Dear Ms. Oswalt:
In accordance with our meeting held in your office on March 17, 1993, I
am providing you with the required certification for the existing septic
system on proposed Lot #1, of the above referenced sub-division. This
certificate is provided as an attachment to this letter.
Based upon our meeting, I am of the understanding this certification
completes the Department of Health and Human Services (DHHS) criteria
required for this subdivision. As such, I now understand DHHS will
sign-off on the plat in the two lot configuration as represented in the
modified preliminary plat.
It is also my understanding the set-backs from water courses are to be
from the mean high-water lines, rather than the center of the channel.
These set-backs are to be shown on the final plat, along with other plat
requirements identified in the approved preliminary plat.
Please review the information contained here and advise me as soon as
possible of any other requirements needed, from your department's
perspective, for plat approval.
We intend to set the monuments on this property in the very near future
and will be processing the final plat shortly thereafter for
signature(s) as required.

ENGINEERING CERTIFICATION
I hereby certify that the existing septic system, located on
proposed lot 1 of the Bakic subdivision; S-9163, within the
Municipality of Anchorage, has an adequate absorption area;
the bottom of which is 4 feet, or more, above the water-table
during any season of the year. This certification is in
accordance with the requirements identified under AMC
15.65.060, sub-section 2.b. Certification is based upon the
site topography, the existing test pits that have been dug on
proposed lot 2 of this subdivision, inspection of the
existing septic system and other engineering considerations.

Dear Mr. Howard:
The final plat for this subdivision will consist of two lots,
rather than three as originally proposed. We have adequate
water monitoring information for the newly designed Lot 2. Due
to the lot configuration and the stream crossing, we will ask
for a plat note requiring the private well on Lot 2 to be
installed to the south of the northern 100' stream setback.
This is necessary to ensure that the reserved disposal area is
maintained. No structures may be built in the reserved area.
We will not accept survey information to verify that the
disposal system on Lot 1 is in compliance. The testhole is too
far away, and you cannot guarantee that groundwater follows the
contours of the land. As previously requested, we will require
that a water monitoring test pit (or augured hole) be installed
next to the absorption area on Lot 1 and that water monitoring
readings be taken through at least the middle of May. Based on
these results, this department will determine if that system
will need to be upgraded prior to final approval.

This letter is a request for clarification of the steps that
you will require for approval of Bakic Subdivision, as stated
during our phone conversation of February 22, 1993.
As you know, I am new to this project and am trying to
expedite its completion for our client. It is my
understanding that you will require a minimum of 40,000 sq.
ft. for each lot within the subdivision (excluding the
R.O.W.). In addition to this, you will require confirmation
that the existing septic system does not encroach into the
ground water zone. I believe that this will entail
confirming that the bottom of the existing disposal field is
located no closer than 4' to the high water line.
At this time, I plan on running levels from our last test-
hole to the area of the existing disposal field to confirm
the vertical location of the field. This will consist of
assuming a ground elevation of 103.5 feet at the test-hole
(knowing that the water elevation is 3.5 feet below the
surface), and finding the ground elevation at the disposal
field relative to the test-hole area. The distance down to
the bottom of the disposal field will then be subtracted from
the ground elevation. The assumed water elevation of 100
feet will then be subtracted from the relative elevation
found for the bottom of the disposal field to determine the
separation distance.
Please let me know if you approve of this method for
determining the adequacy of the ground water zone, or if

The Environmental Services Division, On-site Services Section,
of the Department of Health and Human Services has reviewed
the following cases and has these comments:
S-9163:
Lots 1, 2, 3 Bakic Subdivision
The soil tests submitted for this plat are
unacceptable as they are improperly sited. We
will require adequate soil test reports on both
Lots 2 and 3. The soil test must include water
monitoring through a high water period. We
require information on water availability in this
area. The reserved area for Lots 2 and 3 must
be designated on the final plat; well sites for
these lots must also be shown. We are concerned
about the proposed access to Lot 2; the driveway
may not encroach on the reserved area. The 100
foot protective setback to the stream must be
shown on the final plat.

yard variance from the Board of Examiners and Appeals prior to

I would like to thank you for taking the time to meet with both
Steve Chronic and I to discuss the actions needed for your
approval of Bakic Subdivision. Following is a brief discussion of
what I believe the outcome of this meeting to have been.
After reviewing the new lay-out of lot 3, you said that the
previous problems with the driveway being located over the reserve
area were no longer a concern. A plan for water monitoring
through a high water period was established which will require us
to monitor the current test hole sites once a month up until April
(or we notice a rise in the water level). At that time the
monitoring should be increased to weekly until we begin to record
large changes in the water level at which time the monitoring
should occur daily until the water level begins to drop off.
Along with the water monitoring, we will check to see that the
septic system existing on lot 1 d~es not sit down in the h-f-g~'~

through our monitoring of the existing test holes on proposed lots
2 and 3.

