This is a request for a variance from Section 21.80. 230 of the Land Subdivision Regulations,
This variance is for:
Street intersection at less than 75°.
A. The existing situation is: Paved Poniard Dr intersects Chu§ach Park Dr at 71°13'.

B. The granting of this petition would permit: Dedi cati on of the exi sti nq public use
easement and the allowance for Poniard Dr. to remain as it now is.
Before a variance may be granted, the applicant must prove that each of the fo/lowing four conditions have been fulfilled. Answer
each of the conditions in detail using additional sheets if necessary.
The undersigned alleges that:
1. That there are such special circumstances or conditions affecting said property that the strict application of the provisions of this
ordinance would clearly be impractical, unreasonable, or undesirable to the general public. These special circumstances or
street is already highly improved ( paving and guardrails ) and realignment is
undesirable.
2. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area
in which said property is situated for the following reasons:
The intersection has good sight distances and currently is as safe as
possible.
3. That such variance will not have the effect of nullifying the intent and purpose of this ordinance or the Comprehensive Plan of
the Municipality for the following reasons:
This is an isolated instance of a pre-existing situation.
4. The above listed special conditions or circumstances do not result from the action of the applicant and such conditions or
circumstances do not merely constitute a pecuniary (monetary) hardship or inconvenience in that:
The street was approved by the Municipality in its present position
(within the public use easement) before the petitioner gained ownership.

Lots 10A and 10B, Blk 1 ~nd Lot 16A, Blk 4, Greatland Estates,
units 2 and 3.
Dear Mr. Morris,
We have completed ground water monitoring on the above-referenced
lots for subdivision purposes with the following results:

The above water levels are measured down from the ground surface.
The planning board has informed us that there was a comment on the
health department review that the test holes are required to be 14'
deep. I did obtain verbal approval for 12' test holes from Steve
Morris prior to the excavation. This was necessary due to the depth
limit of the backhoe. In all test holes a greater depth would not be
to any advantage, as there is poor soil at the 12' depth and an
indication of water table on lots 10A and 10B. There is no concern
with bedrock in this area; therefore the additional test hole depth is
unwarranted. A plot plan with topography is attached showing test hole
locations as provided by the surveyor.
