AK 99577, hereinafter referred to as the Grantor, and
of JOHN E. ABRAMS & KAY ABRAMS of 13710 SAVAGE DRIVE, ,EAGLE
RIVER, AK 99577, hereinafter referred to as the Grantee.
WHEREAS, the Grantor is the owner in fee simple of the following described realty:
FIRE LAKE #2 BLOCK 1, LOT 5 Subdivision, according to the official Plat
thereof, filed as Plat P-515 in the Anchorage Recording District, Third Judicial District,
State of Alaska, s �..
and,
'WHEREAS, the Grantee is desirous of enjoying the use of a certain portion of the
Grantor's land for the sole purpose of ingress and egress to Grantee's land for the
purpose of installing and maintaining a private septic system,
and,
WHEREAS, the Grantor has agreed, in consideration of $10.00 (Ten Dollars and No
Cents) and other good and valuable consideration, the receipt of which by Grantor is
hereby acknowledged, to grant to the Grantee an easement solely for said defined
purposes and no other,
NOW this grant witnesseth that in return said specified consideration paid by the Grantee
to the Grantor, the Grantor hereby grants unto the Grantee, his heirs and assigns, full and
free right and authority to install and thereafter maintain a private septic system upon a
portion of Grantor's land as shown by the "AS -BUILT' by JOHN L.,SCHULLER dated
November 6, 2019.
This Grant of Easement is intended to be appurtenant to Grantee's above-described land
and touches, concerns and runs with said lands. This is not intended to be' an exclusive
easement: the Grantor herein expressly reserves unto himself equal rights of ingress and
egress and all other rights as the owner in fee simple of the described premises.
This agreement nuns with the land. If public water and sewer become, available or the
subject encroaching septic system is identified as in failure and cannot obtain a Municipal
of Anchorage Certificate of On -Site Systems Approval, this easement becomes null and
void and Grantee will abandon the encroaching system and connect to the public utilities
or install a legal system on Grantee's property, FIRE LAKE #2 BLOCK 1. LOT 6

Any dispute or disagreement arising under or in any way concerning this instrument shall
be submitted for resolution to the process of binding arbitration in accordance with the
Alaska Statutes made and provided for said arbitration. The jurisdiction of the Arbitrator
shall commence 60 days from the onset of the dispute and shall operate to toll all
applicable Statutes of Limitation.

All construction shall be in accordance with:
1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska
Wastewater Disposal Regulations (18AAC72) and Drinking Water Regulations (18AAC80)
3. The wastewater code requires inspections during the installation. The engineer shall notify the Development
Services Department per AMC 15.65. Provide notification by calling (907) 343-7904 (2417).
4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather
shall be either:
a. Opened and Closed on the same day, or
b. Covered, sealed, and heated to prevent freezing
Special Provisions: Please acquire a recorded access agreement for the septic system to be located on the
11 adjacent lot and submit a copy to the MOA prior to approval of the inspection report/record drawings..

RE: SEPTIC SYSTEM UPGRADE PERMIT
LEGAL: FIRE LAKE #2 BLOCK 1, LOT 6
The septic field has failed and we request a septic permit to upgrade the crib on the above
referenced lot. Due to location of system and other lot restraints we propose to install the new
field on the adjacent lot, which is owned by the same owners.
A test hole was performed to verify ground water levels and soils. Given these site conditions it
is proposed that a deep trench be installed and connected to the existing concrete tank.
The lot and area is served by private water systems and the design will not impact any of the
neighboring properties. Please contact Brent M. Western or me if you have any questions.
