Thi.~ variance is for:
Title 21 Section 21.80.330 Design--Lot frontage and access.
a. "all lots shall have frontage on a publicly dedicated street."
A. The existing situation is:
Existing Lot 2 Block 1, Benbeeca Subdivision currently contains the one residence
sited in the middle of the lot towards the street and a barn. The owner wishes to
subdivide the 199,300+/- square foot lot into three lots, one is for his mother. The
existing lot gains access off Reese Road (a municipal street). The land use zone is
R-7 (20,000 s.f. lot min'., 120' width). There is no municipal water and sewer in the
road ROW, this lot and surrounding lots are served by private well and septic. Lots
in this area are typically a minimum of 40,000 square feet due to the need for private
well and septic systems.
B. The granting of this petition would permit:
The owner to subdivide one lot into three with access off a private access easement.
The private access easement is to be owned and maintained by the property owners
under special covenants to be conveyed with the property and will not be transferred
to the municipality now or in the future.
That there are such special circumstances or conditions affecting said property that
the strict application of the provisions of this ordinance would clearly be
impractical, unreasonable, or undesirable to the general public. These special
cireum~_gtanees or conditions are:
Given the length of road to reach the interior block lots and the dimensions
for a dedicated street ROW with a cul de sac, the land area impact to serve
only two lots is clearly impraeficle.
Subdividing the land into 2 or 3 lots with frontage on Reese Road would
create long lots which fall outside the length to width ratio of 3 to 1. The
existing house and well would be impacted.

That the granting of the specified variance will not be detrimental to the public
welfare or injurious to other property in the area in which said property is situated
for the following reasons:

The 30' width private access easement is to be owned and maintained by the
property owners under special covenants to be conveyed with the property and
will not be transferred to the municipality now or in the future.
The proposed lot size and use is compatible to the surrounding residential
lots. The addition of two residential lots will not cause a significant impact
to traffic on Reese Road.
That such variance will not have the effect of nullifying the intent and purpose of
this ordinance or the Comprehensive Plan of the Municipality for the following
reasons:
The residential density created by this subdivisions and variance far exceed the
underlying zoning district. The access to these lots meets Title 21 and the goals of
the comprehensive plan in providing access from a dedicated ROW similarly to a flag
lot configuration but with the addition of special covenants, conveyed with the
property 'which stipulate its private ownership and private maintenance
responsibilities and the language that the easement will not be transferred to the
municipality now or in the future.
The above listed special conditions or circumstances do not result from the action
of the applicant and such conditions or circumCmnces do not merely constitute a
pecuniary (monetary) hardship or inconvenience in that:
The overall length and width of the block which this parcel resides within and the
need for private water and sewer together with the width and length of this
remaining interior residential block is not conducive to the typical double width lot
layout. This configuration allows for the highest and best use of this land while
maintaining the existing residential house and barn structure.
