Ref: Proposed Septic for Echo Ilills #1; Block 3, Lot 2,
To whom it may concern:
The subject property has an existing 4 bedroom house which is served by a MOA approved septic system
and a private well. The property also has a shop which the homeowner is planning to convert into an
ADU. The existing shop is served by a bootleg septic system and is also served by the existing well. Due
to the homeowner's plans to change the shop into an ADU, the private well is now proposed to be re-
classified as a "C" community well. The proposed ADU will consist of I bedroom, the undocumented
trench will be abandoned, and a new system will be installed per code. We are proposing to use the
existing 1000 gallon undocumented septic tank (see attached septic tank receipt provided by the
homeowner) and install a dual 5-wide trench type drainfield. One test hole was excavated on the property.
The drainfield will be designed around the 30 foot radius of this test hole. Comments regarding the
design are summarized as follows:
I. SOILS: See the attached log which shows the soil classifications, groundwater monitoring, and the
percolation test results.
2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications.
3. SURFACE WATERS: There are no surface waters within 100 feet of thc proposed septic system.
4. TOPOGRAPllY: See attached topography drawing.
We are unaware of an~,adverse impacts this installation would have on adjacent wells or septic systems.

To whom it may concern,
It is my intention to install the drain field myself. I've been engaged full time in construction for
39 years. Excavation is one of my talents. I also know how to read plans and specifications, and follow
instructions. I am a general contractor and president of JADA Construction Co. My Alaska construction
experience is 34 years working full time.
I will be renting the excavator from Airport Rentals (I have done this many times before), and
will be operating the machine myself. I will be present during the entire installation process.
I will be doing this work as a qualified homeowner working on my own property. Garness
Engineering is responsible for design and inspection.

Echo Hills # 1, Block 3, Lot 2- South Anchorage-Waivers & Conditional Approval to
Construct an Onlot Domestic Wastewater Treatment and Disposal Systems-ADEC Plan
Tracking Number 7970
Dear Mr. Gamess:
On December 16, 2009 the Department received an engineering plan submittal for an onlot
wastewater treatment system with an existing 1,000 gallon two compartment septic tank and a
new soil absorption system for the one bedroom Auxiliary Dwelling Unit (ADU) at the above
location. In addition two waivers are required from the source well to the existing wastewater
treatment and disposal system.
Based upon the engineer's recommendations, field sampling of the source well for contamination
(nitrate as nitrogen is at 2.75mg/1), and soils information from the source well log showing a
layer of silts and clay of 8 foot depth support approval of these waivers. The following
separation distances are established by this waiver approval.
The separation distance between the existing 1,250 gallon two compartment septic tank
to the Class C source well is reduced from 150 feet to a minimum of 130 feet.
The separation distance between the existing wastewater disposal field which passed an
adequacy test is also reduced from 150 feet to a distance of 130 feet or more as it
presently is confibmred.
The ADU onlot wastewater treatment consists of the existing 1,000 gallon two compartment
septic tank made by Greer Tank and the disposal field is a new 5 foot wide by two trenches each
34 feet long tbr an effective area of 340 112. This area is based upon the field percolation test
which resulted in 48 miWinch or a minimum of 335 ti2 being utilized.
The Department has reviewed the engineering plans, established the waiver as listed above for
the Class C Public Water System, and authorizes the new onsite wastewater disposal and
treatment system for the ADU unit, now per the Wastewater Regulations 18 AAC 72.235
conditional approval to construct the proposed system is hereby issued. A "Certificate to
Construct" for the onlot domestic wastewater system is enclosed. Please use the referenced plan
number ~n correspondence gardingthis 'stem.
This approval is contingent upon compliance with the following conditions:
1)
The record drawings will need to confirm in a profile view of the new wastewater
disposal trench has meet the requirement of 4 feet of cover material or equal was
installed.
2)
If the applicant fails to construct, alter, install, or modify the system within two (2) years
after the date that the department issues an approval to construct, the approval is void,
and plans must be resubmitted, (along with associated fees), for department review and
approval.
3)
Deviations from approved plans which affect capacity, flow, operation, major design of
units, point of discharge, materials of major system components (such as pipe, lagoon
liners, etc.), or separation distances, must be approved by DEC in writing prior to their
implementation.
4)
This approval is contingent upon compliance with the conditions of Wastewater Disposal
Regulations, 18 AAC 72.235, Construction Certification. The noted section of the
regulations requires that a "Certification of Construction" be completed and submitted to
the Department within ninety (90) days of completion of construction. As-built plans or
record drawings should indicate any changes or deviations from the approved plans to
facilitate final review. A "Certification of Construction" form is enclosed for your use.
5)
This approval is contingent upon 'your receipt of any other state, federal or local
authorizations which are required for your project. You are required to obtain all other
necessary authorizations before proceeding with your project.
6)
You are advised that if this development will require placing fill in wetlands or working
in a stream, river, or lake, permits from the U.S. Army Corps of Engineers and the Alaska
Department of Natural Resources may be required. A Coastal Projects Questionnaire
will help you identify other permits and approvals that may be required for your project.
In the future if either of the onsite systems fails (wastewater or Class C well) and needs to be
replaced they must be installed to meet the current regulatory separation distance at that time. If
separation distances cannot be meet a new waiver must be requested and justified.
This approval does not imply the granting of additional authorizations nor obligate any state,
federal or local regulatory body to grant required authorizations.
Any person who disagrees with this decision may request an adjudicatory hearing in accordance
with 18 AAC 15.195- 18 AAC 15.340 or an informal review by the Division Director in
accordance with 18 AAC 15.185. Informal review requests must be delivered to the Division

