Your request for a waiver of the required 50 feet horizontal separation (prior to 1983) from the
public sewer trunk to the private well has been approved. The approved separation distance is 41
feet.
This waiver approval applies to the existing improvements only. Any future upgrade to the on-
site wastewater disposal system will require all separation distances be met or another approval
from this department.

Separation Distance Waiver Well to Absorption Pit
Dear On Site Services Engineer:
The well on the subject lot was constructed in 1971 approximately 2 years after the septic
system was installed on Lot 5. At the time of installation Municipal Code required a 100'
separation distance from the well to the absorption pit. Details concerning the placement of the
well at its current location are unknown, but the well is only 84' from the edge of the absorption
pit on Lot 5. A waiver must be obtained before a Certificate of On Site System Approval
(COSA) can be issued for Lot 6. We are therefore requesting a waiver be issued allowing the
well to remain in its current location.
The well is more than 125' deep with casing the entire depth. The only well log available from
the area indicates the well is drilled through what appears to be impermeable clay with gravel
and silty clay layers through at least 45' of the depth. The aquifer level is not encountered until
123' below the ground level where the pump is placed. The static water level was found at 50'
below the surface.
The original ground surface on the lot slopes from the well and toward the absorption pit at an
approximate 2% slope. We assume the water gradient slopes away from the well at a slope
similar the original ground surface.
A recent water quality test taken from the well indicated.only a slight amount of nitrate content
(.40 mg/L). The absence of nitrates would indicate no contamination of the well water from
septic effluent from either the septic tank or the absorption pit on Lot 5. No coliform or bacteria
was found in the water further indicating contamination is not present in the well.

Almost sure to be free from any form of contamination from household sewage.
Attached are the well log, water quality results and other drawings showing the proximity of the
existing septic system to the well. We hereby request the waiver be issued and the Certificate
of On Site System Approval (COSA) be approved.
The sewer main fronting the property was constructed in 1983 one year after the well was
placed. The main is only 41' from the well. It uncertain whether AWWU ever applied or was
granted a waiver allowing the main to be less than 75' from the well. We are therefore
requesting the waiver be granted. The sewer main is constructed of 8" Ductile Iron Pipe Class
50. It is thought to be in good condition based on maintenance records from the area. It is
located at 8' to 10' below grade which is approximately 115' above the pumping level of the well.
We again refer to the water quality results from the well. Little or no contamination is present in
the well water indicating the proximity of the sewer main has no adverse impact on the well. We
therefore recommend the waiver be issued allowing the well to be 41' from the sewer main.

In accordance with U.S. Public Health Service Recommendations, we com-
pute the sewage flow to be 60 gallons per person per day. On a weekly
basis this figures to be 11260 gallons a week for three people or
2,520 gallons a week for six people. To my knowledge, pump tanks oper-
ating in this area have a maximum holding capacity of 2.000 gallons.
Rased on this and the fact that occupants are aware the system has to
be pumped periodically and will not be running excess water, this de-
partment recommend& the system be pumped bi-monthly for three people
and weekly for six people.
The Manual of Septic tank Practices,
U S Dept of Health, Education,
and Welfare, Public Health Service Publication No. 626, page 42,
states: "Estimates of sewage quantities: Water consumption by an
ordinary family in an apartment building may average 48 gallons

water per person per day over a period of three months,
but actrange from perhaps 30 gallons per person on certain days to something
in excess of 80 gallons per person on days when water consumption is

RE: Lot 6, Jovon Subdivision
On October 18, 19739 I was called to testify at a hearing
at the office of the Attorney General, Consumer Protection
Section, regarding the sewer and water facilities located
on the above subject lot. The present owners of Lot 6
filed a complaint against former owner of the property,
Mr. Bud Allison. (Refer to complaint copy in file)
The Greater Anchorage Area Borough no longer approves this
sewer and water system for the following reasons:
1. A permit was taken out for a three-bedroom
single family dwelling. A six -bedroom du-
plex was constructed. The sewer system was
not installed accordingly.
2. The sewer system is not functioning prop-
erly and is being pumped on a routine basis.
3. The well does not meet former semi-publi /a
well distance requirements.

