DECISION
This matter came before the Anchorage Board of
Adjustment on July 21, 1987, as appeal from the decision of the
Planning and Zoning Commission denying a conditional use. The
Board of Adjustment hating duly considered the record before the
Planning and Zoning Commission together with the briefs submitted
by the parties, adopts the following findings and conclusions:
FINDINGS
1. The appellant submitted an application to the
Commission to remove gravel from their land in preparation for
developme6~ of a subdivision. -
2. The R-6 zoning district only permits gravel
extraction operations as preparation for subdivision development.
3. It has been acknowledged by all parties that access
to the site is restricted and is of special concern to all.
4. The conditions presented by staff to the Commission
provide mitigation methods to place the least stress on the
access.
CONCLUSIONS
1. The Commission is required to apply a lesser
standard than would normally be applied to a natural resource
extraction operation when that operation is principally
undertaken to permit subdivision development in accordance with
the underlying zoning.
2. The conditions of staff provide adequate safe guards
on this natural resource extraction.
IT IS DECIDED that the appeal in the above captioned
case is granted subject to the conditions of staff listed as
follows:

Final approval of this conditional use for natural
resource extraction will become effective upon the
approval ahd recordation of a subdivision plat for an
R-6 development as required by 21.15.030.I.1. and sub-
division agreement which includes final landscaping,
and cost of upgrading Ganoe Street to MOA gravel stan-
dards. Removal of gravel shall not occur before a final
plat is recorded.
A notice of Zoning Action shall be recorded with the
D~strict R~co~ders Office prior to the issuance of a
land use permit.
This approval is subject to compliance with all appli-
cable conditional use standards, the submitted applica-
tion, and narrative.
Ail excavation related to this approval shall be
substantially in compliance with the following plans
except as modified by these conditions of approval:

Prior to the issuance of a land use permit, the peti-
tioner shall submit an on-site and off-site maintenance
plan , dust control plan, signage and traffic control
plan for flag men and other measures deemed appropriate
for review and approval to Public Works Engineering,
Traffic Engineering, Department of Health and Human
Services, and Zoning Enforcement. Routine road main-
tenance shall include Ganoe Street and one-half mile
lengths in both directions along Birchwood Loop Road at
the intersection of Ganoe Street. At the conclusion of
each work season Ganoe Street, including the intersec-
t'.~on~ shall be restored to pre-work season condition. A
copy of the approved plans shall be provided to Community
Planning within 15 days of its approval.
Prior to the issuance of a land use permit, the peti-
tioner shall submit a master drainage plan for the site
to be reviewed and approved by Public Works Engineering.
The Alaska Railroad shall provide comment to Public
Works prior to approval.
Proof of financial capability for final landscaping and
Ganoe Street upgrading shall be provided to the
Community Planning Department prior to issuance of a
land use permit. Proof of financial capability may be
satisfied with a final subdivision agreement.
Performance guarantee, such as bonding, are required for
and other mitigation measures as required during the
four-year excavation period to assure compliance with
approved plans.

To reduce tracking, prior to the issuance of a land use
permit, shutterboards shall be installed along the
access drive for a minimum of 50 feet, the specific
design to be resolved with Public Works Engineering.
Prior to issuance of a land use permit, a casual access
plan shall be submitted to Public Works. Engineering for
review and approval. The prevention of casual access is
only intended to be provided through'the period of time
of natural resource extraction and may be removed at the.
time of subdivision redevelopment.
Petitioner shall remove a minimum of 42,500 up to a
maximum of 55,000 cubic yards per year from the site
whether for sale or removal for stock piling purposes,
for a maximum of 170,000 cubic yards over the four year
period. (Note: These figures may be subject to reduc-
tion based upon Condition %13.)
A site plan, stamped by a registered engineer (with
notes to address the conditions and identification of
all affected haul roads), must be approved by Traffic
Engineering.
Birchwood Loop Road south to the Glenn Highway, shall be
the approved route for trucks hauling gravel.
A final mining plan shall be reviewed and approved as
part of the plat review, and shall reflect:

reverse slope bench 10 feet wide for every 30 ver-
tical feet of drop.

