ROAD INGRESS AND EGRESS EASEMENT AGREEMENT
This Road Maintenance Ingress and Egress Easement (this "Agreement") is
made as of t L _ August 2025 by CB Homes, LLC whose mailing address in 1911 East
5th Avenue, Suite C Anchorage, AK, 99501, as Grantors of SOUTH LAKEWOOD
HILLS, Block 1 Lot 5 (the "Main House") and SOUTH LAKEWOOD HILLS Block 1 Lot
4,
(the "Empty Lot") to CB Homes, LLC Grantee.
RECITALS:
A. Grantor is the owner of certain real property legally described on Exhibit A
attached hereto and incorporated herein by reference (the "Grantor Property").
B. Grantor is required by Municipality of Anchorage platting requirements to
create said road easement on SOUTH LAKEWOOD HILLS Block 1 Lot 5 (24,098
square feet, main house) to access SOUTH LAKEWOOD Block 1 Lot 4 (48,195 square
feet, empty lot).
NOW, THEREFORE, FOR GOOD AND VALUABLE CONSIDERATION. The
receipt and sufficiency of which are hereby acknowledged, the parties to this Agreement
hereby agree as follows:
1. Common Access Easement. Grantor allows Grantee, its successors and
assigns, for the use and benefit of Grantee, a perpetual non-exclusive easement upon,
over, above the certain area indefinitely of the Grantor's Property labeled as 6400
O'Malley Road, Anchorage, Alaska 99507 (the Main House) with a legal address of
SOUTH LAKEWOOD HILLS Block 1 Lot 5 and SOUTH LAKEWOOD HILLS Block 1 Lot
4 (the Empty Lot) Well Road Maintenance Easement Agreement as shown on Exhibit A
and incorporated herein by reference, for ingress and egress.
2. Indemnification. Grantee hereby defends, indemnifies and holds Grantor
harmless from and again all claims, demands, losses, liabilities, damages or expenses
arising out of or in any way related to the exercise of the rights under this Agreement.
3. Use of Easement Area by Grantors and Grantee. Grantee shall be solely
responsible for the maintenance and upkeep of the road maintenance ingress and
egress easement area. Grantor shall not use the area in any manner inconsistent with
the rights granted to grantee hereunder. All fees, maintenance and repairs will be
divided in half,
4. Running with the Land/Binding Effect. The agreements contained herein
and the easement and other rights granted hereby shall run with the titles to the
Grantor's Property and shall bind and inure to the benefit of the parties hereto and their
respective heirs, successors and assigns.
