exceed the water quality of the surrounding wetland.
Effluent Quality will exceed that of the naturally occurring water in the drainageway and the system
function will be autonomously monitored with an alarm and automatic system shut-off. This system was
tested and NSF certified. The average effluent CBOD5 was 7 mg/L, ranging between <2 and 18mg/L A
naturally occurring concentration of 40 to 60mg/L is normal in this area. Additional treatment will occur
by natural filtration through the wetland vegetation downstream of the discharge.
The proposed installation will not affect the future development of this or the surrounding lots,

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of tlfis

herein the "OWNER," and the Mtmicipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Mah~tenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as
located at (legal description).
2. Definitions.
Alteration. Any change to the design or function of an AWWTS ttmt
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On-Site Systems Approval {COSA). An approval by the
Mmficlpality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from perfomfing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On-Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or m~til the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations~ Installation and Removal of Additional Equipment. Priorto
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, amd any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for falling to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make amy necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On-Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
I. Owner agrees to provide and maintain a telephone connection to the AWWTS as
required by the AWWTS approval.
6. Nonwaiver. The failure of either party at any time to enfome a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or chamge to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
m~d Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The la~vs of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

Dear Mr. Schimscheimer:
This is in response to your January 8,2016, application for a Department of the
Army (DA) permit, to discharge 10,500 cubic yards of fill into 0.24-ac'¢es of wetlands in
order to construct a residential development that consist of a driveway, garage, single
family house, well and septic system. It has been assigned file number POA-2016-17,
Little Rabbit Creek which should be referred to in all future correspondence with this
office. The project site is located within Section 1, T. 11 N., R. 3 W., Seward Meridian;
USGS Quad Map Anchorage A-8; Latitude 61.074150 N., Longitude 149.73576o W.;
Rabbit Creek and Heights Subdivision, Block 1 H, Lots 17A, Parcel Number 020-531-07-
000; Municipality of Anchorage; in Anchorage, Alaska.
Based on our review of the information you furnished and available to us, we have
preliminarily determined the above property contains water.' of the United States (U.S.),
including wetlands, under the Corps' regulatory jurisdiction ~ Please see the attached
Preliminary Jurisdictional Determination Form).
DA permit authorization is necessary because your project will involve the
placement of or fill material into waters of the U.S. under our regulatory jurisdiction.
Based upon the information and plans you provided, we hereby verify that the work
described above, which would be performed in accordance with the enclosed plan
(sheets 1-5), dated November 30, 2015, is authorized by Nationwide Permit (NWP) No.
29, Residential Developments. NWP No. 29 and its associated Regional and General
Conditions can be accessed at our website at: www.poa.usace.army.mil/Missions/
Regulatory/Permits.aspx. Regional Conditions D, E, F, G, H, I and J apply to your
project. You must comply with all terms and conditions associated with NWP No. 29, as
well as with the special conditions listed below:
To Permittee shall implement and maintain effective sedimentation controls
before, during, and after construction to prevent the introduction of sediments
and/or contaminants into adjacent Waters of the U.S. outside of the authorized
footprint. Prior to initiating construction activities, a silt fence and/or other
sediment containment structures shall be properly installed around the edge and
within 5 feet of the authorized fill area. The turbidity barriers shall remain in place,
monitored for effectiveness and maintained until the authorized work has been
completed and all suspended and erodible materials have been stabilized.
Turbidity barriers shall be removed upon stabilization of the work area.
To ensure that the new drainage feature is optimally designed, the Permittee
shall coordinate the location and design of the new drainage by providing
engineered drawings to the Corps and the Municipality of Anchorage Watershed
Management Section for review and concurrence at least 5 business days p~'ior
to construction.
Further, please note General Condition 30 requires that you submit a signed
certification to us once any work and required mitigation are completed. Enclosed is the
form for you to complete and return to us.
The Nationwide Permits are due to expire on March 18, 2017, unless the NWP is
modified, reissued, or revoked. It is incumbent upon you to remain informed of changes
to the NWPs. Nothing in this letter excuses you from compliance with other Federal,
State, or local statutes, ordinances, or regulations.

EXPLANATION OF PRELIMINARY AND APPROVED JURISDICTIONAL DETERMINATIONS: 1. The Corps of Enghneers
believes that there may be jurisdictional waters of the United States on the subject site, and the permit applicant or other affected party who
requested this preliminary JD is hereby advised of his or her option to request and obtain an approved jurisdictional determination (JD) for tha
site. Never[heless, the permit applicant or other person who requested this preliminary JD has declined to exercise the option to obtain an
approved JD in this instance and at this time. 2. In any circumstance where a permit applicant obtains an individual permit} or a Nationwide
General Pe~Tnit (NWP) or other general permit verification requiring "preconstruction notification" (PCN), or requests verification for a non-
reporting NWP or other general permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is
hereby made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which does
not make an official determination ofjurisdictionai waters; (2) that the applicant has the option to request an approved JD before accepting the
terms and conditions of the permit authorization, and that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that the applicant has the right to request an individual permit
rather than accepting the terms and conditions of the NWP or other general permk authorization; (4) that the applicant can accept a permit
authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the
Corps has determined to be necessary; (5) that undertaking may activity in reliance upon the subject permit authorization without requesting an
approved JD constitutes the applicant's acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any
form of Corps permit authorization based on a preliminatT J D constitutes agreement that all wetlands and other water bodies gn the site
affected in any way by that activity are jurisdictional waters of the United States, and precludes any challenge to such jurisdiction in any
administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the
applicant eIects to use either an approved JD or a preliminary JD, that JD will be processed as soon as is practicable. Further, an approved JD,
~ proffered individual permit (and al/terms and conditions contained therein), or individual permit denial can be administratively appealed
pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)). If, during
~hat administrative appeal, it becomes necessary to make an official determination whether CWA jurisdiction exists over a site, or to provide
an official delineation of jurisdictional waters on the site, the Corps will provide an approved JD to accomplish that result, as soon as is
~racticable.
