Maddock 12900 Tracy Way Anchorage, Alaska 99516 Subject: Sewer system on Lot 3, Blk 1, Aspen Highlands #1 PID 017-013-27 Dear Mr. & Mrs. Maddock: In a recent review of a Health Authority request for Lot 2, it was discovered that the seepage trench serving your home is actually encroaching on the 100 foot protective radius around the well on Lot 2. This well has been in place since about 1970; your sewer system was installed in 1985. A review of our file shows that the 1985 upgrade installation was inspected by a private civil engineer. The Health Authority Approval this department signed in 1988 was based on a field inspection by the same engineer; the encroachment was not noted at that time. It is incumbent upon every person installing a sewer system or a well to verify separation distances to all adjacent'wells and sewer systems. Since the well on Lot 2 was already in existence at the time of the sewer upgrade on your property, the burden of protection would have fallen to the property owner of Lot 3. The current encroachment is a violation of AMC 15.65.060B.1, which requires a 100 foot separation. I am notifying you of a violation of that section, and will require that appropriate action be taken to remedy the violation within thirty (30) days from today's date. You will have a choice of either moving the existing trench or obtaining a separation distance waiver to the well on Lot 2. I trust in your absence your secretary can address the concerns in this letter. Enclosed you will find a copy of a July 27, 1990, letter from the Municipality to my clients, the Maddocks, in regard to the sewer system on Lot 3, Block 1, Aspen Highlands #1, as it affects the well on Lot 2 of the same block and subdivision. Your client, Mr. Lee Reid, is the person responsible for having approved the septic system on my clients' lot prior to their purchase in 1988. It is his responsibility to insure that all Municipal regulations were followed. I briefly spoke with John Smith, Program Manager at the Municipality, in regard to this letter. He indicated that applying for a waiver would not be out of the question and, in fact, would probably be the reasonable solution to this problem. Would you please advise Mr. Reid to immediately apply for a waiver and obtain same for the Maddocks' lot. You have until August 27, 1990, to comply with the terms of the Municipal letter. I am confident that Mr. Reid can accomplish whatever needs to be done more economically than either the Maddocks or I. Please send confirmation that Mr. Reid or his designee has either made arrangements to move the existing trench or has obtained or is in the process of obtaining a separation distance waiver for the distance between the sewer system on Lot 3 and the well on Lot 2 and have same to my office by August 20, 1990. We under- stand that the septic system consists of a 1,250-gallon septic tank with a seepage pit and a 41-foot drainfield trench. This information was obtained from the Municipality of Anchorage, Department of Health and Environmental Protection files. The septic tank had not been pumped prior to the percolation test. Since the 4-bedroom house had been occupied prior to the test, a normal degree of saturation within the leach and drainfields is assumed. The test was performed in accordance with the "Adequacy Test General Procedures" for Drainfields as published by the Munici- pality of Anchorage. The test was conducted using a four (4) bedroom house criteria as per the existing structure on the site. This requires the addition of 650 gallons of clear water into the system in 50-gallon intervals. Due to the limited (400 gallon) storage capacity of the well on this site, 480 gallons or 80% of the total daily load of clear water was added on day 1 of the test and only 418 gallons of clear water could be added on day 2. Water levels in both the septic tank and seepage pit were measured at 50-gallon intervals. Drainfield water levels were also monitored throughout the test. Water levels in the house bathrooms were monitored and no system backup was observed during the test. The test was initiated__~n--J~-_~and was completed on June 18, A 2-day delay due to_~ell prob~ occurred between the normal first day and _~ee~nd da~cedures. Clear water was added to the system at a maximum sustained rate of 5 gallons per minute. For this test, the water was added to the septic tank. Based on our test observations of well production and water levels in both the septic tank and seepage pit on days 2, 3 and 4 (water levels within 1-1/2 inches), and on the fact that the system did not appear to be in danger of backing up; we conclude that the current on-site sewage disposal system is adequate for a three (3) bedroom structure. We note that we could find only three (3) designated bedrooms in the house at this time. The intent may be to add an additional bedroom in the basement of the house. We trust that the foregoing information and data will be sufficient for the Department of Health and Environmental Protec- tion to make a favorable decision on the adequacy of this system. The septic tank must still be pumped and the receipt turned in with this report. In addition, we recommend that system clean-out lines be checked to ensure that they are free from debris since it was evident that the septic tank had not been pumped in some time. The well on Lot 2, has been in place since 1970 and the septic system leachfield on Lot 3, was installed in 1985. The septic installation was inspected by a private Engineering firm. This lesser separation distance appears to have been ~ither overlooked or mismeasured. There is no well log for the referenced well, however, data collected during a recent flow test shows the well to have a static water level of 60 ft. and an approximate depth of 271 ft. This large difference in static level and well depth usually denotes a water source from a confined aquifer. Otherwise, if the aquifer was actually at 60 ft., then the well would not have been drilled