The Municipality of Anchorage Development Services Department (DSD) issues Certificates of On-Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registeredin-the State of Alaska. Certificates of On-Site Systems Approvalarerequired-for-the .transfer of-
title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or water
~ulSply system. DSD also issues COSAs upon request to homeowners. Certificates of On-Site Systems Approval
are-vaiid for 90 days fr0m-ttie datelof iSSue for Properties Served bY a-private 0r class c '~,~-ii ~'ncl~rna~, b~ireissued
with new water sample results. (Certificates may be reissued for a period of up to one year with valid water
samples.) CertifiCates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is'not responsible for errors or omissions in the professional engineer's work.
4. STATEMENT OF INSPECTION BY ENGINEER
As certified by my seal affixed hereto and as of the validation date shown below, I verify that my investigation,
based on procedures outlined in the Certificate of On-Site Systems Approval Guidelines for this application,
shows that the on-site water supply and/or wastewater disposal system is (are) safe, functional and adequate
for the number of bedrooms and type of structure indicated herein. I further verify that based on the information
obtained from the Municipality of Anchorage files and from my investigation and inspection, the on-site water
supply and/or wastewater disposal system is(are) in compliance with all applicable Municipal.and State codes,
ordinances, and regulations in effect at the time of installation.

Instructions for On-site Sewer System Test
The Department of Health and Environmental Protection has been
requested to evaluate and approve the sewer facilities serving
your property.
When your sewer system consists of an absorption pit and possible
septic tank, standpipes are required to provide access to each
component of the system. Older sewer systems which have septic ~
tanks not documented by an installation inspection must have
the manhole exposed. In order to evaluate the sewer system,
an absorption rate test is required. The test is conducted by
using one (1) of the following two (2) methods. Your inspector
will note which one to use.
A. The addition of fresh water to the seepage pit and measuring
its rate of absorption over a twenty-four (24) hour period.
The homeowner has the responsibility of ordering 1,000 gallons
of fresh water by contacting a cesspool pumper and requesting
the water delivered at a specified time, excluding Fridays.
The delivery time MUST BE correlated with the department to insure
an inspector is present during the test. The 1,00~ gallons of
water is discharged into the seepage pit, the septic tank pumped
for maintenance purposes and to insure the pit ~est is not affected
during the twenty-four (24) hour period.
B. Seepage pits which are nearly full must have ONLY the SEPTIC
TANK pumped twenty-four (24) hours prior to conducting the absorption
rate-test on the pit° The pit test will be conducted by the
cesspool pumper bringing 1,000 gallons of fresh water to the
site. Five-hundred gallons of sewage will be removed from the
pit, measurements taken and the pit filled to the maximum crib
height using the five-hundred gallons removed plus a portion
of the 1,000 gallons as required by the inspection. Correlation
of the cesspool pumper truck and the department to insure an
inspector is present during the pit test is the responsibility
of the homeowner.
In instances where the sewer system consists of a septic tank
and drainfield, this department must be immediately notified
and the septic tank exposed for documentation. An alternate
method of testing is required and will be explained to you.

I will detail this situation in general.
We are asked by lending institutions to approve existin~ on-site sewer and water
systems prior to sales on homes.
A. We check the well construction, location in relation to sources of
contmnination and take n bacterial analysis.
B. ~?e determine the operational capability and type of sewer system on
the property.
We then provide a report that indicates the status of the sewer and water system
and any deficiencies,
The current ordinances, and rightfully so, state that it is a violation of the law
to dispose of sewage into a septic tank system that is not properly designed,
constructed and maintained.
We conduct the "water test" on disposal systems to insure that the systems have
been adequately maintained and will still dispose all the wastes g'enerated from the
facility they are connected to.
The bank asks for our approval to cover themselves and we conduct these tests to~
insure that everything is as we so state.
Our service costs $25.00. Local engineering firms can provide the same service
for $175.00 and up.
My people will not do bank loan approvals without conducting the tests as I have
explained and as outlined on the sheet of explanatien.
Further, I disagree with the ombudsmsn's interpretatien that this is a regulation
subject to APA, Chapter ~.70.
Legal advise is being' soug'ht on this matter.

Strandberg's questions, I was unable to find Assembly
approval of Lhe Instructions for On-site Sewer System
Test (see aLtached).
I am under the impression that, by reason 'of the Admini-
strative Procedure Act, Chapter 3.70 of the Hunicipal
Code, a regulation of this kind would need approval of
the Assembly.

