The upgrade will serve an existing six (6) bedroom house and one (1) bedroom ADU. The existing septic tank and drain field are in failure and will be removed per MOA code. This lot and surrounding lots are served by private wells. Currently there are no wells within 100’ of the proposed installation. 1. Soils: Several test holes were performed on this lot by Alaska Water and Wastewater Consultants, Inc. The soils logs are on file with MOA Onsite Laserfiche, approximate locations are shown on the attached site plan. TH-5 was used for the basis of design for the soil absorption system. Groundwater was not observed during the excavation of the test hole, and bedrock was not encountered. Groundwater was not observed in the test hole monitor tube after 7 days. Based on the results of the percolation test and overall soils appearance an application rate of 3.0 gpd/SF was used for the design of an advanced wastewater treatment system in the area of the test hole. 2. Concrete Septic Tanks: Proposed concrete septic tanks are to be purchased from and manufactured by D&S Concrete. Six (6) inches of rigid insulation shall be placed over the top of each tank with four (4) inches of rigid insulation placed on all four sides of each tank. This insulation is adequate to provide thermal protection for the septic tanks under the driveway. 3. Soil Absorption System Design: See the attached design package. Six (6) inches of rigid insulation shall be placed over the top of the concrete septic tanks with four (4) inches of rigid insulation placed on all four sides of each tank. 4. Surface Water: There is no surface water within 100 feet of the proposed septic tank and drain field. 5. Topography: See attached site plan for area topography. There are no slopes exceeding 25% within 50ft of the proposed drain field. A small Allan block retaining wall is located north of the proposed field along the driveway. Due to the proposed depth of the soil absorption system the distribution pipe is below the depth of the wall, effluent daylighting through the wall is not an issue. 6. Waiver: We are requesting a waiver from the proposed drain field to the south property line to a distance of 1.0 feet. The south property line parallels a 60’ ROW. There are no wells within 100’ of the proposed drain field. Granting this waiver will not pose a risk to public health or the environment. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastew eatment System (AWWTS), described as Advant'.x located at (legal description) Bear Valley B4 L4 2. Maintenance. Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term -of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. (rev. 05/18/2018) Owner acknowledges that the Municipality may request records of maintenance and repairs from the manufacturer's representative or maintenance provider. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14*11,010, Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. �It Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shalt be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement, 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. GENERAL: The existing 4 bedroom home is served by a private septic system and a private well. The existing septic system is in a state of failure and must be upgraded. The lot is plagued with poor soils, shallow groundwater (7.5'), and the presence of the surface water. The area near the top of the lot has a considerable amount of fill on it (the existing tank is 10 feet deep), making it an impractical place to install a new drainfield. Given these site constraints, we are proposing to install the Recirculating Upflow ]Filter (RUF) system. 2. SOIL CONDITIONS: Four test holes were excavated, two on September 2, 1998 and two on September 10, 1998. Test holes #1, #2, and #3 were found to be unsuitable for an on-site septic system. We are proposing to use the area around test hole #4 for the drainfield site. In test hole #4, the soil below the organics is a ML material (dense silt with a few gravel pockets & some silty sand lenses) to a depth of 10.5 feet (bottom of test hole). Groundwater was encountered during the excavation of TH#4 at a depth of 8.0 feet. Two percolation tests were performed in test hole #4 at 2.5-3.0 feet and 4.045 feet. The percolation rates were 2.6 minutes/inch and 60 minutes/inch (see attached soil logs). 3. DRAINFIELD: The intent is to install a Recirculating Upflow Filter (RUF) system that will allow the use of a small drainfield in the area around a 30 foot radius of the test hole. The size of the drainfield will be based upon the previously established criteria for the RUF systems, which dictates that soils percolating between 1 & 30 minutes/inch have an allowable application rate of 4 gpd/ft2, and soils percolating between 30 & 60 minutes/inch have an allowable application rate of 2 gpd/ft2. Given the soil ratings of 2.6 and 60 minutes/inch, a 2 gpd/ft2 application rate would apply. We are proposing to install a two 5 foot wide drainfields that are 25 feet long each (50 feet total length) and has an effective depth of 2.0 feet (reduction factor = 0.70). This corresponds to an absorption area of 357 ft2, or an application rate of 1.68 gpd/ft2 (assuming 600 gpd total flow). 4. ORENCO PACKAGE SYSTEM: The STEP tank with the trickling and upflow filter will be manufactured by Anchorage Tank & Welding to meet the latest design criteria established by Orenco Systems, Inc. The point of contact at Anchorage Tank is Lowell McNutt. As with their standard STEP tank, it is equipped with a high water alarm per M.O.A requirements. S. SURFACE WATER: There is surface water (ponding water) to the north of test hole #4. A 100 feet setback will be flagged by a registered land surveyor prior to construction to insure separation distances will be met. 6. TOPOGRAPHY: As can be seen on the attached topography site plan, the lot slopes from approximately south/southeast to north/northwest at a grade of approximately 15-20%. In short, there are no slope concerns. 7. CLOSING: I am open to any suggestions from your department that would be an improvement to the proposed system. The investigation complied with those proce- dures required by the Municipality of Anchorage, Department of Health and Environmental Prbtection. This investigation, which was accomplished on August 9, 1977, consisted of three test holes, one at each location, drilled to depths of 18.5 to 20.0 feet below the existing ground surface. The test holes were sited according to your instructions. Their locations and soils logs are shown in attached Drawings A-01, A-02, and A-03. Samples were taken at the depths shown on the soils logs and the samples will be held in storage at our lab for approximately six months. Drilling was accompli- shed with a rotary drill rig using continuous -flight solid -stem auger with an outside diameter of 6 inches. All material brought to the surface by the.augers was continuously monitored by an experienced engineering geologist. The topography at each drilling site is moderately sloping to the north. At the time of the investigation the sites had original vegetation consisting of alders, spruce and hemlock. The top of each test hole was located at original ground surface. The soils encountered in the test holes are shown in the test hole logs in Drawings A-01, A-02, and A-03. The symbols used in these drawings are explained in Drawings B-01 and B-02. Each log displays specific conditions encountered at the test location. However, subsurface condi- tions may vary in other parts of the lots without any apparent surficial evidence of the change. Groundwater was encountered in Test Hole No. 1 I (Lot 4, Block 4) at an approximate depth of 18 feet. Groundwater was not encountered in Test Holes No. 2 and No. 3. Bedrock was not encountered. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. . r C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AW WTS that were included in the original design which would allow the AW WTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWNVTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of -7 A •:0 ($(:> .00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AW\VTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS ,vithout a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWVI TS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the oHmer's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. O,Amer agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Ovmer's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the O vner's AWWTS Operating Permit is: C. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment.
