The tank was placed within forty(40) feet of the creek. This is a violation of Municipal Ordinance 15.65.090 A, B. On November 26, 1980 the holding tank had not been moved. We are aware that a distance waiver request has been made to the State Department of Environmental Conservation; however, until a waiver is obtained from DEC and the Anchorage Department of Health and Environmental Protection, the holding tank must not be backfilled or used. The Code provides for criminal penalties, civil fines of $50 to $1,000 per day and injunctive relief. If there are any further questions, please call this office at 264-4720. They should only be allowed when no other options for sewerage disposal are available, and a sewerage system for the lot is scheduled for construction within the near future. In view of this, we feel that a holding tank can be placed within 100 feet of a creek in accordance with state requirements providing the following conditions are met: (1) The holding tank must be constructed of a sound material of approved design. (2) The creek shall not be utilized as a direct drinking water supply source. (3) The site for the holding tank should be selected based on the physical characteristics of the lot (i.e. distance from the creek, water table, soils, well location, etc.) (4) The system must have a pursuant contract with an approved pumper. (5) The tank should be sized to hold 1 1/2 times the average sewerage that normally would accumulate during the contract pumping cycle. In addition, our department may consider any of the following requirements based on each individual case. (1) The home should be equipped with water saving devices or pressure reducers to reduce the quantity of wastewater produced. 18-.09 LH Rolf Strickland Page 2 December 24, 1980 (2) The tank should have a high level warning system. (3) If the tank is located in an area with a high water table, the sewer line should be constructed in accordance with zero infiltration standards to prevent overflow of the tank by groundwater.
