Chapter 21 of the Anchorage Municipal Code of Ordinances. I understand that payment of the basic vacation fee is nonrefundable and is to cover the costs
sssociated with processing this application, that it does not assure approval of the vacation. I also understand that additional fees may be assr sed if the
Municipalitys cost to process this application exceed the basic fee. I further understand that assigned head:~g dates are tentative and may have to be
postponed by Planning Staff. Platting 8card. Planning Commission. or the As.~em~ly due to administrative reasons.

The Anchorage Telephone utility (ATU) has no objection to the
encroachment of the corner of the garage into a platted easement located
on Lot 6, Block 1, Huffman Hills North, Addition No. 3, as depicted on
the as-built drawing attached.
Acceptance and use of this letter of non-objection by yourself, your
heirs, your assigns, or your successors, will constitute agreement to the
following stipulations:
1. ATU will be held harmless, now and forever, for any damages or
inju~y to any person or property as a result of this
encroachment.
2. Any ATU facility damaged or destroyed as a result of this
encroachment will be repaired at no cost to ATU.
3. Any costs incurred by ATU for special construction
necessitated by t~is encroachment will be borne by the
property owner.
4. All applicable safety code regulations will be observed and
maintained.
5. This letter of non-objection will in no way preclude ATU from
full use and enjoyment of its right~ within any portion of its
right-of-way.

Dear Mr. Weaver:
Chugach Electric Association, Inc. (Chugach)
to the vacation of that portion of the platted
Telecommunication and Electric easement into which the
building encroaches on the southeast side of the above
referenced property, as shown on the enclosed As-Built
by Gastaldi Land Surveying dated August 31, 1993.
This non-objection is given on the conditions that a copy of
the as-built survey showing the encroachment is recorded with
the utility easement vacation resolution, and copies of the
recorded resolution and as-built survey are provided to
Chugach.