An inspection schedule shall be submitted to Public
Works Engineering and Inspection, and Zoning Enforcement
which outlines the end of each haul season and
times for field inspection of the work.
A new topographic map with two-foot contours and per-
manent control survey monuments clearly identified,
shall be submitted to Zoning Enforcement October 30 of
each year commencing with the first haul season.

Annual inspection reports prepared by an Alaskan
registered engineer identifying location and extent of
extraction, as verified by truck~load ticke~s, as it
relates to condition %10,. shall be submitted to Zoning
Enforcement by October 30 of each year commencing with
the first haul season.

Removal of gravel shall occur over a period of time not
to exceed four years from the recording of the final
plat. Hauling of excavated gravel during each. of the
four years, shall be limited to the 15th of April and
end on the 15th of October of each year.

The four-year time limit may not be extended without a
public hearing before the Planning and Zoning
Commission.
Excavation and hauling operations shall be limited to
the hours of 7:00 a.m. to 6:00 p.m. Monday through
Saturday. No operations shall be permitted on Sundays
or legal holidays.

SUBSURFACE INVESTIGATION
"BUSWELL PROPERTY"
Lots 10, 28 and 29, NE 1/d, Sec. lB, T15N, R1W, SM,
Alaska.
Site Description
The site consists of roughly 4.5 acres, located in the
Birchwood Loop area, Chugiak, Alaska. The site is bounded
on the northwest by the Alaska Railroad. Access is from
Ganoe Street.
The site has previously been used as a gravel extraction
site. This use is to continue for the near future. The
north portion of the proposed subdivision is presently open
gravel pit without vegetation. The Southwest portion above
the cut bank contains some natural aider, birch and
cottonwood vegetation. The southwest portion between the
toe of the hil I and the railroad has second growth
vegetation over an old strippings burial site. A steep cut
bank about 50 feet high exists on the site.
Proposed Development
The proposed development of the site will remove additional
sand and gravel from the site, make the slope less steep,
move the slope back toward the southeast. Upon completion

Field Investigation
Subsurface investigation was conducted on 8-15-90, using a
Drott 35 backhoe operated by Anderson Brothers Construction.
Test pits were logged by Mark Hansen. A g" diameter
perforated PVC pipe was set in each test pit beiore
bacl<filling to monitor ground water levels. Soil samples
were taken from each important strata. The test pit logs
describe the soil as 'observed in the field.

Soils were olassified and described using the Unified group
symbols and group names outlined in ASTM D 248?. Samples of
important soil strata were taken from the backhoe bucket.
The samples may not entirely represent the coarser portion
of the soil. The presence of large gravel, cobbies and
boulders should be noted on the logs when interpreting sieve
analysis results. The samples do not represent
stratification which causes the soil to be somewhat sorted
in the field. A 4" perforated PVC pipe was left in the hole
to facilitate future ground water monitoring. Ground water
was rechecked in each hole nine days following excavation.
No percolation tests were performed. The soil encountered
at usabie depth is highly permeable, and has been described
by sieve analyses.
Test pits were located in the field relative to an existing
slab from a former building in the floor area of the pit,
and relative to the centerline or the railroad tracks. The
~ocation sketch shows the test pit ~ocations.
Findings
The actual building sites on the three lots will be exposed
when the excavation and regrading of the area is complete.
The test pit locations represent the northwest edge of the
area. that will be exposed after excavating and recontouring
the lots.
S,Jitab~e soil for the construction of on-site wastewater
soil absorption systems was identified in all test pits.
Soils at usable depth in pits #1 and #5 are highly
permeable, and may require a sand liner. A shallow trench
o£ bed system is most suitable for highly permeable soils
requir, ing a sand liner. Ground water was relatively shallow
in Test pit #2. A shallow bed or trench would be required
at that location, possibly with insulation to reduce the
required soil cover.
A glacial till soil of low permeability was identified at
depth in all of the test pits. No percolation test was
pertormed in the till layer. Perched water exists above the
till in two of the pits. The required four foot separation
of soil absorption systems from ground water will dictate
the final grade after site excavation and regrading. This
should be designed high enough that the required separation
from future soil absorption systems to ground water can be
maintained.

