The length dimension is the length(in feet) of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet). 2~_~_~

Permit applicant has the responsibility to inform this department during the
installation inspections of any wells adjacent to this property and the number
of residences that the well will serve.

Backfilling of any system without final inspection and approval by this department
will be subject to prosecution.
Minimum distance between a well and any on-site sewage disposal system is 100 feet
for a private well or 150 to 200 feet from a public well depending upon the type
of public well. Minimum distance from a private well to a private sewer line
is 25 feet and to a con%n%unity sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days of the well completion.
Other requirements may apply. Specifications and construction diagrams are
available to insure proper installation-

Subject: On-site Sewer Permit
Lot 17A Block 1 Fire Lake Subdivision
This office recently received a request for an on-s~te sewer
permit to serve eleven(il) bedrooms located on Lot 17A Block 1
Fire Lake Subdivision.
As you are aware, our field inspectors visited the subject site
on several occasions and prepared field sketches of the overall
lot, including existing structures, structures under construction,
water well, septic tank and. drainfield, and other pertinent data.
From our field observations, it would appear that the structures
resulting in one continuous multi-family unit will have a total of
eleven(Il) bedrooms.
Assuming the above to be correct and based on a soils test taken
by Robert A. Shafer on July 16, 1983, an absorption area of 1,100
square feet will be required to handle the wastewater generated
from this multifamily unit. We -then superimposed a circle with
the center at the existing well site and having a radius of 150
feet, which is the required setback distance of a Class "C" well.
There is only one small triangular portion of the subject lot
lying outside of this protective radius, and the usable portion of
this area(for on-site disposal) contains approximately 345 square
feet. There is no area or combination of areas on the subject lot
located outside of the 150 foot protective radius which will support
one wastewater disposal system, much less the required replacement
system(s). Our conclusion, therefore, is that the subject lot
will not support an on-site sewer system for more than a single
family dwelling and the permit application is therefore denied.

Subject: Lot 17A Block 1 Fire Lake Subdivision
In response to a recent citizen complaint, our inspectors were
at the subject location on the morning of July 14, 1983. PT;Jot
to being politely requested to leave, our inspectors observed
that there are two(2) residential homes; one apparent large
garage/dwelling, and one additional structure under construction
on this location. If these conditions do indeed exist, then
the "Sewage Disposal System" permit issued on June 6, ]_969 is no
longer valid, and you are in probable violation of the Anchorage
Municipal Code Section 15.65.040(copy attached hereto). If such
is indeed the case, this department will immediately revoke the
existing Sewage Disposal System Permit, and will require additional
testing and possible upgrading of the system. We request your
permission to allow our inspectors access to your property on
Friday, July ]_5, 1983 to determine if your system ~s in compliance
with the above mentioned code section. If such permission is
denied, we will immediately seek an Administrative Search Warrant
and proceed accordingly.
I am aware that there has been litigation between you and the
Municipality over zoning code violations. Attached to this letter
is a copy of the order, in that case, signed by Judge Sauter on
July 8, 1983. Paragraph 6 of that order makes it clear that you
must comply with all provision of law other than Anchorage
Municipal Code Section 21.40.040.

Dear Mr. Walter:
About two weeks after our June 2, 1983 hearing in this matter, I
called you to inform you that while I was preparing the affida-
vits in support of the Municipality's version of the Order in
this case, I became aware that it was very likely that
Mr. Schneider would have problems obtaining the necessary water
and sewer permits to permit maintenance of a fiveplex on his
property. Since that time Judge Souter has signed the
Municipality's version of the Order which makes it very clear
that the only law affected by his decision was the zoning law and
that Mr. Schneider must obey all other local law. Furthermore,
there was never any question with regard to State laws and
clearly Mr. Schneider must comply with the applicable State law.
Last week I became aware that Mr. Schneider had begun construc-
tion on his property. I received numerous calls from neighbors,
from the zoning inspectors, from the Health Department and from
the Mayor's office. Upon investigation I discovered that
Mr. Schneider had not obtained any permits for a new or expanded
water-sewer system to provide necessary amenities for the addi-
tional units he plans to build. Furthermore, it appears that
without any further construction Mr. Schneider is already in
violation of his current sewer permit because it was issued for
only three bedrooms in a single-family house and, by his own
testimony, he now has six bedrooms in the two units on the prop-
erty.
On Thursday, July 14 and Friday, July 15, 1983, an inspector from

attempted to gain entry to Mr. Schneider's property for purposes
of determining the water and sewer facilities that currently
exist on the property and the number of bedrooms and units that
currently exist on the property. He was refused admission, and
this morning I obtained an Administrative Search Warrant for him.
I would hope that further litigation over Mr. Schneider's use of
his property can be avoided. I would also hate to see
Mr. Schneider tie up his financial resources and building
materials in a large structure which cannot legally be used for
the purpose for which it was intended. The only way for us to to
know whether or not he can have the number of bedrooms and units
that he desires is for him to apply for the necessary permits and
supply the required information so that decisions on the permits
can be made. Our health inspector has reported to me that Mr.
Schneider's engineer thinks it is possible to provide adequate
water and sewer for the number of bedrooms and units he intends.
I assume, therefore, that Mr. Schneider already has the support-
ing engineering information that will be necessary for him to
apply for his permits. I hope that with your urging
Mr. Schneider will promptly apply for the permits he needs from
the State and the Municipality.

the premises described, and that probable cause exists to believe

described above between the hours of 7:00 a.m. and 10:00 p.m. for

states:
Robert C. Pratt, being first, duly sworn, deposes and
1. I am employed as an Associate Environmental
Specialist for the Anchorage Department of Health and Environmental
Protection and have held that position since July 1, 1971.
2. My duties and responsibilities as an Associate
Environmental Specialist include the inspection of sewer systems
and water wells for compliance with Title 15 of the Anchorage
Municipal Code.
3. On July 13, 1983, I received a complaint about
construction on Lot 17A, Block 1, Fire'Lake Subdivision (hereafter
"the premises"). The complainant alleged possible violations of
the Anchorage Wastewater Disposal Regulations.
4. On July 14, 1983, I visited the premises and tried
to locate the well and the standpipes to the sewer system. It
appeared that there were two residences on the premises, a two-
story, apparently multi-bedroom house, and a separate ranch-style
house. I also observed construction of a new building between
the two-story house and the ranch-style house. After I had been
on the premises about 5 or 10 minutes, a man named Ed ~crman, who
said he was working for Mr. Schneider, the owner of the premises,
asked me to leave. I complied with his request.
5 .... On July 15, 1983, I delivered the attached letter
requesting permission to inspect the premises to Mr. Richard
Schneider. He read the letter in my presence but refused me per-
mission to inspect the premises.
6. The purpose of my inspection is to determine whether
the limitations of a permit for a sewer system for a three-bedroom
house, issued for the premises on June 6, 1969, have been exceeded.
A copy of that permit is attached hereto. Anchorage Municipal
Code 15.65.020(A) requires compliance with the terms of the

Wastewater Disposal Regulations and conditions of a written permit
issued by the department.
7. I also sought to inspect the property to determine
whether, in connection %~ith the visible construction taking place
on the premises, there had been any instal].ation of a new sewer
system without a permit, a violation of A.M.C. 15.65.040A.
8. Based on Mr. Schneider's refusal to permit me to
inspect the premises on July 15, 1983, I anticipate that Mr.
Schneider will continue to deny entry to inspectors of the
Anchorage Department of Health and Environmental Protection
unless that entry is authorized by a search warrant.
