The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of Health Authority
Approval (HAA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of Health Authority Approval are required for the transfer of
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
supply system. DSD also issues HAAs upon request to homeowners. Certificates of Health Authority Approval are
valid for 90 days from the date of issue for properties served by a private or Class C well and may be reissued with
new water sample results. (Certificates may be reissued for a period of up to one year with valid water samples.)
Certificates are valid for one year for properties served by Class A or B yells or a public water system. The
Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.
4. STATEMENT OF INSPECTION BY ENGINEER
As certified by my seal affixed hereto and as of the validation date shown below, I verify that my investigation,
based on procedures outlined in the Health Authority Approval Guidelines for this application, shows that the on-
site water supply and/or wastewater disposal system is(are) safe, functional and adequate for the number of
bedrooms and type of structure indicated herein. I further verify that based on the information obtained from the
Municipality of Anchorage files and from my investigation and inspection, the on-site water supply and/or
wastewater disposal system is(are) in compliance with all applicable Municipal and State codes, ordinances,
and regulations in effect at the time of installation.

By means of this letter we are requesting issuance of a lot line waiver allowing the septic system
on Lot 1 of Chenoweth S/D to be within 0 feet of the property line common with the Old Seward
Highway R.O.W. The owner of the house, Charlie Chenoweth passed away recently and the lot line
waiver is necessary to allow issuance of a HAA certificate so that the property can be transferred out of
his estate.
According to the limited information contained in your files, the septic system was probably
installed in 1972 and consists of a 1250 -gallon septic tank that discharges effluent into a 12' x 12'
seepage pit. As you can see from the enclosed drawings, the septic tank crosses the property line and
the seepage pit is entirely within the Old Seward Highway R.O.W. I first spoke about this situation with
Dan Roth last March, at which time we discussed the steps necessary to obtain a HAA certificate. He
told me that in addition to making sure that the system passed an adequacy test, we would have to obtain
a ROW encroachment permit from DOT and also obtain a lot line waiver from your office. After some
protracted negotiations with DOT we have recently received the enclosed Encroachment Permit No:
111.061 which allows the system to continue to be used for up to 5 years pending replacement of the
system outside of the highway ROW.
Since the waiver is to a property line bordering a public right-of-way, granting the requested
waiver will not adversely impact the ability to site or construct future septic systems on adjoining
properties. Because of the foregoing I am requesting that you issue the waiver and the HAA certificate.

Allowed Use: The permitted area is to be used for a seepage pit, and for no other purpose.
2. Annual Fee: Pennitlees will pay in advance and without notice, an annual fee in the amount of
$100.00. The first year fee will be due on the effective date of this Permit. Thereafter, subsequent
annual fees are due January I" of each successive year of the temp of the Permit. Any additional
fees arc specified in Special Conditions noted below. All payments required by this Permit must
be made with a check or money order. A late fee of 550.00 will beconte due and payable rtftcr

provided hcrein. This permit is not renewable, the seepage pit trust be relocated outside of the
right of way no later than December 1, 2007.
4. Ose by the State: The issuance of this Permit notwithstanding, the permitted area's primary use is
for transportation purposes. The State may revoke this permit (as stated below), and/or enter the
permitted area at any time, without notice, for emergency use, or for the planning, design,
constriction, inspection, or maintenance of existing or future transportation facilities. Any such

use of the permitted arca will in no way invon tate protections 1— 0ded under 23 USC Section
138 (Preservation of Parklands).
5. Compliance with Laws: Pcrmittccs shall comply with all laws, ordinances, regulations, and
administrative agency and/or court orders, including those relating to licalth, safety, noise,
environmental protection, waste disposal, hazardous or toxic materials, and water and air quality.
No fuel, hurardous or combustible substances are to be stored in the Permit area. Should
Permittees use of the permitted arca cause any discharge, leak, spill, emission, or pollution release
of any type to occur at any time during this occupancy, Permittees shall immediately notify the
State :aid the approprihte federal, state, and local authorities. Pennittecs shall act immediately to
contain and/or absorb the release, repair any damage, and clean up the release arca, mid to restore
the permitted arca to compliance with all applicable state, federal, or local laws or regulations.
Permittees shall be held liable for any and all costs incurred by the State to dispose of cleanup
materials or to clean up the pennitted area unless otherwise agreed to, in writing, by both parties.
6. Indemnification: Permittees shall indemnify, defend and hold harmless the State, and its ofliccrs,
employees, and contractors, from any claim resulting from injury, loss, or damage to any person or
personal property resulting from Permittees use of the permitted area.
7. Waiver of Claims: Permittees waive any claim or right of action Permittee may have against the
State in the event of damage to properly, and injury to or death of any person in the permitted arca
that arises because of the design, construction, maintenance, management, or operation of a
highway in file right of way containing the permitted area.
8. Reimbursement of Costs: Permittee shall reimburse the State for all costs and expenses incurred
by the State, including attorney's fees, in any action brought by the State to recover any delinquent
fees, or for the breach of any terms or conditions contained in this Permit, or to recover possession
of the permitted area.
9. Non-discrimination: No person, on the basis of race, religion, color, national origin, age, or sex,
shall be excluded from participation in, denied the benefits of, or otherwise subjected to
discrimination in that person's use of the pennilted area.
10. Assignment: Pcrmittccs may trot assibn or transfer this permit.
11. Revocafiou: This Permit is not a property right but a temporary authorization, revocable by the
State. The State may revoke this permit in its sole discretion and upon 30 days written notice
unless a shorter period is agreed to herein by Permittees. Said notice will be sent to Pennittees last
known mailing address. Pcrmittccs shall have no right of action against the State. Upon the
expiration or revocation of this Permit, Pcrmittccs shall remove all encroachments and restorc the
permitted area to a clean and safe condition.
12. i.oss; of Business: The State is not responsible for loss of business.
13. No Relocation Benefits: issuance of this Permit docs not entitle Pemlittees to a payment of just
compensation or relocation benefits under AS 34.60 if Permit is revoked, Pennittecs elect not to
renew, or the State denies Permittees request far renewal.
14 C'nncell alion by Permittees: Permittees may cancel this Permit by providing written notice to the
State at the above address. Pcrmittccs are not entitled to a refund of any fees or expenses related
to the revocation or cancellation of this Permit.

15. Abandonment by Permittees: Upon abandonment by Permittees of the permitted arca,
Pcrmittccs rights tinder this Permit will immediately terminate, but Permitlees obligations will
survive until fulfilled.
16. SPECIAL CONDITIONS:
a) Permit is only valid with Envirotnnental Approval from the Municipality of Anchorage.
b) Pcrmittccs agree to relocate seopagc pit outside of the right of way no later than December 31,
2007,