GENERAL PROCEDURES WHEN RESIDENCES ARE INSPECTED
FOR LENDING INSTITUTIONS

Make sure the well is constructed properly and also
check to see if the well is protected from surface or
ground water contamination. A well that is buried or
in a pit is not approved and must be upgraded.
Upgrade of a well: Monies may be escrowed to complete
the upgrade at a later date, if the upgrade can not be
completed due to a seasonal construction problem.
Wells drilled after June, 1975 should be

Wells serving a single family residence must have a one-
hundred (100) foot protective radius from any sewer system.
Existing semi-public wells must be eighty (80) feet away
from a septic tank and one-hundred twenty (120) feet away
from the leaching area.
Any dwelling served by a well which was drilled after
July 1, 1975 and that is greater than a single family
residence must have a two-hundred (200) foot protective
radius from any sewer system.
A bacterial analysis is required. If the test is positive
the well must be chlorinated. If the second sample remains
positive, there is a possibility that there is either
constructional problems or there is a direct contamination
which must be corrected.

If a sewer system was installed after June, 1968 it should
have been inspected by our department. If it was not
inspected after said date, it is an illegal sewer system.
On any existing system there must be a standpipe for the
septic tank and absorption area. These are required for
maintenance purposes. Usually if a system is older than
two (2) years we will require a percolation test. The
percolation test is run to establish the adequacy of the
absorption area. We will also require the septic tank
be exposed and pumped to verify its existance and size.
If a sewer system was designed for a certain number of
bedrooms and a request comes to 'this office for more bed-
rooms than the original approval, we will require an
upgrade of the system°
D. Currently the minimum size of a tank is 1,O00 gallons.
When an upgrade is required for older systems, we will
require a soil test, which will be needed before we can
establish specifications and issue a permit to upgrade
the system.
Upgrade of a sewer system: Monies may be escrowed to

"Nonwater carried sewage disposal systems" means all devices used for
the disposal of human excreta in which water is not used as a conveyance.
' C. "Sanitary sewer" means a sewer that carries liquid and wa~ep carried

D. "Seepage pit" means a covered pit with open-jointed lining through which

a building sanitary drainage system on part thereof and is designed and

soil outside of the tank through a seepage pit or a system oF open joint oP

F. "Sewage" means human excreta, food wastes disposed o~ through sewers,
washwaEep, liquid wastes from residences, institutions, business
' buildings, and industrial establishments and such diluting water as may

H. "Subsurface disposal field" means a system of buNed open joinEed pipes
through which sepdc tank eft'luent may seep or leach into the surPounding

I. "Treatment plant" means an individual household aerobic waste treatment
system that has been approved by the Departmen~ of Health and
Environmental P~otection, tested and certified by the National Sanitation
Foundation Testing Laboratory, Ann Anbop, ~/chigan, meets or exceeds
National Sanitation Foundation Standard No. 40, and meets on exceeds

B. Untreated discharges. No person shall cause or permit any sewage or
other wastes to be discharged into or disposed of in such a manner that
access will be gained to any waters of the State of Alaska unless such
sewage or wastes are first treated in a manner approved by the
department and the Alaska Department of Environmental Conservation.

C. Hazardous discharges. No person shall cause or permit any human
excreta, kitchen wastes, laundry water, sink water, toilet wastes, septic
tank e'ffluent, sewage or other wastes to be discharged or flow upon I:he
surface of the ground or' into any ditch, gutter, street, roadway, s~ream,
lake, underground water SOLirce, or public place nor onto any private
property so as to create a nuisance or health hazard. (GAAB 16.45.020)
D. Watershed areas. No person shall cause or permit a sewage disposal
system to be located within the drainage of any waLershed area used 'For
or reserved for use as a source of public water supply without the written
approval of the department. Such sewage disposal systems shall consist
of an adequately sized, self-contained tank, a tried and proven
incineration device, or other similar methods approved by the department.
No method of sewage disposal shall be used in any watershed drainage or
any area reserved for use as a watershed to provide a public water
supply, when such is of an experimental nature, ffhe department shall
promulgate and enforce such regulations necessary to prevent con-
tamination of watershed areas. Such regulations shall include but not be
limited to tank construction, tank size, ~ank location, and methods of
servicing that will guarantee adequate watershed pro~ec~ion. (GAAB
'16.45.030).

