Pannone, Principal Registered Professional Engineer E-mail:steve@panengak.com October 19, 2017 Subject: Rabbit Creek View & Heights, Block 1H, Lot 28A Septic System Permit Request Design Narrative This is a design narrative for a permit to install a septic system to be issued for this property. The proposed system.will serve an existing four (4) bedroom house. Currently the lot is developed. The system will utilize an existing 1500g advantex tank with an AX20 pod and a proposed drain field. This lot and the surrounding lots are served by private wells. There are no wells within 100' of the proposed septic system. 1. Soils. One test hole was performed in the area of this system by Aecs in 1984. Ground water was not observed to a depth of 0.8' below the surface in the test hole monitor tube. Bedrock was not encountered in the test hole to 14.5'. One test hole was performed in the area of this system by PES in July of 2010, and groundwater was monitored fo rat least seven days. Bedrock was encountered in the test hole at 0.8' in July of 2010. The percolation rate was found to be 3.42 minutes per inch in this hoel. Based on the results of the percolation tests and overall soils appearance; an ERS system will be used. See waiver request. 2. Soil Absorption System Design. a. See Sheet 1 of the design package. 3. Surface Water: There is no surface water within 100 feet of the proposed septic tank and drain field. The proposed drain field upgrade will maintain at least 100 feet from all surface water and drainage ditches. 4. Topography: The existing topography on the lot generally slopes from south to north, with a slope of approximately 10% in the area of the drain field, with a steeper field uphill of the field. There are no steep slopes within 50' of the proposed drain field. The proposed drain field will maintain 50' separation all steep slopes. 5. Drawing Markings: The Drawings are marked "For MoA Review Only". When written notification that the review is complete and that there are no further comments is received from MoA On-Site Department, the note will be removed and "Issued for Construction" drawings will be issued. Waiver Request for use of Engineered Receiving Soil (ERS). I am requesting a waiver to the 1992 Code to use the proposed Code Update Section of Engineered Receiving Soils (ERS). Below I will detail my request justifying the use of ERS: a. Two test hole were excavated in the vicinity, one by PES in July 2010 and one by Jerry Hart in 1984. The soils logs are attached. Ground water was found at 0.8' in July of 2010. b. This design proposes to use MoA Type II. This interface will be approximately 4 feet in depth and will be compacted to approximately 80 percent to allow free flow of the effluent through it into the native soil using MoA Waste Water Code application rates. The infiltration area of the interface between the ERS and the in-situ soil was based on the 31-60 minutes per inch percolation rate of the in-situ receiving soil. A two foot thick filter sand layer will be placed over the MoA Type II material to act as an interface between the SAS and ERS. c. The SAS is sized assuming a percolation rate of the ERS soil, assumed 6-15 MPI, which gives an application rate of 5 GPDSF. d. The system will protrude above the ground surface.The cover of the system will produce a mound, which will have at a minimum, three to one side slopes and six inches of organically rich soil to promote the growth of vegetation.The mound will be vegetated. e. Shallow Ground water was observed in the test hole. Steps need to be taken to protect this shallow ground water from contamination with sewage effluent. These steps include the use of advanced wastewater treatment system to ensure a high quality effluent and maintaining at least four feet of vertical separation from the highest ground water and the bottom of the drain field (our design is calling for 4 feet vertical separation.) f. Supplemental test holes are not necessary due to the vertical, not horizontal conveyance of effluent. The proposed installation will not affect the future development of this or the surrounding lots. The proposed systems will serve an existing four- bedroom house. Currently the lot is developed. The lot is served by a community water supply. The existing septic system shall be modified and reused. The west 600 sf will be removed and reconstructed. Contaminated native soil will be removed as required and replaced with filter sand. The middle ten feet will be removed and replaced with native fill to create a buffer between the new primary and new reserve field. The surrounding developed lots are served by private water systems and community water system. The private wells are located over 100 feet from the proposed soil absorption system. The community well is located over 150 feet from the proposed upgrade. 