This permit is between Chugach Electric Association,Inc.,an Alaska non-profit electric cooperative,
(herein"Chugach"),whose address is P. O. Box 196300,Anchorage,Alaska 99519 and Daniel W.
Beardsley and Mary Ellen Beardsley(herein"Permittee"),whose address is 11480 Browder Avenue,
Anchorage, Alaska 99507.
1. Easement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as follows:
Described in that certain written instrument recorded on the 29th day of September 1952,in
Volume 79, Page 381, on file in the office of the District Recorder,Anchorage Recording
District, Third Judicial District, Seward Meridian, Alaska,
Described in that certain written instrument recorded on the 9th day of October 1979, in
Book 443, Page 721, on file in the office of the District Recorder, Anchorage Recording
District, Third Judicial District, Seward Meridian, Alaska,
Described in that certain written instrument recorded on the 22nd day of August 1980, in
Book 518, Page 925, on file in the office of the District Recorder, Anchorage Recording
District, Third Judicial District, Seward Meridian, Alaska,
Dedicated by the plat of the subdivision known as Trail's End Subdivision, according to
Plat Number P-604, recorded on the 19th day of July 1961, on file in the office of the

(herein "Easement")which pertains to the following described real property:

Permittee acknowledges the validity of the Easement. Permittee warrants and represents that
Permittee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Easement is adjacent:
Lot Three(3), AND Lot Eight(8), Block Eight(8),Trail's End Subdivision, according to
Plat Number P-604, recorded on the 19`h day of July 1961, on file in the office of the
District Recorder,Anchorage Recording District,Third Judicial District,Seward Meridian,
Alaska,
(herein"Parcel").
2. Encroachment. Permittee has constructed or purchased the following improvements
on or within the real property subject to said Easement:
A septic line that crosses Easements along the East Ten Feet(E 10') of Lot Three(3),
AND the West Ten Feet (W 10') of Lot Eight, at a location approximately Thirty-six
Feet(36')north of the south property lines,for a width of approximately Two Feet(2'),
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury,property damage or other loss arising in any way from the continuation of
the Encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit,has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This permit
creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within the
Easement are upgraded,added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or

preserving the Encroachment. If such payment is not made within thirty(30)days of written demand
for same,Chugach may terminate this permit in accordance with paragraph 9,below
8. Covenants Running with the Land. The obligations of the Permittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the Permittee's
interest in the land subject to the Easement and shall benefit the Easement.
9. Termination. Chugach may terminate this permit after the giving of thirty(30)days
written notice of such termination if:
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.
b. The Encroachment is damaged by any means to an extent of more than thirty percent
(30%) of its replacement cost at the time of destruction.
c. Permittee fails to make the payment described in paragraph 7, above.
10. Term. This permit shall,if not sooner terminated by Chugach,expire forty(40)years
from the date hereof.
11. Entire Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements,oral or written,between the parties. No modifications,amendments,deletions,additions
or alterations of the permit shall be effective unless in writing and signed by all of the parties hereto.

Subject to your agreement to indemnify the company as set forth below, GCE Communication
Corp has no objection to the previously constructed septic system that crosses through the 10ft
CEA and 5ft utility easements of Lots 3 and 8, Block 8,Trails End Subdivision,also known as
11480 Browder Avenue, city grid 2841,GCl WO# 18-0058-71.
This letter of non-objection in no way precludes GCI Communication Corp from full use and
enjoyment of any rights it may have within any portion of the utility easement and or the right-
of-way,including unlimited access for servicing its facilities. Also any additional and
extraordinary costs incurred during any future required construction,repair or reconstruction of
GCI's facilities to accommodate any or all of the encroachments shall he paid by the property
owner.
By signing below,you agree to indemnify and hold GCI Communication Corp harmless, now

Alaska Communications has no objections to the existing septic system encroaching into the 5'utility easement
located along the western boundary of Lot 3&8, Block 8 of the Trails End Subdivision,otherwise known 11480
Browder Avenue,Anchorage,Alaska as depicted on the drawing submitted by Garness Engineering Group,Ltd.
Alaska Communications currently is utilizing this easement and has no objection to the encroachment. Alaska
Communications hereby issues this letter with stipulations to allow the encroachments of the above mentioned into the
easement.

successors,will constitute agreement to the following stipulations:

ENSTAR Natural Gas Company has no objection to the septic line encroachment into the two ten foot
(10FT)CEA Easements and into the five foot(5FT)utility easement between Lots 3 and 8,Block 8,
Trails End Subdivision,accorc,ag to Plat No.P-604,Records of the Anchorage Recording District,Third
Judicial District, State of Alaska.
Acceptance and use of this letter of non-objection by yourself,your heirs,your assigns,or your
successors,will constitute agreement to the following stipulations:
• Landowner/Contractor working near ENSTAR gas facilities shall contact the Alaska Digline,
Inc., (907)278-3121 or 811 for line locating two(2)business days prior to any related
excavation. This service is free of charge.

