PERCOLATION TEST RESULTS
AND
GENERAL SITE INVESTIGATION REPORT
This letter is a request for a septic upgrade permit on the above -referenced property. The lot,
located on Anvik Circle, is approximately 17,794 square feet with a three-bedroom residence.
On August 28, 2005, an inspection was made and the septic system was found to be in a failed
condition. The original system was installed in August 1972, and a new septic tank was installed on
October 14, 1988, in the same location as the original tank, which is under the paved driveway.
Four inches of insul foam was placed over the top of the tank. The only place for an additional leach
field is in the front yard in an area referred to in an Encroachment Non -Objection and Agreement
signed by Wayne D. Carmony of MEA, dated August 24, 2005, stating that, "A septic system will
encroach on the platted anchor easement located on the east boundary of the above parcel." (See
attached copy.)
The owner has had considerable problems with the septic system over the past three years,
necessitating frequent pumping of the tank and crib.
On August 30, 2005, a test hole was dug to a depth of 16 feet, with a perc rate of 4 minutes per
inch. No water was encountered after a seven-day monitoring period. The test hole monitoring
tube is still in place, and there was still no water in the tube as of August 28, 2007.
The existing 1,000 gallon tank will be abandoned according to code, as well as the 18'x16', 6' E.D.
crib. There are no native trees in the front yard; there is one small ornamental tree that will have to
be relocated.
Attached is a design package for the new system with a 1,500 gallon Anchorage steel tank and
Advantex system with an AX20 Mode 1 A filter pod for up to 4 bedrooms.

The water line was relocated in 2007 as shown on the plan view, and a representative of AWWU
was present to inspect the relocation. Seward Land Surveyors verified the location of the back right-
hand comer of the lot line (as viewed from the front of the house) to be 3' inside Meadow Creek.
On-site observation and physical survey show that there are no water wells or private wastewater
disposal systems within a 100' radius of the proposed system.
The proposed system will have no measurable impact on surface or sub -surface drainage, or on
drainage from adjacent lots. It appears that there is no potential for contamination of adjacent water
wells or streams from known sources. Also, the proposed development will not prohibit future
development of any neighboring lots.

ENCROACHMENT NON -OBJECTION AND AGREEMENT
THIS AGREEMENT, made and entered into this day of A 2005, by

member owned electric cooperative, whose post office address is Box 2929, Palmer,
Alaska, 99645, hereinafter called "MEA", and BKB LLC whose address is 18540

Applicant is the owner of the property described as Lot 6, Block 5, BLOCK
5 EAGLE RIVER HEIGHTS -NORTH SUBDIVISION, located in T14N, R2W,
Section 12, S.M., according to Plat 71-220, Anchorage Recording District,
Third Judicial District, State of Alaska.
Encroachment(s) Description
A. A septic system will encroach on the platted anchor easement located
on the East boundary of the above parcel.
NOW, THEREFORE, for and in consideration of their mutual agreements MEA,
for itself, its successors and assigns, waives its objections to Applicant's
encroachments as described in the paragraphs above, subject to the following
conditions:
Applicant shall indemnify and hold MEA harmless from liability for any injury
or damage to any person or property which may result from said
encroachments.
2. The Applicant fully understands and agrees that this encroachment
agreement does not restrict or limit the current or future ability of MEA to
fully enjoy the benefits of the easement for any and all utility purposes that it
presently enjoys under the easement.
3. Applicant stipulates and agrees that it shall hold MEA harmless from liability
for any and all damages to the encroachments that may result from the
existing and future use of said easement by MEA, its contractors,
successors, agents, licensees, or assigns.
4. Any facilities or property of MEA that are damaged or destroyed as a result
of such encroachment(s) shall be repaired or replaced at Applicant's
expense.
5. Applicant shall comply with all applicable safety codes and regulations.
6. Any expenses which MEA may incur in the relocation or modification of its
facilities to accommodate the encroachment(s) shall be paid entirely by
Applicant.
7. This Agreement shall not be construed to give Applicant permission to add
new structures or appurtenances or modify existing structures or
appurtenances that are or will be located within the easement.

