It is recommended that a waiver to the horizontal distance of 150 feet be granted for the operation of this well to serve both the multiple family dwelling and the single family dwelling located on the referenced property. The septic systems located on these properties pre -date the horizontal distance requirements established by current code. It is felt that the soil conditions in this area will provide adequate purification of the water to allow its return to the water table. The installed wastewater disposal system [2 1250 gallon two compartment septic tanks (it, series) and 1,200 square feet of soil absorption system] appears to have been properly sized for the waste stream being generated by the sixplex. In addition, it appears that the installed system was installed in accordance with the minimum design requirements of the State Wastewater Disposal Regulations and guidance. Therefore, in accordance with State Wastewater Disposal Regulations [18 AAC 72], final operation approval is granted. A Construction and Operation Certificate, with the operation section signed, constitutes final operation approval for this project. Thank you for providing information on the Point of Entry (POE) treatment device that was installed to reduce the nitrate levels to a level below the Maximum Contaminant Level of 10 mg/l. Once the owner of the Class C public water system submits the Class C public water system registration form, I will make sure this information is included in the Department's database. In addition, we will be notifying your client and the owner of the Class C public water system of a monitoring program that will need to be put into place to ensure that the existing POE treatment device is properly operating. Currently, for Class A and B public water systems with levels of nitrates, POE treatment devices to reduce the nitrate levels are not acceptable. We are currently collecting information on the number of, the ownership of, the different types of sources, and contamination being found in water being provided by Class C public water systems. This project may result in POE treatment Michael E. Anderson Page 2 08/08/02 devices not being approved for use by Class C public water systems. As a result, the POE treatment unit may have to be removed a treatment system that will treat all the water from the source well will need to be installed. The above issued approval does not imply the granting of any additional authorizations, nor obligate any local, state, or federal regulatory body to grant required authorizations.