Request for Letter of Non-objection to Encroachment (Tax ID# 015-191-68)
The Anchorage Water and Wastewater Utility received a request from your Representative
Garness Engineering on December 27, 2018 in regards to an existing on-site septic line
encroaching within the Utility Easement abutting the east property line of Lot 3 and the west
property line of Lot 8, TRAILS END BLK 8 LT 3, 8
AWWU is currently not using this Utility Easement and has no objection to the
encroachment. AWWU hereby issues this letter with stipulations to allow the encroachment
of the existing on-site septic line to encroach into the utility easement, property owner(s)
agrees to the following:
1. AWWU will be held harmless, now and forever, for any damages or injury to any
person as a result of the encroachment;
2. The property owner(s) shall call for utility locates before excavation in the
easement;
3. All applicable codes and regulations will be observed and maintained within the
easement;
4. This letter will in no way preclude AWWU from full use and enjoyment of its rights
within any portion of the easement;
5. The property owner(s) shall pay any additional and/or extraordinary costs incurred
to accommodate the encroachment during any future required construction or
reconstruction of AWWU facilities;
6. AWWU's non-objection does not imply other approvals that may be required for this
encroachment; and,
7. AWWU does not provide a position for any other parcel or utility impacted by the
encroachment.

Ref: Proposed Septic System Upgrade for Trails End S/D; Block 8, Lot 3 and 8
To whom it may concern:
The existing 4-bedroom house is served by a pdvate well and septic system. The septic system
consists of a 1250 gallon septic tank located on Block 8, Lot 8 (installed in 1984) and a
drainfield located on Block 8, L3 (installed in 1986). The drainfield was initially installed to
replace the drainfield that was originally installed on Block 8, Lot 8, in 1984 after it was deemed
to be submerged in groundwater. A recent investigation found the operational drainfleld to be
in a state of failure. In addition, the drainfleld on Block 8, Lot 8 was deemed to be encroaching
upon groundwater.. In short, the septic system is in need of replacement.
All adjoining properties are either undeveloped or served by a holding tank. In short, the area is
marginal in regards to suitability to support an onsite septic system. There is a curtain drain
somewhere on Lot 8, which has an outfall pipe near the northwest corner of Lot 8. During our
site visits to the property (including the most recent site visit on 7/14/2016) no water has been
observed discharging from the curtain drain. On 7-13-2016 groundwater was found in the 1984
drainfield at a depth of 5.3 feet below grade. The operational drainfield (Lot 3) was found to be
surcharged on 5/11/2016 to within ~"f~et of the ground surface. For design purposes, we are
assuming that the liquid depth in the~/drainfield on 5/11/16 represents the spring groundwater
eve .
We are proposing to decommission the existing septic tank and install a new Quanics CAT II
Aerocell system on Lot 8, and rebuild the drainfield on Lot 3 to receive the CAT II effluent.
Comments regarding the design are summarized as follows:
1. SOILS: See the attached 1986 soil log by Bruce J. Cowin, P.E. which show the soil
classifications, and the percolation test results. It should be noted that although 7-day
groundwater monitoring did not occur, the bottom of the proposed drainfield will be at grade.
Additionally, during our site visit on 7/13/2016, the groundwater in the abandoned drainfield on
Lot 8 was at approximately 5.3 feet below existing grade.
2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications.
3. SURFACE WATERS: There are no surface water concerns.

MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE
THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewatcr Treatment System
(AWWTS), described as
located at (legal description).
Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On-Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS. t
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties

8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance

govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severabili ,ry. Any provisions o£this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

MUNICIPALITY OF ANCHORAGE
ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the"AGREEMENT" made and
entered into as of this 21 Day of S/tNUkizy of 20 V1 , by and between

Anchorage, herein the"MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),

2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
,NS Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
Ns It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
, Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

repairs from the manufacturer's representative or maintenance provider.
pc Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
05 Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
pc, Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On-Site Systems Approval.
VS Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
jJ5 Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.
