RE: SEPTIC TANK UPGRADE PERMIT
LEGAL: MOUNTAIN PARK ESTATES BLOCK 5, LOT 10
The owner has requested that we obtain a septic permit to upgrade the existing aged steel septic
tank on the above referenced lot. We propose to install a 1500-gallon single-compartment and a
1000-gallon HDPE tank in series per the attached design to serve the existing 6-bedroom duplex
residence. Attached are the ADEC record documents of the referenced property. The lot and
area are served by private wells. The design will not impact any of the neighboring properties.

Gentlemen:
On September 26, 1977, at your request, we conducted a test of the
septic system on the above described property.
During the test, the liquid level in the septic tank was monitored as
water was added to the system. The following table summarizes the
measurements.

The meter used during the test was a Rockwell 5/8" standard water meter
which had previously been calibrated by R & M Consultants, Inc.
If it is assumed that the duplex on the property will house 6 people in
each 3-bedroom unit, the average load on the system can be expected to
be 900 gallons per day or 0.625 gallons per minute.
During the test the system accepted 480.9 gallons or over 1/2 the total
daily load, in 110 minutes. This indicates an acceptance rate of 4.4
gallons/minute.
It appears that the system is accepting effluent at an adequate rate for
a 6-bedroom duplex.

I am as a builder/owner of lot#lO endeavoring to clear all obstacles
i qualifying Jan Carroll,owner of lot# 9, thru VA so he can build
this year. One of the main hurtles has been this water rights thing.
So far I have done the following-
l) sold half interest in water rights to Jan Carroll, recorded with
l0 ft. easement~ across my property
2) had the well tested by M & W Well Drilling ·
3) had engineer approve capacity of well GPM~ 24hr. testing
4) had engineer and plumbing contractor design system for a three
dwelling water service
5) had bacterial test made by your department
6) have your basic approval of system
7) have state approval of system
8) have VA approval of basic system and all legal documents in
order ( Maintanace agreement w/ water rights specified) with
the exception of an easement on one piece of property across
the Alpine Drive,owned by Bo bbie Lee Hobson, Lois D~. ~uchorage.
It is the easement that is holding up everything. Mr. Habson is re-
luctant to give either myself or Mr. ~arroll this option. ~ advised
him to talk with you on this matter. Logically, he should have no
objections to the easement since the 120 radius falls on the highest
corner of his property. This would not be under any terms the
location of any future septic system d~e to the high terrain. The
property owned by Hobson presently can be serviced by a subdivision
commmnity well entering at the rear of his land.
"I am requesting an exemption from the easement requirement by
your department, so that construction can begin as yet this year.

Alaska Communications has no objections to the existing shed and septic vents encroaching into the 10' Utility
Easement located along the western boundary of block 5 lot 10 Mountain Parks Estates Subdivision, otherwise
known as 6121 De Armoun Rd Anchorage, Alaska as depicted on the drawing provided by Frontier Surveys, LLC.
Alaska Communications currently utilizes this easement and has no objections to the encroachment. Alaska
Communications hereby issues this letter with stipulations to allow the encroachments of the above mentioned into the
easement.
Acceptance, (your signature below), and use of this letter of non -objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
1. Alaska Communications will be held harmless, now and forever, for any damages or injury to any
person or property as a result of this encroachment.
2. Any Alaska Communications facility damaged or destroyed as a result of this encroachment will be
repaired at no cost to Alaska Communications.
3. Any costs incurred by Alaska Communications for special construction necessitated by this
encroachment will be borne by the property owner.
4. All applicable safety code regulations will be observed and maintained.
5. This letter of non -objection will in no way preclude Alaska Communications from full use and
enjoyment of its rights within any portion of this easement
6. Alaska Communications is under no obligation to restore any structure damaged as a result of Alaska
Communications full use and enjoyment of its rights within any portion of easements or right-of-ways.

This permit is between Chugach Electric Association, Inc., an Alaska non-profit electric cooperative, (herein
"Chugach"), whose address is P. O. Box 196300, Anchorage, Alaska 99519 and Jared D. Lanmb (herein
"Permittee"), whose address is 6121 De Armoun Road, Anchorage, Alaska 99516.
1. Easement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as follows:
Described in that certain written instrument, recorded on the 4"' day of August 1952, at Volume 76,
Page 275, on file in the office of the District Recorder, Anchorage Recording District, Third
Judicial District, Seward Meridian, State of Alaska,
Described in that certain written instrument, recorded on the 29t' day of May 1958, at Book E3,
Page 252, on file in the office of the District Recorder, Anchorage Recording District, Third
Judicial District, Seward Meridian, State of Alaska,
(herein "Easement") which pertains to the following described real property:
The West Ten Feet (N 10') of Lot Ten (10), Block Five (5), Mountain Park Estates Subdivision,
according to Plat Number P-461, recorded on the 10''' day of September 1958, on file in the office
of the District Recorder, Anchorage Recording District, Third Judicial District, Seward Meridian,
Alaska.
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that Permittee is the
owner of the fee simple interest in the land subject to the Easement and the following described real property
to which the Easement is adjacent:
Lot Ten (10), Block Five (5), Mountain Park Estates Subdivision, according to Plat Nunmber P-461,
recorded on the 10"` day of September 1958, on file in the office of the District Recorder,
Anchorage Recording District, Third Judicial District, Seward Meridian, Alaska,
(herein "Parcel").
2. Encroachment. Permittee has proposed to construct the following improvements on or within
the real property subject to said Easement:

A wooden shed approximately 9' by 12' located on the southwest corner Lot 10, Block 5,
fully encroaches into the easement, and a, septic system with two (2) septic vents that
encroaches approximately six feet (6') into the east side of said easement for a width of
approximately one foot (1'). If Chugach decides to underground the overhead electric
facilities, the homeowner would be required to mark where the pipe is and the depth of it,
(herein "Encroachment").

the Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any claims for
personal injury, property damage or other loss arising in any way from the continuation of the Encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the extent to
which the Encroachment occupies any of the real property encumbered by the Easement without the prior
written consent of Chugach. Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the Encroachment
and any additions thereto, even if in violation of this permit, has not and shall not in the fixture give rise to any
interest or estate in the real property subject to the Easement or any other real property. Without in any way
limiting the foregoing, Permittee acknowledges that the Encroachment is not adverse to any interest of
Chugach and its continuation is entirely with the permission of Chugach for purposes of the common law
doctrine of adverse possession. This permit creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within the Easement
are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of Chugach's total costs for
such modification which is reasonably attributable to accommodating or preserving the Encroachment. If
such payment is not made within thirty (30) days of written demand for same, Chugach may terminate this
permit in accordance with paragraph 9, below.
8. Covenants Running; with the Land. The obligations of the Permittee arising from this permit
shall be covenants running with the land which shall burden the Parcel and the Permittee's interest in the land
subject to the Easement and shall benefit the Easement.
9. Termination. Chugach may terminate this permit after the giving of thirty (30) days written
notice of such termination if:
a. The Encroachment is enlarged, increased, or extended within the real property affected by
the Easement.
b. The Encroachment is damaged by any means to an extent of more than thirty percent (30%)
of its replacement cost at the time of destruction.
C. Permittee fails to make the payment described in paragraph 7, above.
10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years from
the date hereof.

11. Entire Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements, oral or written, between the parties. No modifications, amendments, deletions, additions or
alterations of the permit shall be effective unless in writing and signed by all of the parties hereto.