The Environmental Services Division, On-site Services Section,
of the Department of Health and Human Services has reviewed
the following cases and has these comments:
S-8993:
Lots 1 and 2 Hoggard Subdivision
The department requests that the proposed well
locations be moved to the north to protect available
on-site wastewater disposal areas. We will require
that the areas for the original and two replacement
wastewater disposal sites be designatedon the plat.
The plat must also designate that a maximum number
of 4 bedrooms be allowed on each lot. Prior to
final plat approval, we will require the upgrading
of the wastewater disposal system serving the house
and the proper abandonment of the existing
undocumented system. We will also require the
abandonment of the existing well and well pit, and
the drilling of a new well.
S-8994:
Lots 1, 2, 3 Birchwood Acres Subdivision
The department has reviewed the proposed plat, and
found the following discrepancies in the submittal:
1. We will require a percolation test and water
monitoring report for each lot. The test must be
taken in an area of potential wastewater disposal.
2. Provide ground water monitoring of all test holes
through high water period (approximately May 15).
3. Engineer must show areas of less than 25% slope
which would be suitable for on-site wastewater
disposal.
4. Show 50 foot setback from area designated for
wastewater disposal to the top of slope greater
than 25%.
5. We will require evidence of water availability
for potential private wells.

Lounsbury & Associates has revised the proposed grading plan and
plat for the above referenced project. On May llth I met with you
to review the revised project and the Health Department
requirements.
Some additional information is necessary for the Health Department
to complete its review. We need to complete percolation test for
two of the existing test pits. In addition, we will be providing
additional test pits in the higher areas of the lots. We have been
monitoring the groundwater since our May llth meeting. Enclosed is
a reduced copy of the proposed development with the existing test
pits and proposed test pits shown.
The Revised Report addressing all items in your January 19, 1993
memorandum will be compelted by the llth of June, and will be
submitted to your Department for review and approval. If you have

The Environmental Services Division, On-site Services Section,
of the Department of Health and Human Services has reviewed the
following cases and has these co~nents:
Lots 1, 2, 3 Birchwood Acres Subdivision
In 1990 this department provided comments for
S-8994, which clearly showed the proposed plat did
not meet basic filing requirements outlined in AMC
21 and 15.65. As a result DHHS strongly requested
that this plat be returned for additional work, or
that it be denied. The new application contains
no new information which would alter this
position. Therefore, this department recommends
the plat be denied since it cannot meet code
requirements. Our review shows the following
deficiencies:

SUBSURFACE INVESTIGATION "BUSWELL PROPERTY"
Lots 10, 28 and 29, NE l/a, Sec. 18, T15N, R1W, SM,
Alaska.
Site Description
The site consists o~ roughly a.5 acres, locate~ in the
Birchwood Loop area. Chugiak, Alaska. The site is bounded
on the northwest by the Alaska Railroad. Access is from
Ganoe Street.
The site has previously been used as a gravel extraction
site. This use is to continue ~or the near ~uture. The
north portion of the proposed subdivision is ppesentty open
gravel pit without vegetation. The Southwest portion above
the cut bank contains some natural alder, bi£cn and
cottonwood vegetation. The southwest portion between the
toe of the hill and the railroad has second growth
vegetation over an old strippings burial site. A steep cut
bank about 50 feet high exists on the site.
Proposed Development
The proposed development or the site will remove additional
sand and gravel from the site. make the slope less steep,
move the slope back toward the southeast. Upon completion
of the gravel extraction the site wi[ I be devetoped into
three residential lots. The usable area on the proposed
lots wit I be the same approximate elevation as the present
floor of the gravel pit.
Field Investigation
Subsurface investigation was conducted on 8-i5-~0, using a
Drott ~5 backhoe operated by Anderson Brothers Construction.
Test pits were logged by i~a~k Hansen. A a" diameter
perforated PVC pipe was set iii each test pit before
backfilling to monitor ground water levels. Soil samples
were taken from each important strata. The test pit logs
describe the soil as observed in the ~ield.

Findings

Suitable soil for the construction of on-site wastewater
soil adsorption systems was identified in all test pits.