The house duplex was sold to us in Feb. 19%2. It was our understanding that it
met Borough requirements for a duplex. In April 19'73 we started to have
sewer problems. At first we thought it was a clogged line. Then we found out
that the drainage field was full, so we had it pumped. Now we are having it
pumped on the -average of every 10 days 6 15.00 a truck load. We decided to
upgrade the system so I callPthe Department of Environmental Quality Control
to inspect and recommend what should be done., They said there was nothing we
could do as at didn't meet or there was not enough room to put in the required system
for a duplex, so we would dust have to have it pumped until the public sewer
came into this area. Then I said that I wondered if the system was big enough
for the duplex and Mr Coad said he would check his records. Here it was found that
his Bud Allison's application was for a 3 bedroom single family dwelling. He

AND CONSUMER PROTECTION.
Sec 45.50.471. UNLAWFUL ACTS AND PRACTICES. (a) It
is unlawful for a person to
(1) fraudulently convey or transfer goods cr
services by representing them to be those of another,
(2) falsely represent or designate the geographic
origin of any goods or services,
(3) cause a likelihood of confusicr or raisuna-r-
standing as to the source, sponsorship, or aoDroval, or
another person's affiliation, connection, or association
with or certification of goods or services,
(4) represert that goods or services have sDcn-
sorship, approval, characteristics, ing,edients, uses,
benefits, cr cuantities that they do not have or tna: a
person has a spor.sorshio, approval, status, affiliation, or
connection that he does rot have,
(5) represent that goods are original or nei, if
they are deteriorated, altered, reconoitioned, reclaired,
used, secondhand, or seconds,
(6) represent that goods or services are of a
particular standard, quality, or grade, or that goods are
of a particular style or model, if they are of another,
(7) disparage the Foods, services, or husiness
of another by false or r.Ssleading representation of fact,
(8) advertise goods or services with intent not
to sell them as advertised,
(9) advertise goods or services with intent not
to supply reasonable expectable public demand, unless the
advertisement prominently discloses a limitation of quan-
tity;
(10) make false or misleading statements of fact
concerning, the reasons for, existence of, or amounts of
price reductions,
(11) engage in any other conduct creating a like-
lihood of confusion or of nisunderstandin, ana which mis-
leads, deceives, or dar•ages any buyer or co^vetitor in
connection witn the sale or advertisement of goods or
services,
(12) use or employ any deception, fraud, false
pretense, false promise, misrepresentation, or kroxingly
conceal, sup,)ress, or o^it any material fact with intent
that others rely upon the concealment, suppression or onis-
sion in connection with the Sale or advertisement of goods
or services wnether or not any person has in fact been
misled, aeceived or damaged;
(13) fail to deliver to the customer at the tine
of an installment sale of goods or se -vices, a written
order, contract, or receipt setting out the name and address
of the seller and the name and address of the organization
which he represents, and all of the terms and conaitions
of the sale, including a description of the goods or ser-
vices, which shall be stated in readable, clear, and
unambiguous language.
(b) The unlawful acts and practices listed in (a) of
this section are in addition to and do not limit the types
of unlawful acts and practices actionable at common law or
under other statutes of this state.
(c) when a person is tried under the crimi 1 provi-
sions of this chanter for engaging in an unla.rful act or
practice under this chanter, it must be shown that he acted
knowingly and with intent.

(1) an act or transaction permitted under lays
administered by the state, by any regulatory board or com-
mission, or officer acting under statutory authority of the

or employee of a newspaper, periodical or radio or television
station in the publication or dissemination of an

Sec. 45.50.501. RESTRAIVIdG PROHIBITED ACTS. (a)
When the attorney general has reason to believe twat a per-
son has used, is using, or is about to use an act or cractice
declared unladful in sec 471 of this chapter, and that
proceedJnE,s %ould be in the public interest, ne ray bring
an action in the name of the state against the person to
restrain by injunction the use of the act or practice The
actJon may be brought in the superior court in the .judicial
district in which the person resides or is doing b,.siness
or has his principal place of business in Alaska, or, .with
the consent of the parties, in any other judicial district
in the state.
(b) The court may make additional orders or jud--^ents
that are necessary to restore to any person in interest any
money or prc,erty, real or personal, wnich ray have been
acquired by means of an act or practice declares to be
unlawful by sec. 471 of this chapter.
Sec. 45.50.511. ASSURANCES OF VOLUWARY CO'IPLIANCE.
In the administration of secs. 471 - 561 of this c^apter,
the attorney general may accept an assurance of vol --tart'
compliance with respect to any act or practice corside^ea
to be violative of secs 471 - 561 of this canter Prem a
person vho has engag-d or was about to engage in sues an
act or practice. Such an assurance shall be in 4riti-7 a -d
\ shall be filed +,ith and is subject to the approval of t -e
superior court in the judicial district in :.hich the a! -e --ed
violator resides or is doing ousiness or has nis pr_nciral
place of business in Alaska. Such an assurance of vol -hart'
compliance is rot considered an admission of violation for
any purpose Natters closed in this way .:av at any t_
be reopened by the attorney general for further prcceeaings
in the public interest, under sec. 501 of this chapter.

