Maintenance. Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. ' It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. caner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. I Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. Health & Human Services Re: Intermittent Sand Filter Project Lot 140, T14N R2W Section 25 Dear Mr. Smith: We have noticed problems with the water quantity meter that needs to be addressed as we are getting unreliable data: 1. The meter remote sensor has been jogged so that it reads a one at the extreme left. Initially this was ignored, however it appears that the digit counter is not operating properly over the entire range. We would like authorization to replace the remote meter head with the unit left over from Lot 8 Shenandoah Hills. If this doesn't work, we will ask Tweed Excavating to replace the sensor and provide us with the date and reading on the actual meter when replaced. Our services are estimated to cost $100 to swap the meters. 2. The water meter turbine has "silted up" due to poor water quality from the on-site well. In order to receive reliable data we request you authorize a change order to place a water filter in-line prior to this meter. This should be a rust/sediment type filter with bypass and shut-off capabilities and five filter replacements. Estimated cost of materials $65, installation by a contractor, $120. SPECIAL PROVISIONS: RECEIVED BY: DATE: ISSUED BY• DATE: • PROPERTY OWNER AGREEMENT INTERMITTENT SAND FILTER WASTEWATER DISPOSAL SYSTEM This agreement, dated FE/Mt/FRY g 1993, is made between the Municipality of Anchorage Department of Health and Human Services (DHHS) and the property owner(s) of T15N R2W Section 25 Lot 140, S.M. The agreement is made for the purpose of designing, constructing and testing an intermittent sand filter on-site wastewater disposal system on the subject property. The subject property is currently served by a holding tank and the property owners desire an alternative to the holding tank system. The property owner(s) agree to the following: 1. The property owner(s) will allow DHHS and its representatives access to the subject property as required to design, construct and test the wastewater system. The property owner(s) acknowledge that the proposed wastewater system may or may not be successful and agree to indemnify, defend, save and hold the Municipality harmless from any claims, lawsuits or liability, including attorney's fees and costs, allegedly arising out of loss, damage or injury to persons or property occurring during the design, construction, test and uses of said wastewater system. 2. The property owner(s) will reimburse DHHS a total of $10,000 or 75% of the construction costs, whichever is less, for the new system if the system receives final operating approval from DHHS. Reimbursement will be made within 6 months of notification of such approval. If the property owner(s) fail to make payment as required herein they expressly agree that any remaining sum owing from due date shall bear interest at the rate of 10.5% per annum and property owner(s) shall pay actual costs, including actual attorney fees required to enforce the provisions and payments hereof. 3. If the system does not receive final operating approval from DHHS, the property owner(s) will be required to revert back to a holding tank as a means of on-site wastewater disposal within 60 days of being notified in writing to do so by DHHS. DHHS agrees to the following: 1. We understand that our plans have been reviewed by Orenco Systems and yourself and this draft incorporates those review comments. Included are soil logs, site plans, profile drawings, sand filter drawings, design calculations, special provisions to MASS, and supplemental provisions. We have not provided the pumping cycle intervals to the sand filter, but the control panel is specified to allow almost any configuration. An air pump and heat addition device have not been specified as this is still being developed at Orenco, and will have to be added at a later date. The air line will be provided under this contract to allow for quick connection of a device in the home. This can be done by a separate contract. The submitted plans call for a waiver of 75' well to septic tank/lift station from the required 100', and a waiver of 2' of required 4' to ground water table to clarified effluent discharge.