1. COSA. The Owner is in the process of selling this property. The existing system was located and inspected. The system was tested for operation and was found that it could not accept the required 150 gallons per bedroom per day (600 gpd). The system is able to absorb approximately 10 gallons per day. The intent is to install an upgraded septic system in the spring of 2010 by August. The septic tank and drain field will be pumped approximately every two weeks to keep the sewage from day -lighting on the ground. Funds for the pumping and installation of the new tank and field will be escrowed at the time of the sale. 2. Soils. A single test hole was excavated by Pannone Engineering Service in March of 2010. See the soil log attached. Leroy Reid also performed a soils test in 1984. PES found the soils to be similar to Mr Reid's. A curtain drain is installed uphill of the system and appears to be working. Ground water was monitored for seven days. No ground water was monitored to a depth of 10 feet below ground level after the monitoring period. Bedrock was not encountered in the test hole. It is my opinion, based on the results of the percolation tests and overall soils appearance; an application rate of 1.0 gallons/day/square feet should be used, using an advanced wastewater treatment system. 3. I was authorized by the Owners David Stevens to excavate a single test hole to determine the suitability of the soils for an upgrade system. I contacted Mike Blakslee with A+ Home Services and he mobilized his Cat 420 Backhoe to the property. Below is a summary of my investigation. We excavated the first test hole at the western end and north of the of the existing drain field. The excavation only went five feet deep. We encountered three feet of peat with a gray silty gravel below. The edge of the existing drain field was encountered at four feet. We stopped and moved east so our test hole would not be influenced by the existing field. The second test hole was excavated approximately 15 feet south of the north property line. We encountered one and a half feet of peat, with gray silty gravel underlying it to a depth of four feet. A brown poorly graded gravel to silty gravel was encountered from four feet below ground level to 10 feet below ground level. This is the soil that the original engineer encountered that had a percolation rate of 35 minutes per inch. No ground water was encountered. We installed a monitor tube in the excavation to log the ground water depth. The soils encountered are suitable for an advanced wastewater system. I contacted the MoA and discussed the situation with Ms. Debbie Wockenfuss. We come to a consensus that the best option for this property is as follows: • Abandon the existing septic tank in place per code. • Install a new Advantex wastewater treatment system (1500 G tank, AX20 Pod, NO auxiliary pump vault. • Reconstruct the western 20 feet of the existing drain field by removing the biomatted gravel and underlying native soil, installing a 12 inch sand layer, and the constructing a new 600 sf (30' by 20') drain field. The contractor will have the option to use either sewer drain rock or HDPE bio -diffusers as the drain field material. (I am adding this as a possible cost savings option without loss of quality.) • The remaining portion of the drain field will be re -plumbed and reused at a later date. • The two drain fields will be separated by a new diverter valve between the new treatment system and the two drain fields. • When all is complete, the property will have two drain fields and a new treatment system. Per my proposal letter, we are able to proceed with obtaining a conditional COSA for the sale of the property. Baird, Assistant Municipal Attorney SUBJECT: Opinion request of July 25, 1985 Re: Rabbit Creek Heights/View Subdivision Your request for opinion of the above-referenced date directed to Mike Marsh has been referred to me as the Assistant Municipal Attorney dealing with land matters. The issue which you raise is which of several possible potential surveys of these subdivisions should be used for purposes of issuing on-site sewer and well permits. It is my understanding that plats for these subdivisions were recorded in 1970. Both plats contain significant survey errors to the extent that conflicting descriptions can be given for the same lot based on either the monuments in place or the infor- mation on the survey plat and that described lot areas overlap. It is clear that accurate descriptions of the physical location of well and septic systems can be reasonably required in connec- tion with your permitting activities pursuant to AMC 15.55 and ].5.65. Correct location of water wells and septic systems is probably critical to the safe and efficient operation of well and septic systems which is one goal of these two sections. Since we now know that the survey information in the two described sub- divisions is inaccurate, the Municipality can lawfully insist upon an accurate survey before granting permits for water wells or septic systems under these two sections of the Municipal Code. I have been unable to find any provision in ordinance or statute creating a public duty of the Municipality to survey private lands. The platting regulations appear to contemplate that any survey work done would be at the expense and direction of the subdivider. See AMC 21.75 and 21.80. While it might be argued that the Municipality incurred liability by negligently approving erroneous plats for these two subdivisions, the statute of limi- tations for any claims arising from such negligence is two years and has probably long since run. See