The septic as-built which we prepared was developed with the aid of an as-built survey which showed the house angled slightly different than what actually exists. Therefore, as shown by the new as-built performed by Robert E. Johns, Jr. and Associates, approximately 14 feet of leach field is located within the right-of-way. We propose to relocate approximately 24 feet of leach field trench onto the property as shown by the attached sketch. We wish to perform this upgrade work under the existing Permit ~ SW910177 and submit a revised septic as-built once the work has been completed. An adequacy test was performed on ~he existing septic syst~ on May 16, 1991. The resul~ were not satisfactory. A test hole was excavated, a p~rcolation ~ p~rfo~ed, and an upgrade designed. The existing well was found to be located approximat~y 80 ft. to a neighboring cesspool. See Exhibit A. On September 28, 1976, the Municipality approved the on-site sewage disposal system. See Exhibit B. At the time the permit was lssued and approved, the well had not been installed. On March 31, 1981, the Municipality of Anchorage, Department of Health and Human Services (DHHS) issued the~ i an on-site sewer permit to Bruce Elder for an upgrade of system. See Exhibit C. Both permits specifically required the applicant to certify that he was familiar with the requirements for of on-site sewers and wells as set forth by the Municipality Anchorage. On May 4, 1981, Mr. Elder received approval for an individual water and sewer facilities with the upgrade of the system. At that time, DHHS only required that waste water systems have an adequacy test and a bacteria test. DHHS did not require that separation distance be inspected. During 1991, the current owners Patricia and Eugene Mangiardi realized that there was not the correct separation distance between the septic system and well when they tried to sell their house. See Exhibit D. The plaintiff drilled a new well on their property in 1991. On September 12, 1991, DHHS approved the new on-site waste water disposal system. See Exhibit E. Patricia Mangiardi, the plaintiff, is now seeking $6,100 because the IMunicipality failed to construct a well at 14800 LocLoman Lane. ARGUMENT Ak. R. Civ. FiEMORANDUM IN SUPPORT OF MOTION FOR SUMMARY JUDGMENT THAT CLAIM IS BARRED BY AS 9.65. 070 Page 2 MUNICIPALITY OF ANCHORAGE The Municipality of Anchorage is entitled to summary judgment as a matter of law because the plaintiff's claim is barred under AS 9.65.070(d). AS 9.65.070(d) states in part: (d) No action for damages may be brought against the Municipality or any of its agents, officers or employees if the claim (1) is based on a failure of the Municipality, or its agents, officers or employees, when the Municipality is neither owner nor lessee of the property involved, (A) to inspect property for violation of any statute, regulation, or ordinance or a hazard to health or safety; (B) to discover a ;violation of any statute, regulation, or ordinance, or a hazard to health or safety if an inspection of property is made. AS 9.65.070(e)(1) states: The Municipality has the meaning given in AS 01.10.060 and includes a public corporation established by a Municipality. AS 1.10.060 states: The Municipality means a political subdivision incorporated under the laws of the state that is a home rule or general law city, and home ii rule or general or borough or unified .! Municipality. The Municipality of Anchorage is a home rule Municipality that meets the definition in AS 01.10.060. Therefore, AS 09.65.070 ~) In the present case, the il applies to the Municipality of Anchorage. plaintiff is claiming that the Municipality approved a well in 1981 MEMORANDUM IN SUPPORT OF MOTION FOR SUM14ARY JUDGMENT THAT CLAIM IS BARRED BY AS 9.65.070 Page 3 MUNICIPALITY OF ANCHORAGE without detecting a violation of the ordinance, specifically AMC 15.65.050(A). See Exhibit D. The Municipality is not the owner or lessee of the property. AMC 15.65.050(A)(4) requires that a septic tank must be located no less than the separation distance required by 18 AAC 72 from water supply wells. A person who builds or installs a sewer, private sewer line, waste water disposal or waste water treatment must comply with the minimum separation distance set forth in 18 AAC 17.015. Ms. Mangiardi is contending that the Municipality failed to inspect for a violation of 15.65.050(A)(4) and failed to discover a violation of 15.65.050(A)(4) and/or 18 AAC 17.015. See Exhibit D. Therefore, this is the type of claim which is barred under AS 9.65.070(d) and the plaintiff is not entitled to proceed against the Municipality. In J & L Diversified Enterprises, Inc. v. Anchoraqe, 736 I P.2d 349, 351 (Alaska 1987), the court held that the plain language of the statute precludes actions like these. The court stated that ii the purpose of AS 9.65.070(d) is to protect the public treasury by !!barring actions seeking money damages for injuries alleged to be i the result of municipal licensing, permitting, entitlement and zoning procedures and decisions. ~. at 352. The statute immunizes municipalities and their employees from actions for damages based on these procedures. In Gates v. City of Tenahee Springs., 822 P.2d 455, 459 (Alaska 1991), the city removed the MEMORANDUM IN SUPPORT OF MOTION FOR SUI~4ARY JUDGMENT THAT CLAIM IS BARRED BY AS 9.65.070 Page 4 plaintiff's fence from the right-of-way!and revoked Gates' permit. The court held that these decisions were immunized under the plain language of AS 09.65.070(d)(3). The court continues to follow the logic from J & L Diversified Enterprises, Inc., and gives the Municipality immunity from actions based on permitting. In 1981, the Municipality only required an inspection of the property for adequacy of the septic system and for bacteria. The property was not inspected for separation distances. The plaintiff seeks to receive damages from the Municipality's failure to detect a separation distance violation or failure to inspect the separation distances. Therefore, a claim based on the Municipality's failure to detect a violation of the separation distances is barred under AS 9.65.070(!d)(1)(A) and (B).
