Site was inspected 9/28/82. Two cleanouts located near
the building both on line leading into 2,000 gallon
tank. Two 4" access ports located on tank. Depth to
water is 7.0', depth to bottom of tank is 11 8' The
tank is located south of the building under a paved
drive.
On November 1, water was introduced into the first
chamber of the septic tank at a rate of 7.5 gpm for
6 hours. 2,700 gallons were introduced with no rise
in the tank fluid level. No back-up was noted in
either chamber, the cleanouts, or basement. This

Notes
system meets the Municipal Requirements for a 9 bedroom
dwelling.
No observation sump or leach field cleanout were found.
A 3' diameter 10" deep depression was found approximately
8' north of the driveway and 40' east of Jewel Lake Road.
6" of snow covered the ground during the investigation.
The system was last approved 6/4/79 when the current owner
purchased the building.
0w~er will have the septic tank pumped prior to application
for approval.

In reply to your questions on page two of your letter dated
July 19~ 1977 to this department:
(1) The existing septic system on th~ lot serving the
fourplex is not adeq~/ate and would not be approved
with a p~ping schedule.
(2) Expansion of the complex would reqp/ire a soil test,
per, it and additional tankage.
(3) My letter stipulates additional sewer facilities for the
existing fourplex~ if this department approval is to be
given on the septic system.
(4) My letter to you dated February 28, 1977~ stated
se~e se~er system was inadequate° Also, note reference
was made to a pumaping rate of six(6) times a year per
your statement.
To further e~pand upon your letter~ you~ requested an evaluation
for yourself of the sev;age facilities for existing and possible
future expansion of th~ apartment complex.
An inad~quate septic ~ystem that is properly maintained to prevent
overflow is not in violation~ however, obviously would not meet
fuB~onal critera for an approved, septic absorption system.

Dear Mr. Buchholz:
I am writing to request clarification of your enclosed February 28, 1977 letter to
me regarding the results of the pert test that was run on the septic system on subject
property on February 24 - 25, 1977.
Your February 28, 1977 letter confirmed the discussions we had immediately prior to,
and following the completion of the test. You also reconfirmed the intent of your
letter during our telephone discussion approximately two weeks ago.
Mrs. Tyner and I were considering the sale of subject property to our very close
friends, Mr. and Mrs. D. A. Silva, and ~we!~>wanted?,!! to be certain that we were not
selling them a potential problem. I specifically requested the following from your
test:
1. Was the existing septic system adequate for the 4 plex based on the current
pumping schedule of every second month.
2. What would be required to expand the 4 plex with 9 bedrooms to a total of
7 units with 15 bedrooms.
The following was my understanding of the situation during our discussion immediately
following the test, and this was confirmed, in my opinion, by your February 28, 1977
letter and again by our telephone discussion in late June 1977.
The existing septic system was adequate based on the pumping rate of six
times per year, and that there were no further requirements for the existing
facility.
An expansion of the complex to 7 units would require a soils analysis and
a permit stating the design criteria, plus additional tankage.
We subsequently listed and sold the property to the Silvas with a March 31, 1977
closing. A copy of your letter was provided to the Silvas. The listing stated
"seller states that the Septic System is currently pumped on an every 2nd month basis
and that the system is performing adequately for the existing units at the time of
closing".
Mr. and Mrs. Silva listed the property on May l, 1977, and closed their sale on
June 15, 1977.
The new buyers immediately encountered problems resulting in the replacement of
the entire system. They also obtained a copy of your enclosed February 28, 1977
letter to me, and made the following erroneous interpretation: "as you can see from
the enclosed letter the system was known to be inadequate to Mr. Tyner at least
in February 1977"

There were three new families in the building during the Silva's ownership, and
several plastic bags and handy wipes were found in the system by Anchorage Cesspool
Pumping. These were apparently blocking the line to the cesspool. This was certainly
unfortunate, but could not have been anticipated during our February 1977 perc test.
I am also enclosing a summary reflecting the history of the septic system during our
ownership and a copy of a statement prepared by Anchorage Cesspool Pumping confirming
our two month pumping cycle.
I would appreciate your reconfirming the following from your February 28, 1977 letter:
The Septic System was adequate for the existing 4 plex based on the current
pumping schedule of every second month. I understand that this did not
imply that the system was "officially approved", as this would require a
system with no pumping whatsoever.
2. An expansion of the complex would require a soils analysis and a permit
stating the design criteria plus additional tankage.
3. That your letter did not stipulate a requirement for additional facilities
for the existing four units.
4. That your letter did not indicate that I had knowledge in February 1977
that the system was inadequate.
We realize that you are on a very busy schedule. Your reply to these four items
would be greatly appreciated and extremely helpful to assist us in reaching an
equitable settlement with the Silvas and the new buyers.