E. Domestic waL~r systems. No person shall cause or permit any abandone~~
well or deep well 'to be Used For the disposal of sewage or used as a
receptacle for household wastes. No person shall cause or permit any
cesspool, septic tank, or privy to be located in any water-bearing stratum
that is or may be Used as a source of domestic water supply or to be
otherwise located so that POllution From same can enter any domestic water
supply. (GAAB 16.45.030). _
F. Roof drainage. No person shall cause or permit any cooling water, or
footing, surface, or roof drainage to be discharged into any septic tank
or sanitary sewer. (GAAB 16.45.020)
G. Hindr*ance of facility operation. No person shall place into any septic
tank, seepage pit, drain field, sewer line or treatment plant any object or
subsbance that might hinder the operation of said septic tank, seepage
pit~ drain fie/d, sewer line, or treatment plant, except as necessary
during repair or maintenance. (GAAB 16.45.020)
H. Disposal of wastewater disposal system contents. No person shall cause
or permi~ any part of tile contents of any privy, septic tank, or sewage
treatment plant to be discharged upon the surface of the ground unless
pursuant to the terms of a written permit 'to do so From the department.
Final disposal shall be incineration, buria/, or other means approved by
the department. (GAAB 16.45.040)

A.
Septic tank seepage system disposal facilities shall not be used or
installed on any parcel where sanitary sewers are available/ provided that
this section shall not apply to premises having the sewage flow equivalent
of a two-family dwelling unit or less where said Premises is more than
feet from a right of way or easemen~ containing a sewer main From which
sanitary sewer service is available.
B. Sanitary sewers are available ~o a parcel when thai parcel borders a righ~
of way or easement containing ,a municipal sewer main and when the main
extends at least ten 'Feet inside a perpendicular line drawn from the sewer
main to any cornet- of the parcel which touches the right of way or
easement.
C. All property owners shall comply with the requirements of this section
within one year after- sanitary sewer becomes available to the parcel
(adapted From GAAB 16.45.050).

No person shall construct or instal/ any septic tank, treatment plant,
drain 'field, or seepage pit within Anchorage thai does not comply with tile
requh'ements of this chapter and the specifications o~' the department and
and the Alaska Department of Environmental Conservation. No person
shall construct, sell, or install any septic tank, seepage pit, or drain
field without first obtaining a permit From the clepartment.

No person shall install a septic tank soil absorption system on any lot
having an area less than 1 1/4 acres within lot lines or where the soils are
classified as requiring a greater area than 190 square feet per bedroom by
the Unified Soils Classification System or where a percolation test shows
the absorption capacity of 'the soils 'to be greater than fifteen minutes per
inch Nvithout the written permission of the department. (new)
C. No septic tank, treatment plant, drain 'field, or seepage pit shall be
backfilled without the permission of the department. All persons shall
contact the department giving as much notice as possible prior to covering
or backfilling any septic tank, drain field, seepage pit~ or cesspool.
D. The department encourages the development and use of new processes and
methods which have been 'thoroughly tested and found satisfactory in
operation. If new processes or methods are proposed incorporating
deviations 'From standard practice, proof of merit must be provided
together with a bonded guarantee of performance. Because methods and
processes of sewage disposal and treatment are continually changing with
the advent of additional knowledge and experience, approval of plans and
specifications by the department does not imply that recommendations for
altera'tions or additions will ~ot be offered a't some later date when
conditions change or methods and processes are improved.

: 1. In determining a suitable location for the system, consideration
shall be given to the size and shape of 'the land area available, type
of soil, slope of natural and fininshect grade~ depth of ground
water, proximity of existing or future water supplies, and possible
expansion of the system.

3. Treatment plants shall be required as described in -Fable 1.
(a) Nlaintenance of the treatment plant shall be provided by a
contract between 'the property owner and the local distributor
or maintenance concern. Copies of the current maintenance
agreement between the homeowner and the maintenance
concern will be provided to the department by the
homeowner. A copy of the contract shall be supplied to 'the
department within thirty days after installation of the
treatment plant. (new)
(b) The general maintenance contracL must comply with the
National Sanitation Foundation Standard No. 40 requirements

and receive approval of the
Attorney. The contract department and the P4unicipal
requirements as outlined ,must Include the service
Dy th.e National Sanitation
Foundation sLudy leading to approval of that type of plant
and by the plant manufacturer. All maintenance agreements
shall have a provision For removal of excess biological sludge.
In maintenance conLracts that provide for the performance of
maintenance work or inspeckions~ reports of maintenance work
performed and the results of Periodic inspections made shall
be filed with the department within thirty days after the ~ime
the work is performed or ~he inspection made. (new)
(c) Failure to perform the maintenance agreed to in a maintenance
contract is a violation of this chapter subjecLing persons who
fail to Perform such maintenance to suit for civil penalties and
injunctive relief. (new)