It was then agreed that we should dig at least one more test ho~
in the reserved area of lot 2 If the material in this hole is
found to resemble the two previous holes and there is no physical
evidence to the contrary, then no more holes will be required.
The reserved areas will De placed on the final plat, with a note
stating that no building or foundation may be placed in~~ ....

Based on these changes and considerations, you have agreed to
approve the preliminary plat. We understood you would be sending a
revised memo to the Department of Economic Development and
Planning, stating your conditional preliminary approval of this
plat.

area of proposed Bakic Subdivision. This information was taken
from your files during the month of December and should answer any
questions you may have concerning the availability of water in
this area.
The well records for Chalet Terrace Subdivision are for a
community well which serves lots 2 through 10. This well is shown
to be able to supply 2.0 gallons per minute per household using
the well. The well certificates for lot 2 of World Top Acres and
lot 2B of Upper Chinook Subdivision show the wells being capable
of supplying up to 20 gallons per minute, and 10 gallons per
minute respectively.

This letter is in responce to your concerns regarding the proposed
design of Bakic Subdivision. During our meeting on December 5,
1991, I believe we cleared up some of the questions that you had
on the soil test sitings.
The confusion as to the proper location of these test areas
appears to have come from incorrect off-set distances being shown
on the soils logs from Hillside Drive and Alps Avenue to the soil
test sites. The test site shown to be 570' from Hillside and 220'
from Alps should show distances of 540' from Hillside and 190'
from Alps. The test site shown to be 530' from Hillside and 290'
from Alps should show distances of 500' from Hillside and 260'
from Alps. These distances reflect the location of the soil test
sites relative to the proposed property lines (see attached).
As for your other concerns, I would like to meet with you at your
earliest convenience to discuss our proposed modification plans
and possible options.

The required 30' dedication of R.O.W. for Alps Avenue for
subdividing this property would create the following
conditions;

The existing garage would fall approximately 7' within
the 25' minimum required secondary front yard setback.
lb.
The existing wellhouse would fall approximately 5'
within the 25' minimum required sideyard setback.
The owners right to subdivide the existing 5 acre parcel
into three smaller parcels in accordance with current
land use designation.
The proposed subdivision design follows A.M.C. Title 21
requirements for subdivision design and A.M.C. Chapter
15.65 for waste water disposal. AMC 21.80.010 requires
"the dedication of a half street width when the other
half of the street has been dedicated". For this
proposed subdivision, the required dedication for half a
street width is 30'. This would then place the existing
garage approximately 7' within the 25' minimum required
secondary front yard setback.
3b.
AMC 21.040.080's minimum size requirements for a
single-family lot, combined with AMC Chapter 15.65's
requirements for waste disposal areas, and MOA's Traffic
Engineering departments not allowing direct vehicle
access onto Hillside drive, locks the geometry of lot 3
into the configuration shown on the preliminary plat.
This then places the existing wellhouse on lot 1
approximately 5' within the 25' minimum required
sideyard setback from lot 3.

The existing garage would not interfere with sight
distance along Alps Avenue, or be in any way obstructive
to the users of Alps Ave.
4b.
The portion of lot 3 closest to the existing wellhouse
on lot 1 is not usable for building due to the nearby
creek. In addition to this, the foliage currently
surrounding the wellhouse hides it from view.
The granting of the requested variances will not result
in any additional construction or abandonment of proven
working facilities (i.e. residents potable water
supply).
These proposed variances would not change the current
use of the surrounding properties, or the way in which
the lot to be subdivided is used.
This variance would allow the current 5 acre parcel to
be subdivided into the three parcels displayed on the
preliminary plat of Bakic Subdivision dated October 31,
1991, while allowing the existing residence to keep and
use the garage and wellhouse while approximately 7'
within the 25' minimum required secondary front yard
setback and approximately 5' within the 25' minimum
required side yard setback respectively.
