Homan $%~ject: Lot 9 Block 8 Prator Subdivision The residence in question was occupie~ by Mr. Weinig during this department's initial inspection of the sewer m~d water facilities. Unfort~ateiy, the sewage absorption area location is unkno~n as vents for access are missing. Since the location is unknown an~ thought to be in violation from information supplied by the real estate agent, this department offered two(2) options. (1) Uncover components of the sewer system to establish desitin and location for evaluation° (2) Escrow monies for a new on-site system. To facilitate closing the escrow option was utilized. The existing system may absorb sewaue at.a~, acceptable rate for current residence, however, its~prox~m~ty to the well is unknown. Additionally, the well could at some future date become contaminated. ~ This department still requests; (1) the existing facilities be locate~ to determine if an a~equate separation between well and sewer exist and, if indeed, the separation is adequate, the absorption rate be tested to national standards and the septic tank pumped or; (2) a new on-site sewer system be installed per ~,~unicipal ordinances° If there are any further questions, please contact this office at 264-4720. Buchholz Sanitarian Municipality of Anchorage Pouch '6-650 Anchorage, Alaska 99502 Ref: Lot~, Block 8~ Prator Subdivision; Dear Mr. Buchholz; Weinig, Richard A. et ux As you are aware, we have been holding an escrow for completion of the sewer system to meet the Municipal standards since April 15, 1976. In that the real estate agent in this case~ Whitney Ellison has been unable~ in her opinion to gain free access to the property to place a sewer system upon the Same because she has not been able to reach a proper agreement with the owners, Mr. and Mrs. Richard A. Weinig, we have held Mrs. Ellison;s funds in escrow as guaranty of completion of the sewer system to meet Municipal standards for a period of approximately 2½ years. We desire to complete whatever arrangements are necessary to satisfy the requirements of the escrow for purposes of insuring that we have an adequate sewage disposal system upon the site. Apparently, the system is totally adequate for the Weinigs as they report no failure. It seems we are in an impossible situation as we understand it. But in any event, in view of the escrow agreement and the legal documents, the Weinigs have signed with this Bank, it is our position that we will proceed to resolve this matter forthwith. At this time, we would like to be advised as to the specifics of why the sewer system does not meet the standards of the Municipality of Anchorage. If in fact, it is inadequate, we would like to know exactly what must be done to bring it to compliance for it is totally inappropriate for us to continue to hold funds that were given us Richard A. Weinig et ux 27 September 1978 by the seller or his agent in perpetuity because they are unable to reach an agreement to enter the premises and complete whatever improvements must be made. Your early consideration of this request prior to inclement weather preventing construction.