INTRODUCTION~ A BRIEF HISTORY
On November 23, 1984, we purchased a $ acre parcei on the upper
hillside with the intention of developing a homesite. We spent the
following winter and spring of 1985 familiarizing ourselves with
the property.
Our initial plan was to build a small house on the lower, acces-
sible portion of the property. The septic Dermit provided with the

an estimate for a line extension to the base of our property. We
were informed that the cost of extension would be $22,226. Just to
our property'corner.' ~e hoped that some of our neighbors on Echo
St. would like to Join us in bringing in this line extension, thus
splitting the expense. It would be expensive, but was a viable
option.
Complications began on August 16, 1985, when soils testing revealed
the inaccuracy of the original septic permit making our initial
plans impossible. Subsequent testing, as documented by Ted Moore
of Flattop Technical Services (See Inspection Report Log), located
an area feasible for on-site septic at the highest and least
accessible portion of our property. This necessitated building a
driveway in excess of one-quarter mile. In addition to the
driveway, additional septic testing and construction costs, we were
forced to find a new house site, and develop suitable plans for
that site. There were no funds remaining for home construction at
that point. With winter arriving, the temporary use of a mobile
home became our best option. Most of our neighbors were well
informed of our difficulties and revised plans and none of them
registered any concerns as to our ultimate intentions. Between
October and December, 1985 we located a small mobile home, built a
!12' x 12' bedroom/drafting room addition, and made all necessary
water and septic connections.
We approached Chngach Electric for a new quote, knowing that our
building site was now to be a quarter of a mile above our original
plan. The new estimate was in the neighborhood of $30,000. The
figure was staggering enough, but when our neighbors said they were
not interested in Joining in, it was out of the question. We began
to look into alternative energy sources. Working with George
Menard, owner of Invertech Alaska, Inc., we concluded our most
viable energy option was Photovoltaics with diesel generator
backup. A great deal of time and planning was put into this
project to ensure a reliable source of electricity. Our original
estimates for this alternative were $16,000-17,000. Funding would
be a real consideration.
INTRODUCTION~ A BRIEF HISTORY continued
The State of Alaska had a program for 5~ financing for alternative
energy. The program was ideally suited for our situation. We went
ahead with the application for financing and were encouraged by the
assistance from the State. Thoughout all the planning stages, the
Dept. of Economic Development, State of Alaska, encouraged and
assured us that the monies were there and untouchable by any
changes in the economic picture. Several days after we submitted ,
our completed loan application, without any warning, Governor
Sheffield transferred all monies of the energy program to other
programs. ~.
Attempts were then made to finance our energy source through local
banks. We were rejected because they did not know anything about
photovoltaics and were concerned about resale should we default.
We did not look forward to spending another winter hauling water
and living without fulltime electricity. A decision was made to
start construction of the electrical system with whatever financial
resources we could put together out of pocket.
Anchorage Community College offered a course in Photovoltaics,
taught by George Menard. I took the class to learn about the
system with hands on experience. Fortuitously, the class required
a lab in which a system be installed, and our homesite was
selected. Installation was scheduled for April 25, 1987, but it
was to be delayed a week as the photovoltaic panels had not arrived
and it had snowed.
On May 1, 1987 the class of twenty students, under the direction of
George Menard and Karen Holtzer, and photographed by Channel 2
News, installed the ten photovoltaic panels onsite. The following
day, under the camera of Channel 13 News, power was connected and
our alternate energy was flowing! As yet, we do not have our 10
KW generator, and we have not put siding or other planned cosmetics
for our power house, but we are enjoying fulltime electricity at
this time.
Our long range plans have not changed. Our time schedule has been
set back due to unforeseeable events, which have caused significant
cost overruns and forced us to finance out-of-pocket. Our plans
for building a home in 1987 will not be possible, however we have
retained Patrick McKittrick, A.I.A., to assist us in designing an
earth sheltered home, comparable with our environmental conditions
on the hillside, to be built in 1988.
INTRODUCTION~ A BRIEF HISTORY continued
As future long term residents of our neighborhood, *e have no
desire to have a trailer-town or tent city on the hillside, nor do
we want to be associated with that type of development. We have
developed a thorough plan for our property from site plan to energy
alternatives. It has taken considerably more time and expense than
was originally anticipated and we appreciate the patience of our
neighbors who have supported our efforts. We are sure that the end
result of this development will be an asset to the neighborhood and
community.
NOTE
On April 24, 1987, the day before our energy system was to be
installed, Dale came home to find a pink notice from Michael Kerr
of Zoning Enforcement, stuck in our door. Without any previous
notification or warrant, while no one was home, Mr. Kerr inspected
our entire property, buildings and site and posted notification of
violation. Respecting the intent of the zoning laws and not
wanting to be in violation, we called ~mmediately. We set up an
appointment and met with Michael Kerr and his supervisor. We have
been attending to legal paperwork since that time.
The following is in answer to the notice of violation.