so deep. The assumption of a confined aquifer is further supported by reviewing well logs for several of the surrounding properties. These well logs indicate several soil layers of differing consistencies including clayey gravel and hardpan. Believing the water source is a confined aquifer this would place the aquifer at a greater depth than 60 ft. a confining soil layer would also decrease the possibility septic effluent within the leachfield from making its way to the well. A risk analysis was performed using the Department of Environmental Conservations (D.E.C.), Separation Distance Waiver Guidelines and it appears that no bacterialogical pollution is possible from this source. The results of our risk analysis is as follows: Ae WATER TABLE: AS diScuSSed, the static water level within the well at 60 ft. should not be used as the aquifer depth. Instead, an inspection of several area well logs (attached) shows water first encountered within bedrock between 220ft. - $00ft. Subject: Lots 2 and 3, Blk 1, Aspen Highlands #1 Following receipt of the letter from Mr. Congdon, a copy of Mr. Weining's letter, and the explanatory letter from Lee Reid, Dan Bolles and I made a site visit to the subject lot. As a result I have the following comments to make: Our rough field measurements indicate that the system on Lot 3 is either too close to the well on Lot 2, or else too close to the well on Lot 3. I would like to see technical information on the type of metal detector used to locate the lateral sewer line. The Metrotech Company has been out of business for about 10 years; while they were in business, detector models they manufactured were unable to accurately detect to a depth of 8 feet below grade, where the lateral line is located. Dr. Reid states now that the system has a '°dog leg" in it. However, three pages of field notes and the official stamped and signed inspection report do not support this position. If the system was in fact installed in this manner, an amended inspection should have been filed with our office. The municipal code requires a separation of 100 feet between the nearest edge of an absorption field and a private well. References in the notes indicate measurements were made to the actual lateral line rather than the edge of the excavation. Naturally we are unable to know exactly where the edge of the excavation is, but normally a lateral line is placed about in the center of a trench excavation. Trenches generally are slightly greater in width than the backhoe bucket used to dig them. That means that the excavation would extend about 18-22 inches on either side of the pipe. If this is the case, by Dr. Reid's own measurements a violation exists. I have discussed this situation with my supervisor, John Smith, and he has directed me to take no further action since a separation waiver to the well on Lot 2 has previously been issued. /331 I~nclineeril~cI ~ ~nuironmenld Studies P. OF HEALTH & ENVIRONMENTAL PROTECTION RECEIVED Dear John: As we discussed on the phone, I maintain that the distance from the seepage trench on Lot 3 to the well on Lot 2 is not less than 100 feet, Here is my rationale. The old system on this lot was within 100 feet of the well that was located on the lot to the west. When we moved the septic system we had to consider the wells on Lot 2 and Lot 3. By the NE corner of the house we ]]ad a small corridor through which we could pass and maintain the 100 feet separation distances. At the NE corner of the house the edge of the trench is 10.5 feet from the house. See the copy of the field notes of Alan Wien. The distance from the well's edge on Lot 2 to the corner of the house on Lot 3 is 113.5 feet. The difference between 113.5 and 10.5 leaves 3 feet. The trench width is 2.5 feet. At the NW corner of the house the distance ~s about 12 feet. See attached. In reality, the system runs parallel to slightly toward the house. Just past the NE corner it starts to turn slightly northward to the end standpipe. If you visit the lot you can see where the earth has settled over the trench. It verifies the position as 100 feet from the well. Mr. Ned Newton and I used an electronic locator and a metal snake to verify the pipe locations. The location falls right in the sunken area. In hind sight, it would have been better to exaggerate our site plan to show this dog leg. We did note on our inspection report that the distance is 10.5 feet to the foundation from the system. Neither Susan Oswalt nor S&S Engineers contacted me to ask for a clarification or a verification of the distances. A simple phone call instead of Susan's threatening letter to Mrs. Maddock would have been all that was necessary to clarify the problem. The confrontational approach without all of the facts is usually counterproductive. Everything I have on my file and what I hsve measured in the field indicates that the trench is at lesst 100 feet from the well edge. On Tuesday, August 21, 1990, Lee Reid and Ned Newton made a precise measurement of the separation distances between the Maddock septic system and the well radius curves. The Metrotech locator was used to measure the length of the septic line. The li~ne fal!s one foot outside both hundred foot well radius curves. The Susan Oswalt letter of July 27, 1990 appears to be based upon an erroneous survey by Robert Shaefer of S & S Engineering. That survey assumed that the Maddock septic system was installed in a straight line. It was not. As the attached field drawing prepared by Lee Reid indicates, the line was built with a slight dogleg in it which skirted the outside of 'the 100' well radius circles. It seems to me as if our main task is to persuade Susan Oswalt or her superiors at the Municipal Department of Health and Human Services that Reid's measurements are correct and Shaefer's are wrong. Lee will contact Susan in an attempt to determine what proof she needs. If she does not accept the Metrotech locator's results, Lee suggests that a trench be excavated and the line Robert E.