15.65.070 Seepage_j~i
A. The use of seepage pits for disposal of septic tank effluent shall be
acceptable only when soil conditions or topography indicate a need for
this method of disposal. (GAAB 16.45.060).
B. No seepage pit excavation shall extend into the water table. Where
ground water is encountered, the bottom of the pit shall be backfilled
with clean coarse sand or similar material to at least four feet above the
waLer table. (adapted From GAAB 16.45.060)
C. The top of all seepage pits shall be not less than eighteen inches below
the finished grade. (GAAB 16.45.060)
D. The required absorption area of seepage pits shall be computed on the
basis of soils analysis conducLed according to the requirements shown on

greater than thirty minutes per inch, that is, in areas where more than

The required seepage area for seepage pits shall be determined in the
same manner as the minimum absorption area for subsurface disposal fields
in § 15.65.060(B). (new)
The effective seepage area of a seepage pit shall be tlae vertical wall area,
based on dug diameter, of the pervious strata below the inlet. (GAAB

No person shall cause or permit any seepage pit to be constructed or
installed less than 100 feet from any river, lake, or stream or any source

property line; 15 feet from any septic tank; 10 feet from any water main

Earth pit privies shall be constructed as recommended in the Alaska '~'~;
Department of Health Document HSE 7-2, Sanitary Privies~ or in a
similar manner approved by the department.
Seat covers of any earth pit privy shall be kept closed during
ins. ect seasons when the privy is not in use. The contents of a
privy shall no~ be permitted to overflow onto the surface of the
ground or be exposed to insects~ rodents, or other animals. ~¥hen
the pit becomes filled to within eighteen inches of the ground
surface, either the contents shall be removed and disposed of by
burial or other means approved by 'the department, or a new pit
shall be excavated and the old one be backfilled with at least two
feet of earth.
4. The pit of all abandoned privies shall be backfilled to six inches
above the original ground surface.
5. Privies shall not be used where adequate water supply is available
to operate a water-carried sewage disposal system except for sho~t
periods of time as approved by 'the department.

September 1, 1988, are exempt from the design requirements of
15.65.040(E)(6), 15.65.050, 15.65.060, and 15.65.070(C)~(G), but modifications
to those wastewater disposal systems made after- September 1, 1968, are not
exempt from the requirements of this chapter. (adapted from GAAB 16.45.060).

Permits required by this chapter for persons who construct, sell, or
install any septic tank, seepage pit or system, drain field, or package waste
treatment plant as a business shall be issued on an annual basis and shall expire
on December 31 of the year of issuance. The annual fee for such permits is

plants without first obtaining a permit to do so from the department

C. No person shall pump, transport, or dispose or the contents of privies,
septic tanks, and sewage treatment plants in such a manner that a
nuisance or health hazard is created. (GAAB 16.45.040)

I will detail this situation in general.
We are asked by lending institutions to approve existing on-site sower and water
systems prior to sales on homes.
A. We check the well construction, location in relation to sources of
contamination and take a bactel'ial analysis.
B. We determine the operational capability and type of ..-,ewer system on the property.
We then provide a report that indicates the status of tho sewe~ and water system
and any defieienele=.
The current ordinances, and rightfully so, state that it is a violation o~ the !aw
to dispose of sewage into a septic tank system that is not properly de,il:ned,
constructed and maintained.
We conduct the "water test" on disposal systems to insure that the systems h~ve
been adequately maintained and will still dispose all the wa~.~tes generated from the
facility they are c~onnected to.
The bank asks fro' our approval to cover themselves and we conduct these tests to
insure that evm~rthing is as we so state.
Our service costs $25.00. Local engineering firms cmn provide the same service
for $175.00 and up.
My people will not do bank lean approvals without conductin~.,~ the tests as I have
explained and am outlined on the sheet of explanation.
Further, I disagree with the ombudsman's interpretation that thi~ is a regu]f~tton
subject to APA, Chapter 3.70.
