The length dimension is the length(in feet) of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet).

and must be returned to this department within 30 days of the well completion.

The Municipality of Anchorage Development Services Department (DSD) issues Certificates of On-Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On-Site Systems Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also issues COSAs upon request to homeowners. Certificates of On-Site Systems Approval
are valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system,
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

As certified by my seal affixed hereto and as of the validation date shown below, I verify that my investigation,
based on procedures outlined in the Certificate of On-Site Systems Approval Guidelines for this application,
shows that the on-site water supply and/or wastewater disposal system is (are) safe, functional and adequate
for the number of bedrooms and type of structure indicated herein. I further verify that based on the information
obtained from the Municipality of Anchorage files and from my investigation and inspection, the on-site water
supply and/or wastewater disposal system is(are) in compliance with all applicable Municipal and State codes,
ordinances, and regulations in effect at the time of installation.

Engineer's Comments: This investigation was completed in compliance with ADEC and MOA regulations. The
assessment of the condition of the well and septic applies only to the conditions as of the day tested. The flow
and absorption rates may change due to subsurface conditions that may not be observed from the surface,
changes inland use, local soil characteristics, groundwater levels that may fluctuate during the year and the
water usage of the family being served by the system. The operational life of all well and septic systems are
subject to these various and dynamic characteristics and are outside the control of the
evaluator of the well and septic system. Therefore,
ArcTerra can not give any estimate of how long a
system will function satisfactory for current or future
occupants or can ArcTerra guarantee that no unseen
encroachments, deficiencies or discrepancies exist.

The 6' casing, in good condition and located in the northeast corner of the
property along Hightower Road is welded closed to prevent contamination. This
welded casing has a positive slope away from it and we do not expect there to be
any adverse effects from this well.

Reference: This is an amendment to and supersedes the determination letter dated
October 12, 2010 by irma M. Cox.
Dear Mr. & Mrs. Bennett:
This letter is in response to your request for a determination of the nonconforming status of the
property located at 189 Hightower Road. (Parcel: 075-071-22, Grid: SE4815)
This determination is based upon the as-built survey provided with your request, building permit
records, tax assessment records, our research, and the applicable Municipal Ordinances in
place presently and at the time of construction. The following facts were established:
New Girdwood Townsite Alaska, Block 1, Lot 20 was created by plat 65-70, filed on June
29, 1965.
Municipal property appraisal records (CAMA) currently indicate a mixed
residential/commercial on a 7,702 square foot lot.
September 1, 1978 land use permit issued for a storage building.
May 1, 1980 land use permit number L-513-80 issued for a porch for a single-family
dwelling.
September 24, 1982 aedal photo (flight 36, frame 6) shows a small structure on the
northwest corner of the lot.
September 28, 1982 Jand use permit number L-82-5124 issued for a new 2% story' single-
family dwelling.
December 13, 1983 the property was zoned R-11, Tumagain Arm District.
A photo provided by applicant d§ted October 18, 1984 shows the three stow house with
attached garage and the deck.
An as-built survey by Lantech dated December 31, 1998 shows an existing house with a
large wood deck to the south, to the west and to the east, and a gravel drive to the north.
November 1, 2005 the property was re-zoned GC-7, Townsite Squsre Commercial District,
The information provided by applicant indicates the use of the structure as fotlows:

An e-mail from Tim Bennett dated October t7, 2010 states that the deck has been cut
back to the original dimensions and the height of the landing is 29" to the top of the
platform, photo is attached.
Anchorage Municipal Code (AMC) provisions relevant to this determination are as fotlows:

AMC 21.09.050-1 Allowable uses:
GC-7 -DwelIing, mixed-use
AMC 21.09.060-2) Minimum lot requirements:
A minimum lot size of 6,000 square feet, and a lot width of 50 feet for all uses.
AMC 21.09.060-2 Minimum yard requirements:
Front yard: 16 feet minimum; 20 feet maximum [5]
Side yard: Zero setback permitted on one side [3] and in accordance with
21.09.040,C.2.g,iii (D), if applicable; otherwise 10.
Rear yard: 15 feet
[3]: Zero Lot Line Setbacks - Where adjoining property owners agree to connect
buildings or cooperate in the design of a public passageway or coudyard between them,
a zero lot line side set-back is allowed on one side.
[5]: Maximum Front Setback Exception - Limited portions of building frontage may,
subject to administrative site plan review, be allowed to step .back further than the
maximum aJlowed front setback to create small usable public spaces in the front of a
building.
AMC 21.09.060-2 Maximum lot coverage:
Maximum lot coverage by ail buildings is 70 percent.
AMC 21.09.070 L~_) Off-street parking standards:
(3) gC-7 District. In the gC-7 district, on-site parking for new commercial development is
prohibited. Parking for new commercial development shall be located within the
adjoining right-of-way, or in community parking areas under a municipal parking
agreement. Required parking for upstairs dwelling units in the gC-7 district may atso
be located off-site. Any on-site parking for residential units shall be located on the
side or rear of the principal building and enclosed within a garage architecturally
compatible with the principal building and no closer to the street than the building's
pdmary front facade. On-site parking in the rear setback is prohibited.
(8) Parking surface materials:
Interior roads, driveways, and par.ki.ng areas shall be paved, except paving of
driveways and surface parking areas for single-family and two-family residences is
not required.

The structure is a mixed-use of two dwelling units and retail/office space. Pursuant to AMC
21.09.050-1 the mixed-use is a permitted use in the GC-7.
The structure encroaches 9.6 and 9.7 feet into the required 10-foot north side yard setback and
6.6 feet into the required 10-foot south side yard setback. The deck encroaches entirely into the
required 10 foot south side yard setback, .Since the structure and deck predate Zoninq, the_
house and deck are Le,qa] Nonconforminq Structures and are governed by AMC 21.55....040,
The deck on the southwest corner of the house encroaches approximately 7.5 feet into the
required 15-foot rear yard setback. The information provided by Mr. Bennett states that the
deck was built at the same time as the structure. Since the deck predates zon]nq, the deck is a
~ega_l Nonconforming Structures and are ,qoverned by AMC 21.55.040.
The deck on the northwest corner of the house (rear) encroaches approximately 9~0 feet
into the required 'l§-foot rear yard setback. New information provided by' Mr. Bennett
indicates the deck has been cut back and is 29" in height.
According to the information provided, the one bedroom apartment requires 1% parking space;
the two bedroom aj~adment requires 1% parking space and the retail/office space requires ,4
parking spaces. Total parking required for the mixed-use is 7 parking spaces. A parking plan
was not submitted for this determination. It appears from the as-built survey submitted that
there is sufficient area to provide the required 7 parking spaces. The parking spaces are
located at the front of the building. Pursuant to AMC 21.09.070 states in pad "any on-site
parking for residential units shall be located on the side or rear of the principal building and
enclosed within a garage..." Since the parkin.q area in the front was established prior to zoning;.
the front parking area is a Legal Nonconforming Characteristic of Use and is ,qoverned bv AMC
21.55.100. If the uses change, additional parking spaces may be required.
The. parking area is gravel.. Pursuant to AMC 21.09.07_0(L)(8)_the. parking area is required to be.
paved. Since the gravel parkJn.q area was in place prior to zonin,q, the lack of pavin,q is a Leg~
Nonconformin.~ Characteristic of Use and is governed by AMC 21.55.100.
The deck on the southwest corner encroaches into the utility easement and is in vioiation of
AMC 24.30.020. Please contact the Municipality of Anchorage Right-of-Way division, 343-
8240, concerning possible letters of non-objection regarding the encroachments into the
easements.
