The proposed systems will serve an existing four (4) bedroom house. The existing system was designed and installed for a three (3) bedroom house and will be expanded to accommodate four. The existing field is in failure and will be re -used as a reserved based on CAT III. Currently the lot is developed. This lot is served by a private well. The surrounding developed lots are served by private wells. There are no wells within 100' of the proposed septic system. 1. Soils. Two test holes were performed in the vicinity of this system by Ted Moore in October of 2006, and groundwater was monitored for at least seven days. Ground water not was observed to a depth of 18.5' below the surface in the test hole monitor tube in October of 2006. Bedrock was not encountered in the test hole. Based on the results of the percolation tests and overall soils appearance; an application rate of 0.5 gallons/day/square feet was used for a CAT III wastewater system in the area of these test holes. 2. Soil Absorption System Design. a. See Sheet 1 of the design package. 3. Surface Water: There is no surface water within 100 feet of the proposed septic tank and drain field. The proposed drain field upgrade will maintain at least 100 feet from all surface water and drainage ditches. 4. Topography: The existing topography slopes from the northeast to the southwest at approximately 5% in the area of the septic system. There are no steep slopes within 50' of the proposed drain field. In consideration of the mutual covenants contained herein, the parties to this Maintenance and Repair Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as located at (legal description). 2. Definitions. Alteration. Any change to the design or function of an AW WTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Certificate of On -Site Systems Approval (COSA). An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with Anchorage Municipal Code (hereinafter, "AMC') 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an A W WTS that were included in the original design which would allow the AWWTS to continue to perform as designed. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an A W W TS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the A W WTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations, Installation and Removal of Additional Equipment. Prior to performing any alterations to an A W WTS, the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AW WTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AW WTS service and maintenance provider approved by the municipality and the manufacturer of the A W WTS for the entire term of the AWWTS In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AW WTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an A W WTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the A W WTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. H. Owner agrees that the A W WTS installation and maintenance requirements as provided by the AW WTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. 1. Owner agrees to provide and maintain a telephone connection to the A W WTS as required by the AW WTS approval. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement, the only authorized representatives of the parties are: a. Owner: b. Municipality: Director. Jurisdiction: Choice of Law. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Maintenance and Repair Agreement. 9. Severability. Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. The required separation distance between an absorption field and surface water is 100 feet. SITE PLANS It appears that the water running in this ditch has increased over the years to the point where it flows beyond the time period when snow melt in the immediate vicinity is completed. ROAD DESIGN The following is a justification for the requested waiver: 1. The topography is such that the slope direction is to the southwest. SOILTEST However, a berm has been installed along the southern border of the absorption field, such that any surfacing of effluent would be directed to the west and would continue on in a westerly direction towards the corner of the lot, where it can change directions to the PERCOLATION south and eventually reach the surface water near the culvert that TEST crosses under upper DeArmoun Road. The distance that the effluent would have to travel exceeds 100 feet before it would reach the subject surface water. STRUCTURAL d TI INSPECTIONS 2. The pathway that the effluent would have to take to reach the surface water is through a heavily vegetated area. This would have the effect of slowing migration and treating the effluent before it could reach the surface water. The ground surface elevation at the ends of the leachrield trenches is higher than the elevation of the sewer line leaving the house. As effluent reaches the surface of the ground in the septic system, it would back up into the house. The occupants of the house would have trouble with backing up sewage into the house prior to effluent being discharged out onto the ground, and therefore action would need to be taken to resolve the problem. The operational life of all septic systems depends on the local soil conditions, groundwater levels that may fluctuate during the year, and the water usage of the family being served by the system. These conditions are outside the control of the evaluator of this septic system. THIS INDICATES A WELL YIELD OF 3 GPM. WHEN THE PUMP WAS SHUT OFF THE WATER LEVEL RECOVERED FROM 193 FEET TO 182 FEET IN' 18 MINUTES. THIS INDICATED A RECOVERY RATE OF .75 GALLONS PER MINUTE. The Municipal -requirement for well flow is 150 gallons of water per bedroom per 24 hours.This well surpasses this requirement. The assessment of the condition of this well applies only to the conditions as of this date. The flow rate of the well may change due to subsurface conditions that may not be observed from the surface, and changes in land use and other factors that may impact the conditions of the aquifer feeding the well.