A glacial till soil of low permeability was identified at
depth in al { of the test pits. No percolation test was
performed in the till layer. Perched water exists above the
till in two o~ the pits. The required four foot separation
or soil absorption swstems from ground water wi I I dictate
the :inal grade after site excavation and regrading. 'rhis
should be designed high enough that the required separation
from future soil absorption systems to ground water, can be
maintained.

of the Department of Health and Human Services has reviewed the
following cases and has these comments:

Thoreau Subdivision - Revised
No objection to revised plat.
S-9293:
Lots 1, 2 Birchwood Acres Subdivision
The information submitted with the plat indicates
the division into three lots, but the plat shows
only two lots. We need clarification on the actual
division. In addition, the following information
is missing from the plat application:
1. We will require that soil tests be reported on
forms provided by DHHS. Each test must include
percolation results and water monitoring results.
2. We will require water monitoring results through
a high water period.
3. Provide information on water availablility.
4. Provide a drainage plan which addresses potential
impact on on-site wastewater systems from surface
waters.
5. There is a garden hose and a 4" sewer pipe which
are buried near the top of the slope. We request
information on its current use; the pipe may not
discharge sewage.

Site Description
The site consists of roughly 4.5 acres, located in the
Birchwood Loop area, Chugiak, Alaska. The site is bounded
on the northwest by the Alaska Railroad. Access is from
Ganoe Street.
The site has previously been used as a gravel extraction
site. This use is to continue for the near future. The
north portion of the proposed subdivision is presently open
gravel pit without vegetation. The Southwest portion above
the cut bank contains some natural alder, birch and
cottonwood vegetation. The southwest portion between the
toe of the hill and the railroad has second growth
vegetation over an old strippings burial site. A steep cut
bank about 50 feet high exists on the site.
Proposed Development
The proposed development of the site will remove additional
sand and gravel from the site, make the slope less steep,
move the slope back toward the southeast. Upon completion
of the gravel extraction the site will be developed into
three residential lots. The usable area on the proposed
lots will be the same approximate elevation as the present
floor of the gravel pit.
Field Investigation
Subsurface investigation was conducted on 8-15-90, using a
Drott 35 backhoe operated by Anderson Brothers Construction.
Test pits were logged by Mark Hansen. A 4" diameter
perforated PVC pipe was set in each test pit before
backfilling to monitor ground water levels. Soil samples
were taken from each important strata. The test pit logs
describe the soil as observed in the field.

Soils were classified and described using the Unified group
symbols and group names outlined in ASTM D 2487. Samples of
important soil strata were taken from the backhoe bucket.
The samples may not entirely represent the coarser portion
of the soil. The presence of large gravel, cobbles, and
boulders should be noted on the logs when interpreting sieve
analysis results. The samples do not represent
stratification which causes the soil to be somewhat sorted
in the field. A 4" perforated PVC pipe was left in the hole
to facilitate future ground water monitoring. Ground water
was rechecked in each hole nine days following excavation.
No percolation tests were performed. The soil encountered
at usable depth is highly permeable, and has been described
by sieve analyses.
Test pits were located in the field relative to an existing
slab from a former building in the floor area of the pit,
and relative to the centerline or the railroad tracks. The
location sketch shows the test pit locations.
Findings
The actual building sites on the three lots will be exposed
when the exca~vation and regrading of the area is complete.
The test pit locations represent the northwest edge of the
area that will be exposed after excavating and recontouring
~.he lots.
Suitable soil for the construction of on-site wastewater
soil absorption systems was identified in all test pits.
Soils at usable depth in pits #1 and #3 are highly
permeable, and may require a sand liner. A shallow trench
or bed system is most suitable for highly permeable soils
requiring a sand liner. Ground water was relatively shallow
in Test pit #2. A. shat low bed or trench would be required
at that location, possibly with insulation to reduce the
required soil cover.
A glacial till soil of low permeability was identified at
depth in all of the test pits. No percolation test was
performed in the till ~ayer. Perched water exists above the
till in two of the pits. The required four foot separation
of soil absorption systems from ground water will dictate
the final grade after site excavation and regrading. This
should be designed high enough that the required separation
from future soil absorption systems to ground water can be
maintained.

A supplemental field soils investigation was conducted on 6/2/95 and 6~4~93 on
the above site. The original investigation was conducted ~n August and