Sec 45 50 531 P9IIATE AdD CLASS ACTIONS. (a) A
person wno puro�ases or 1_ases .hoods or services and there-
by suffers an ascertainatle loss of money or Droperty,
real or personal, as a result of anotrer person's act or
practice declared unla.,ful by sec. 471 of this chanter, may
bring a civil action i^ the juaicial district in anic� the
seller or lessor resides or has his principal place of
business or i^ doing busi-ass, to recc✓er actual damages
or $200, whicnever is creator. The jury or, if the action
is tried without a jury, t"e judge may, in cases of wilful
violation, award uo to three times the actual damages sus-
tained, and in all cases tre court may provide equitable
relief it considers necessary or proper
(b) A person entitled to bring an action under this
section may, after investigation by and approval of the
attorney ten-ral, if the Lnlawful act or cractice has caused
similar injury to numerous other persons similarly situated
and if he adequately represents the similarly situated
persons, bring a, action on behalf of himself and other
similarly injure-, aro situated persons to recover actual
damages. A person nlarhinto cring an action under tnis
subsection shall first sib --it to the attorney general a
COPY of his proposed cc olaint, and he rav not file the
complaint in court litnout t^e attorney general's approval.
In an action brought urdar t�ls subsection, the court may
in its discretion order, in audition to damages, injunctive

(c) Upon commencerert of an action brought under this
section the clerk of the court shall mail a copy of the
complaint or other initial pleading to the attorney general
and, upon entry of an order or Judgment in the action,
shall mail a copy of the order or judgment to the attorney
general.
(d) In an action brought by a person under this sec-
tion, the court may awd^d, in addition to the relief pro-
vided in this section, reasonable attorney fees and costs.
(e) A permanent injunction or final Judgment against
a person against whom an action was initiated under sec
501 of this chapter is prima facie evidence in an action

brought under this section that the person used or erploled
an act or practice declared unlawful by sec 471 of ttis
chapter.
(f) No person may corpence an action under this sec-
tion more than too years after he aisco✓3rs or reaso-acli
should have discoaered th.it nic loss resulted from an act
or practice declarea unlawful by sec 471 of this chapter.
(g) If the court finds for the defcnda•.t in an action
brought under this section, it may award the defenaant an

(b) Notrithstanding the absence of such a notice on
a note, instrument or evidence of inaebteaness arising out
of a censurer credit sale or consumer lease as uescribca

court, may recover, on behalf of the state, a civil penalty
of not more than $5,000 per violation.
(c) A person who engages in a course of conduct
declared unlawful by sec. 471 of this chapter is, upon

conviction, punishable by a fine of not more than $10,000,
but this subsection noes not limit any other provision of
secs. 471 - 561 of this chapter.
Sec. 45 50.561. DEFINITIONS. In secs. 471 - 561 of
this chapter
(1) "advertising" includes the attemot directly
or indixectly by publication, dissemination, solici,ation,
endorsement or circulation, display in any manner, including
solicitation or dissemination by mail, telephone or door-
to-door contacts, or in any otner way, to induce dx.rectiy
or indirectly a person to enter or not enter into an obli-
gation or acquire title or interest 4n any merchandise or
to increase the consumption of it or to make a loan,
(2) "documentary material" means the original
or a copy of a book, record, report, memorandum, paper,
communication, tabulation, map, cnart, photogranu, mechani-
cal transcription, or other tangible document or recording,
wherever situate,
(3) "examination" of documentary material in-
cludes the inspection, study, or coping of the material,
and the taking of testimony under oath or acknowledgement
in respect of documentary material or copy of it,
(4) "seconds" means manufactured items having
flaws or consisting of a standard quantity or quality less
than the manufacturer's quality standard.
