Replat and Vacation for Lot 21, Block 21,

VACATION JUSTIFICATION
The original plat (66-167) for Alyeska Subdivision Third Addition created 10 foot wide utility easements
on all property lines within the subdivision. The redundancy of easements within the subdivision is not
necessary for the utility development for the area. The easements are being vacated due to the location
of the existing structure on the property. The house encroaches into the easements as currently platted.
All of the utility companies have issued letters of non-objection for the proposed utility easement
vacations except for Chugach Electric Association with respect to the western most easement.
DOWL has requested an encroachment permit from Chugach Electric Association for the western
easement. This action combined with the re-designation of the westernmost easement to an Electric
Easement, as shown on the preliminary plat, will allow unencumbered conveyance of the property in the
future.
PRELIMINARY PLAT
The preliminary plat is being submitted for review concurrent with the vacation request. As noted on the
plat, all of the property lines are record per the original plat. There will be no modification of the
exterior lot lines of Lot 12, Block 21, Alyeska Subdivision Third Addition. We have obtained a survey
waiver from Mr. Tom Knox, the Municipal Survey, for this platting action. An As-Built for the property
has been prepared by Lantech and is attached for your use.
In addition to the vacation request, a Nonconforming Determination has been issued by the Building
Safety Division for this property. A copy of this letter is attached for your review.
DRAINAGE ANALYSIS
The proposed replat and vacation will have no impact to the existing drainage within the subdivision.
There are no plans for development of this property beyond the existing improvements shown on the As-
Built drawing.

Dear Mr. McCoy:
we have reviewed your request for a nonconformin~ determination on
the above referenced property.
* Plat #66-167 creating this lo5 was filed December 7, 1966.
* Tax parcel #076-022-25, indicates a single family dwelling
placed on the record in 1982.
* No land use or building permit in evidence.
Area was zoned Unrestricted 1965, R-il Turnagain Arm District
December 13, 1983.
* Principal structure encroaches 8 feet the 20 foot front yard
setback. Covered open porch encroaches 17.6 feet the 20 foot
front yard setback at its southwest corner.
The above information indicates the principal structure precedes
zoning. Therefore it is classified as a nonconforming structure
and is governed by Anchorage Municipal Code 21.55.040. This
section states what restrictions and requirements apply to such a
property, a copy of which is attached.
Certification of this nonconformity by the undersigned is hereby
documented for record this date.
Access to this property appears to be through Lot 13. An "access
agreement" (enclosed) must be executed for this property to be in
compliance.

The covered open porch encroaches 7.6 feet the lO foot utility
easement at the southwest corner of the property. The dec k
encroaches 4.4 feet the utility easement along the west
property line.
If the utility easements are not vacated as stated in your letter
of July 8, 1996, a right-of-way encroachment permit must be
obtained from the Public Works Right-o£-Way engineer Ron Goughnour,
343-8246.