A.S. § 09.10.070. Even if the statue had not run, a Municipally sponsored and financed sur- vey would not necessari.ly eliminate the Municipality's exposure to claims arising from the erroneous approval of the plats. Any new survey conducted by the Municipality or any private party will not resolve the potentially conflicting property rights of homeowners within these subdivisions. Many of these homeowners October 15, 1985 Page 2 undoubtedly .purchased property described by reference to the erroneous surveys and have owned the property pursuant to deeds utilizing these surveys for more than seven years. There is a high probability, under such circumstances, that rights to the real property have vested by virtue of adverse possession. See A.S. § 09.25.0501 Frankly, given the circumstances you have described, the potential of conflicting claims among property owners within the subdivisions creates a real mess. The solutions for the homeowners will undoubtedly involve signi- ficant expense to them. First, if all property owners within the subdivision, together with any holders of liens or encumbrances of any of the lots within property and the Municipality of Anchorage can all consent to a replat of the subdivision, then, that replat would be binding on all parties, and would certainly be a sound basis for the issue of well and septic permits. The difficulty with this procedure is that it would require the con- sent and cooperation of all property and lien holders. Second, the property owners could individually or collectively bring actions in the Superior Court to quiet title to their individual lots, A.S. § 09.45.010 or actions to establish boundaries, AoS. § 09.45.020 .or some ~combination thereof. A judicial deter- mination entered at the conclusion of such an action would finally and forever resolve issues as to lot boundaries. Third, some combination of a replat and law suit might be possible there are "hold-outs" from participating in a replat process. Such hold-outs could be made defendants in a quiet title action brought by the other homeowners. In summary, I believe you may lawfully insist on an accurate sur- .vey as a condition to issuance of well and septic permits pur- suant to the above-referenced sections of the Anchorage Municipal Code. Given the known inaccuracies of the survey on which the existing subdivisions are based, and the grossness of errors, you need not accept as-built surveys which are based upon either the lot corners set in the field or the filed survey information. Finally, a simple resurvey of the subdivisions will not resolve questions regarding the location of the lots which will be binding on parties and therefore will not be a more accurate basis upon which to issue well and septic permits. The choice of remedy of the land owner as to how to resolve this issue is something for them to pursue among themselves with the advice of ~ common'or individual legal counsel. Upon discovering these discrepancies, this office discontinued the issuance of on-site sewer and waker permits and health authority approval certificates until such time that there is an acceptable assurance that configuration/ corners/boundaries of a candidate lot are ii1 agreement with an approved and[ recorded subdivision plat. In order to satisfy 'the above requirement, this office will issue a permit or certificate upon receipt of a certified survey conducted by a registered surveyor(other than Mr. William Johnson) with the survey taken from and closed on a known and established permanent monument. Site Just above intersection of George Court and Nickleen Street where Rabbit Creek crosses Nickleen Street has an improperly installed straw bale/silt fence (see fig. I, II). The straw bales in this case don't effectively block the flow and much of it runs around side of bale, thereby defeating purpose of the bales. Water samples were taken at this site on Rabbit Creek above the road, below the road, and in the small drainage ditch that flows around straw bale in figs. I, II. Site 2, located just above the intersection of Francesca Drive and Carl Street where Rabbit Creek intersects Carl Street was sampled above the road and above the drainage ditch running alongside road and draining into creek. Another set of samples was also taken well below road. Heavy sediment loads were visually observed in creek and especially heavy sediment loads were observed in the 2 drainage ditches running down both sides of Carl Street and emptying into Rabbit Creek. No straw bales/silt fences were obsel~ed in place on either of there ditches at their junction to Rabbit Creek. According to the plat map provided by Department of Public Works these ditches were supposed to have straw bales/silt fences installed in them. None were observed. All water samples will be tested for suspended sediment, fecal coliform, and turbidity. Results will be reported as soon as analysis is completed by Alaska Testlabs. Prior to performing any alterations to an AW WTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of Q ($____.00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: \ AIAI dL_X C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nonwaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B.
