Tim & Larry Jones 2809 E. 52nd Avenue Anchorage, Alaska 99503 Subject: Lot 72, Campbell Creek Park Subdivision, Section 33, T. 13N., R.3W., S.M. Dear Messrs. Jones The Anchorage District Office (ADO) of the Department of Environmental Conservation has been informed by the Municipality of Anchorage (MOA), Department of Health and Human Services (DHHS) of the probability of a public water system operating on the above- referenced property without the required operation approval (18 Alaska Administrative Code (AAC) 80.100). Results of DHHS October 1990 sampling program reveals that the surface water in the area could be contaminated by improperly treated human wastewater. Aisc, from the information supplied by DHHS, it appears that there are two living units (two single family residences) on Lot 72 being served by one source well. Any well serving more than a single family residence but fewer than 25 persons (assuming two persons per bedroom) is classified as a Class C Public Water System Source Well and requires compliance with the Alaska Drinking Water Regulations, 18 AAC 80.100 (copy enclosed). Upon a review of the Department files, we are unable to locate any information on this existing Class C Public Water System. If you have any information concerning any prior approvals for this system, please assist us by providing this information. If on the otherhand, this system has never received an operational approval, you will need to obtain the services of a professional engineering firm to verify that the installation of the existing public water system presently meets current regulations or met the appropriate regulations at the time of installation. In closing, I wish to emphasize the need for your prompt response to this request due to the possible threat to public health in your neighborhood. We are requesting that the above-requested information be submitted to this Department by May 13, 1991. If your are unable to comply by this date, please contact me to discuss a schedule which can be workable to all parties. Thank you for your cooperation with this Department. Tim & Larry Jones: On November 28, 1990 this office issued you a Notice of Violation for the operation of an on-site wastewater disposal system which is not in compliance with AMC 15.65. You were given the opportunity to either connect to public sewer or upgrade your deficient on-site system. At the request of area residents, the Anchorage Water and Wastewafer Utility (AWWU) developed a proposed plan and cost estimate to bring public sewer to your neighborhood. The proposed sewer exfension would have served your property. However, on March 19 AWWU calculated all ballots and determined that the neighborhood does not support extension of public sewer. Since public sewer will not be an option for your lot, the on-site system must be brought into compliance with municipal ordinance. Accordingly, this letter will serve as your final Notice of Violation. By May 17, 1991 you must provide to this office, an application for a permit to upgrade your on-site wastewater disposal system. The application must be prepared and submitted by a licensed civil engineer in accordance with requirements of AMC 15.65. By May 31, 1991 construction of the upgraded system must be completed and an as-built inspection report prepared and submitted to this office by a licensed civil engineer. The citation includes a mandatory court appearance.
