The adequacy test performed on the subject property shows
the system is not functioning properly for a six(6) bedroom
duplex.
Because of the location of your well and the neighboring
well, relocation of the existing system is not possible.
Therefore, before we can grant approval, a 1,000 gallon
holding tank will need to be installed. This should be
installed immediately after the existing 1,750 gallon
septic tank. You would then have two(2) holding tanks.
The seepage pit and drainfield must be disconn%eted.
A ps.nit will need to be issued for the installation of
the holding tank.

sewer systen!. Please be advised that this is not an approved sewer
syste~ duo to deficiencies in the absorbtioz~ area and the well dis-
tances (See report). Mr. David A. Brown, the licensed excavator who
installed the systea for you, will be required by this Department to
aake th~ necessary corrections, weather peraitting.

system can be worked out with a minimum of problems.

It a~pears ti'~at it will be come time before Borough sewers will be
available to your subdivision. At this tim~, tt~ere are no plans for
providing sanitary sewers for Alpine Village. This would probably
also apply for a public water supply.

client may be operating under some misconceptions.
First, Mr. Sanders is in no way being held
responsible for the present inadequate distance between
his system and his neighbor's well. This is not the
focal point of Borough concern. Rather, the Borough
has only, and quite 'reasonably it would seem, requested
that any extensions of Mr. Sanders' system be made in
a southeasterly direction, that is, in the direction
away from the well. Now that Mr. Sanders and the
Borough alike are cognizant of the existence of the
well, it can hardly be eXpected that Mr. Sanders would be
allowed to proceed in a manner that would increase the
likelihood of its contamination. I am aware of no hardship
that this directional requirement imposes upon your client.
Second, Borough approval of a sewer system
is no guarantee that the system will never constitute
a source of trouble requiring remedial action. The
system as approved by the Borough appears to have been
sufficient for normal use. Ms. Dickerson has explained
to me, however, that demands put on The system have been
'excessive. The Borough can see no reason why it should
pay any part of Mr. Sanders' costs in upgrading his system
to meet those demands.
Clearly, until some exploratory digging is
undertaken, neither the Borough nor your Client will
know precisely where the problem lies. The Borough,

however, must fulfill its responsibility to the public
to rid the area of unsanitary sewage; Mr. Sanders must,
therefore, take the steps necessary to upgrade his system.
The Borough thus continues to expect that
Mr. Sanders will meet the June 30 deadline. If you
wish to discuss this matter further with me and/or
Ms. Dickerson, we will be happy to meet with you.

Gentlemen:
Mr. Tom Sanders has brought to my attention your
correspondence of March 22, 1.973 and ~ 23, 1973.
You may recall ~from the meeting that we had in your
office in mid-March, 1973, the subject of the Sanders sewer
system was discussed at some length. Present at that meeting
were Mr. Strickland, Ms. Dickerson, Mr. Sanders, and the
undersigned. At that meeting the focal point of discussion
was the adequacy of the system on Mr. Sanders' property.
The fact that this system had earlier been the subject of
litigation between himself and the contractor was also
brought out. This earlier litigation resulted in the system
being redesigned,' re-installed to meet the borough's
"mandatory requirements" then existing. Needless to say,
those earlier "mandatory requirements" were borough specified,
borough supervised, and borough approved. Mr. sanders right-
fully assumed that with borough involvement to such a heavy
extent, that his system was not only legal, but in addition,
sufficient and adequate.
Your correspondence of March 22 and April 23 now
changes the focus from the adequacy of the system which had
been earlier "mandatorily required", supervised and approved
system to a focus on a 100-foot requirement from a well which
is not on Mr. Sanders' property. As your department is well
aware, the well in question was placed on the adjoining property
subsequent to the borough's "mandatory requirement", supervision
and approval of Mr. Sanders' sewage system.
During our discussion at the mid-March meeting, your
department through the representatives present, stated that
the adjoining neighbor's well had been put in without borough

approval or even a simple request for a permit for installation.
Under such circumstances' it seems extremely unfair, irregular
and improper for the borough now to place the onus on Mr.
Sanders to~ upgrade his syStem to avoid coming within 100 feet
of the adjoining well.
Based on the observations of your department, it
would appear that an upgrade of the system is in order. Mr.
Sanders would be willing to proceed with an upgrade of the
system on th.e following basis:
That in the event the upgrade of the system
requires full utilization of drainage area
on any point on his property, that such a
utilization can and will be made with prior
borough approval. (This was the understanding
Mr. Sanders had when he left them[d-March
meeting. )
That the borough, having approved the design
and construction of Mr. Sanders' present system,
misled Mr. Sanders. At a considerable outlay
of time and money, Mr. Sanders met the earlier
borough requirements. Now the borough has changed
its requirements by focusing on an unauthorized
adjoining system. To the extent that a revision
is required by the borough, the borough due to
its misleading of Mr. Sanders, will pay all
costs associated with the revision of his system.
In conclusion, I should call to your attention that
Mr. Sanders' inability to sell the subject property because of
the borough's change of position, as it relates to the adequacy
of the system, has and will continue to result in damages to
Mr. Sanders in terms of his marketing the property. Accordingly,
we request that you issue a permit on the basis of the fore-
going stipulations.

Dear Mr. Lee:
Thank you for your inspection report dated January 28, 1971, of Lot 1 Block 4
Alpine Village Subdivision. I have a number of questiona about this report. (1) It
was my understanding from Mr. Brown at the time of installation that this sewage
disposal system was built to specifications that he received from you. (2) Weather
permitting, just what will Mr. Brown be required to do about the distance from A to
B which is now 50 feet and your minimum required distance stated on your on-site report
is 80 feet. (3) Unfortunately I do not believe my lot is large enough to accomodate these
minimum required distances. (4) Specifically what is David Brown going to be required
to do on this syst~to receive borough approval.
As I have already paid for this installation in full to David brown w~th the assurance
that it would be a completely approved borough sewer system, I don't fe~l that I can
affor~ another $2000.00 or $3000~00 or $4000.00 to correct the stated'deficiences.
(1) If the borough requires a certain distance from A to B why was this distance not
stated to David Brown in the recommendations he recieved from the borough when the
soil sample was given and recommendations asked of the borough?
Do you have any idea on when I can expect to hook into a borough sewer system? Are there
any plans for providing borough sewers in the ALpine Village subdivision.
There is a water sample taken from my well in March of 1970 on file at your office.
This sample showed no evidence of contamination at that time. If there was no contamination
of the water in the well with a totally inadequate sewage system I had in at that time
(one log cesspool and four 50 gallon barrels and no ~ravel) I fail~ to see the concern for
minimum required distances with the much improved system I have in now.
Are there any plans for providing Alpine subdivision with city water?
Thank you for all your time and cooperation. I sincerely hope we can get this problem
straightened out in the near future. Needless to say I am becoming very tired of cesspool~,
sewer systems and lawsuits.
