Ref: Proposed Well and Septic System for Rabbit Creek View & Heights SID: Block 6H,
Lot 6A
To whom it may concern:
The proposed 3 bedroom house is to be served by a private well and septic system.
Four (4) test holes were excavated on the property. The proposed design is utilizing an
ERS. There are 4 properties adjacent to this lot which have been designed utilizing
ERS. As can be seen on the attached site plan Lot 7A, Lot 1A, And Lot 2A all were
designed by Steve Pannone, P.E. and approved for installation and based upon our
recent site visits, all the drainfields have been installed for these lots. Mr. Pannone also
designed, inspected, and documented an ERS on Lot 18A. We have designed this ERS
using similar design procedures for these adjacent properties that were approved by
your department. We have designed the new ERS drainfield around TH#4. We were
unable to perform a percolation test on native soils due to the saturated condition of the
soils. However, we did pull a soil sample and took it to Alaska Test Lab and had them
run a soil classification and sieve analysis (see attached results). It was deemed to be
SM soil. Based upon these results, we have assumed a 30 to 60 minutes percolation
rate and have proposed using a 1 .0 gpd/sq.ft. application rate for the native soil
receiving Cat II effluent. We are proposing to use a 2.0 gpd/sq.ft. application rate for the
ERS. Mr. Pannone used this similar method of soils testing on three (3) of the four (4)
ERS designs for the adjacent properties which were approved by your department. We
are proposing to request a waiver to utilize a Cat II Quanics Aerocell system instead of
a Cat III system (see below request). If you require physical inspection of the soils for
TH#4, we did pull a soil sample for the Peat and an additional soil sample of the SM
material. We will gladly bring these by your office if you would like to see the soils
conditions. In regards to the reserve site, we are proposing that in the event of the
primary drainfield failing that the drainfield be rebuilt to meet the reserve drainfield
requirement. The proposed well is to be drilled at the location shown on the attached
site plan. Comments regarding the design are summarized as follows:
1. SOILS: See the attached logs which shows the soil classifications, groundwater
monitoring, and the percolation test results. See the above paragraph explain the soils
conditions

2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications.
3. SURFACE WATERS AND SUBSURFACE DRAINS: There is a drainage ditch that
runs along Nickileen Street that runs with surface water for a majority of the year. We
propose being 100+ feet from this surface water. There is a small area that has
pooled/trapped water that is believed to be from snow melt along Denise Circle. We have
contacted the adjacent property owner who lives at the end of Denise Circle and based
upon our discussion with him, he has stated that this water dries up during the summer.
We are proposing that the contractor fill and grade this area so that in the future water is
not able to pond in this area.
In regards to subsurface drains, as can been seen on the site plan and design drawings,
there are several subsurface drains that have been installed. There is a subsurface drain
downhill from the proposed drainfield (to the North), that the adjacent property owner
installed. We are proposing to be 20+ feet from this subsurface drain with the proposed
drainfield. See waiver request below.
4. TOPOGRAPHY: Based upon spot elevations across the property provided by Holt
Surveying, the topography in the area of the proposed drainfield ranges from 5 to 10
percent running approximately North to South. Per the fill and grading code, no fill may
be placed within 2 feet within property line (site boundary) or one half the vertical height.
Since we are anticipating 6 to 7 feet high mound, this would mean the toe of the slope
would need to be 3 to 3.5 feet from the property line. We have shown the toe of the slope
4 feet from any property line. In short, there appears to be no slope concerns.
5. WAIVER REQUESTS:
• Waiver to allow ERS system: As stated, we are requesting a waiver to allow an
ERS system with vertical conveyance to be installed on this property. We have are
proposing to use the proposed Revisions to the wastewater code to allow for this
installation.
• Waiver to allow a Category II advanced wastewater system in lieu of a
Category III system: Per the proposed Revisions to the wastewater code, an ERS
system requires the use of a Category III advanced wastewater system. We are
proposing using a Category II Quanics Aerocell system for this installation. The
sampling data for a Category II and Category III Quanics Aerocell system are very
similar in treatment level. Given that after the treatment process, the treated
effluent will pass through 2 feet of MOA approved sand filter and then another 2
feet of classified Type II before reaching the high groundwater table; it is our
opinion that the effluent should meet tertiary treatment levels. Based upon this
information, it is our opinion that there is sufficient justification to allow for the
installation of a Category II advanced wastewater system.
• Waiver to separation to the test hole: As can be seen on the design, we are
proposing that the drainfield be installed over Test Hole #4. Since the installation

will include the installation of 5+ feet of type II fill, there should be no concern with
installing this drainfield near or over this test hole.
• Waiver for SM soils to be used for ERS: The in-situ receiving soils were below
the water table when we excavated the test hole, which made it impossible to
perform a percolation test. GEG did have a sieve analysis classified by Alaska Test
Lab. The sieve analysis classified the soils as a silty sand with gravel (or SM under
the Unified Soils Classification system). The proposed ERS code limits the use of
ERS in soils classified as GP, GW, SP, or SW. We are requesting a waiver be
granted for this ERS to be installed in SM soils. This requirement was waived on
Mr. Pannone's designs for Lots 7A, 1A. & 2A which had GM to SM soils. Given the
precedence set with the issuing of these other permits, it is our opinion that a
waiver be granted for this property as well.
• Waiver for drainfield to a subsurface drain: Per the proposed Revisions to the
wastewater code (15.65.201 , paragraph 1.f), a drainfield will be allowed to be 10
feet (or two times the effective depth) from a subsurface drain that is downhill from
proposed drainfield. We are requesting that this setback apply to this design.
We are unaware of any adverse impacts this installation would have on adjacent wells or

MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On-Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On-Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On-Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
I. Owner agrees to provide and maintain a telephone connection to the AWWTS as
required by the AWWTS approval.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are: /

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

I have encountered several major problems in attempting to
develop a septic system for the reference property.
First, the two test holes do not perc. This means the soils in
the areas of the test holes do not accept and allow water to pass
thru. The soils went from peat and organics at -the surface to
clays. See attached soils log.
Second, the lot has ditches with running water on three sides of
the lot. It appears these ditches run water wheather it is
raining or not raining. Therefore, a septic system located on
this lot must maintain a separation distance from these ditches
of 100 feet. A sketch showing the lot and the 100 foot water
separations is attached. As you can see, there is no area
available for the design or construction of a septic system.
With both of the above factors against a septic system, it is my
opinion that the property will not receive approval for a
traditional septic system.
If you still wish to try and develop this property, you have two
options: a holding tank system or an innovative sewage treatment
system. I must caution you that both are very expensive.
A) Holding Tank --We would need permission from Municipality to
install a holding tank. The Municipality usually does not like to
approve holding tanks for new construction unless there are some
assurances that the holding tank is a temporary situation. You
would also probably need a pumping contract. A word of caution,
because of the property location, a pump Wtruck may not be able to
reach your property in the winter.
B) Innovative Sewage Treatment System --These systems are very
expensive to purchase, install, and operate. This system
basically takes the home sewage and treats it to the point where
the effluent can be discharged into the creek. The Municipality
has strict monitoring programs which would require you to have
regular sampling and testing of the effluent by an approved
laboratory.

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the"OWNER,"and the Municipality of Anchorage,herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein,the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS),described as

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On-Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code(hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On-Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement,and any renewals thereof,at the owner's sole expense,to pay
for any and all: (1)repair(s),(2)maintenance,(3)adjustment(s),(4)replacement
costs,and(5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws,regulations,rules
and orders for the AWWTS.
C. Upon request by the Municipality,the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance,repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On-Site Systems Approval.

H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.

8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.
