On Thursday afternoon, October 13, 1983, Mr. Rowland came in for
a permit for a sewer system. He completed the application form
at the counter and indicated he wanted a permit for a two bedroom
single family dwelling. Since the minimum septic tank size is
1000 gallons (good for up to three bedrooms), I urged him to size
the absorption area accordingly. He agreed to a permit for three
bedrooms since he had gravel soils.
At no time did Mr. Rowland mention a trailer, or that this
installation was not for the dwelling shown on the soils log.
The permit was written for a new installation, not an upgrade.
There was no mention of a public well either.
Mr. Rowland indicated he "had to have a permit" that day as the
work was already in progress. He told me it would be engineer
inspected and in fact his engineer was on the site then. The
normal inspection fee was waived for this reason. I assumed the
installation would be handled properly since an engineer was
supervising. Engineers who regularly do these inspections have
been provided with written instructions on installation
requirements.
On Monday, October 17, Corey Willis informed me that a four-plex
was on the property and that a trailer was being moved in. I
suggested he immediately revoke the permit (in writing) and hand
deliver the notice to Mr. Rowland.

Dear Mr. Rowland:
The permit issued to you on October 13, 1983, for on-site
installation is void. After researching the files, we find that
there is already a system for a 4-plex and not enough lot size to
allow the additional 3 bedroom system to meet all our codes.
Also the installation appears to be closer to a cut bank than
code allows.
This sewer system must be abandoned and no use made as it is
unapproved by this department. Failure to comply with this
notice will result in legal action.
The file search also revealed that you have recently installed
on on-site system for your 4-plex. You need to get a permit for
that installation and submit the engineer as-builts for the
4-plex's on-site system.
Please contact this office regarding compliance.
Sincerely,
Cory Willis, R.S.