RESPONSE TO VIOLATIONS
Please accept this statement in regards to the MOA letter issued by Mr. Michael
Kerr of the Building Safety Division.
His interpretation of the Title 21 Codes finds us in violation of the following
to which we offer our facts and information:
1. Section 21.40.100 B and C - On October 7, 1985 we moved our Ardon Mobile
Home onto our property and failed to secure a Land Use Permit.
Attachment "A" is our signed statement that we intend to build within 18
lonths from the date of issuance of a Land ~se Permit permitting a mobile home
on our property during the construction of our home.
In reference to the accessory building violations, a 12' x 12' bedroom/drafting
room was attached to the west side of the mobile home. It was built on skids in
order to be relocatd as part of the shop/barn complex. As final plans are
developed for our shop/barn complex, we will be applying for a Land Use Permit
that will include the permanent relocation of this structure. We request that
this structure be included in the Land Use Per.it allowing the Mobile Home for
an::18 amnth period. ~
Our property is located beyond existing electrical lines. Chugach Electric
provided estimates in the vinicity of $30,000.00 (Note the enclosed estimate).
To circumnavigate the extreme expense, we opted for alternative energy in the
form of Photovoltaics. An 8' x 12' Power House was constructed to house the
twelve (12) 1580 amp hour batteries, miscellaneous controls and components, and
a 10 KW Diesel Generator. This is the power source for our proposed home,
therefore.the structure is not an accessory, but a prerequisite to the
alternative energy system. This is a permanent structure, therefore we
request a Land Use Permit.
The only other structure on the lot is an 8' x 8' storage shed. Again, this
building is not on a permanent foundation and is to be incorporated in the
shop/barn complex at a later date. In order to build the home and make the
improvements, the shed is necessary to store incidental materials. We request
that this structure, be included in the Land Uae Permit allowing the Mobile Home
for am 18 a~nth period. It will be included in the application for a Land Use
Permit upon it's permanent relocation as part of the shop/barn complex.

2. Section 21.~5.020 B-it 115 - There is nothing "customarily subordinate or
incidental" about the support structures constructed on our property. These
definitions are more applicable to urban/suburban areas. Our neighborhood is
clearly rural. We are located in a land use area beyond utilities and road
maintenance. This situation is not unusual for bush Alaska, but is clearly not
customary for the Municipality of Anchorage, therefore we request due
consideration as an exception.
3. Section 21.25.010 A-2 - We now understand that according to Title 21, we
should have procured a permit prior to locating and occupying our mobile home.

The Zoning Board of Examiners and Appeals may only grant a variance if the Board finds all of the
following six (6) conditions are met. Each condition must havea response in as much detail as it takes to
meet the condition. Please use additional paper if there is not enough room here for your response.
The applicant hereby alleges that:
1. Special conditions exist which arepeculiartothisland, structure, or building involved are which are not
applicable to other land, buildings or structure in the same district. These special conditions are:
1. Remoteness 2. Lack of electricity and other utilities.
3. Soils conditions that required careful planning (a hiqher degree)
to assure correct development. 4_ Alpine topoqraphy wi~h dr~in~g,.
adding to the complexity of planninq and expense_
2. Strict interpretation of the provisions of the Zoning Ordinance would deprive the applicant of rights
commonly enjoyed by other properties in the same district under the terms of the ordinance. These
rights are: the right to a reasonable lencl, th of time within which
to develop a trouble-free home with standard conveniences.
3. The listed special conditions and circumstances do not result from the actions of the applicant and
such conditions and circumstances do not merely constitute a pecuniary (monetary) hardship or
inconvenience in that: we did not create the economic woes of Anchorage that have
stymied or slowed the progress of Owner-Builders: a monetary hardship.
An artistic hardship stemminq from our insistance to conscienciously d,.-
velop our home has extended our time frame. This project can best be
completed if we are onsite to eliminate travel time and to protect our

5. Granting the variance will not permit a use that is not otherwise permitted in the district in which the