By its execution of this Agreement, Applicant agrees:
(a) for itself, its successors and assigns, that its encroachment upon
the named easement as hereinabove mentioned will be subject to the
foregoing conditions, and
(b) Applicant shall within 60 days of the date first listed above, record
this document in the proper recording district and shall provide MEA
notice of such recording by providing MEA with a certified copy of the
recorded document. Should Applicant fail to comply with this recording
and notice requirement, this agreement shall become null and void.

"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREA I'M ENT SYSTEMS. Municipality
grants permission to Owner to utilize and operate an Advanced Wastewater
Treatment System (AWWTS), described as ej located

2. Definitions.
A. Alteration. Any change to the design or function of an AW WTS that
Includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design. Prior to
performing any alterations to an AW WTS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65.
B. Certificate of On -Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with AMC 15.65.
These approvals certify that the systems are adequate for the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AW WTS that were included in
the original design which would allow the AW WTS to continue to
perform as designed.
E. Permit (Construction) An On -Site Wastewater Disposal System
Construction Permit as defined b3 AMC 15.65.
F. Permit (Operating) An Advanced Wastewater Treatment System
Operating Permit. An annual permit, issued by the Municipality, that
allows the Owner to operate an A W WTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On -Site Wastewater System Construction Permit and
all relevant provisions of AMC 15.65
3. Fee. Owner shall pay to Municipality an annual fee of 0—-
(s <:C�-00), payable on or before the issuance of the operating permit and annually
thereafter. The annual fee is due on or before the anniversary date of the approval by the
Municipality of installed system.
4. Term. The term of this Memorandum of Understanding shall be for the life of the
A W WTS.
The term begins on the date of approval by the Municipality of the installed system and
shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On -Site approval is issued to
the new owner or transferee of the property.
5. Alterations, Installation and Removal of Additional Equipment. Owner agrees
not to make any alterations, removal of parts or additions to the AW«'TS without a
Construction Permit from the Municipality.
6. Maintenance and Repairs.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the
Owner during the term of this Memorandum of Understanding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2)
maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs.
Further, Owner agrees to comply will all applicable ordinance, laws, regulations,
rules and orders for the AWWTS.
D. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWWTS Operating Permit. This
schedule shall be submitted to the Municipality tmnually upon the renewal of the

C. Owner acknowledges that the fine schedule for failing to maintain and repair an
AWWTS are codified in AMC 14.60.
D. Owner agrees that only maintenance, repair personnel certified by the
Municipality will inspect and make any neceisary maintenance, repairs or permitted
alterations to the system.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
AW WTS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
G. Owner agrees that the relevant provisions of the standard specification guidebook
for AW WTS is the governing professional guidelines for the construction,
maintenance and repair of the Owner's AW WTS.
7. Nonwaiver. The failure of either party at ani time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way effect the validity of the Memorandum of Understanding or any part
hereof, or the right of such party thereafter to enforce each and every provision
hereof.
8. Amendment.
A. This Memorandum of Understanding shall only be amended, modified or changed
by a writing, executed by authorized representatives of the parties, with the same
formality of this Memorandum of Understanding was executed and such wTiting shall
be attached to this Memorandum of Understanding as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this contract, the only authorized representatives of the parties are:

C. Any attempt to amend, modify, or change this contract by either an
unauthorized representative or unauthorized means shall be void.
9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.
10. Severability. Any provisions of this Memorandum of Understanding decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining provisions
of the Memorandum of Understanding.

Dear Ms. Kohfield:
Per your request of July 23, 1979, we conducted a test of the sanitary sewer
system on the above described property.
The septic tank was pumped prior to the performance of the test on the
seepage pit. During the test the liquid level in the seepage pit was
measured before and after the addition of 1,200 gallons of water. All liquid
levels were measured below the top of the standpipe and are shown in the
following table:

The water level rose 72.5 inches with the addition of 1,200 gallons of water,
indicating a capacity of 16.5 gallons per inch. Twenty-four hours later the
liquid level was again measured and found to be 7.4 feet. It had dropped 3.6
feet or 43.5 inches. This indicates an average effluent acceptance rate of
717.8 gallons per day for the surrounding soils. If the three bedroom
residence on the property is to house six people, the average load on the
system can be expected to be 450 gallons per day. We can therefore conclude
that the system is disposing of effluent at an adequate rate for a three
bedroom residence.
