SEPARATION DISTANCE WAIVER TO SURFACE WATERS: The holding tank is located approximately 52 feet away from the drainage ditch located parallel to Romania Drive. It had runnin9 water in it on) 10/28/95. In addition, there is a buried stream (in a/ culvert) somewhere along the "east" ~ro~ert,~ lin- -~ .... g eater than 30 feet from the holding tank, per the HAA · ssued in August 1990. Due to the fact that the culvert is buried, it is not possible to verify the separation distance. Per the 1990 HAA (approved by M.0.A) a waiver of the required separation distance (75 feet, holding tank to surface water) was granted for 30 feet. Based upon what I could visually see, the system is in compliance with this waiver. 3. STRUCTURAL INTEGRITY OF HOLDING TANKS: Per the as-built records, the holding tank system consists of two 1000 gallon septic tanks, one installed in 1985 and the other installed in 1988. Because of their age (10 years or less) they were not physically exposed and inspected for structural integrity. I did remove the caps to listen for infiltration, and did not hear any. Furthermore, the homeowners did not inform me they had any problems associated with infiltration, such as increased pumping frequency. The engineer makes no warranty regarding the future life of these tanks. If you have any question, please call me a 337-6179. Box 196639 Anchorage, Alaska 99519 Subject: Lot 18, Blk 8, Paradise Valley Gentlemen: We have received notice from Robert Shafer of S & S Engineering that appropriate corrections have been made to the culverting on the above lot. I have also inspected that work and find its completion has brought the sewer system back into compliance with state and municipal code. I am closing my complaint case on this site. The previously issued waivers to the culvert and the stream in the ditch on Romania are hereby reinstated. I have also approved and issued the Health Authority Certificate today. During a routine field check 6n an adjacent property, I noticed that conditions on Lot 18 have changed substantially. The small surface flow is still present. It is not possible to know if the small surface stream actually disappears into the ground as was the case during the earlier waiver application. However, at a point immediately east of the cleanouts for the holding tanks there is an eruption of water from the ground. This flow is estimated to exceed 5 g.p.m., and has eroded the bank as it drops into the road ditch. It appears that a previously installed underground drain pipe has ruptured or separated. As measured, this flow is 21 feet from the cleanouts on the holding tank. This letter will serve as your official Notice of Violation for the sewer system on Lot 18. As the owner of record, F.D.I.C. is responsible to see that this system is brought into compliance within fourteen (14) days. In addition, the previously signed Health Authority Approval is hereby revoked. To be specific, a small stream traverses the east property line and is approximately 30 feet from an existing septic tank which has been converted to a holding tank along with the installation of an additional 1000 gallon septic tank. In addition, a horizontal separation distance of 48 feet exists between the holding tank and the road barrow ditch along Romania. This ditch has been determined by the State of Alaska, Department of Environmental Conservation (DEC) to constitute a stream. The stream which traverses the east property line is approximately 30 feet vertical in elevation above the holding tank where it enters the property and disappears into the ground at a point where it is still approximately 5 feet vertical in elevation above the holding tank. While the barrow ditch stream is at approximately the same elevation as the top of the holding tank. Both the existing septic tank and the new tank have been made water tight. This was verified by us prior to backfilling. There is no other location suitable for this holding tank without encroaching upon the separation of the private well. It is our opinion that there is no possibility for the surface water sources to be polluted by this holding tank installation. The obiect of the meeting was to find a mutualIy agreeable method of bringing the house construction and the on-site sewer system construction into compliance with MunicipaI and State codes in order to obtain a Certificate of Occupancy and finally a Health Authority Certificate. After discussion, it was agreed that the following steps wltl be taken: The concept for the capturing of the stream and subsequent diversion along the east property iine was approved, pending final plans. S & S Engineering will provide an appropriate design for culverting the stream by the middle of next week. This design will be reviewed by DHHS and Public Works. Following approval of the design, DHHS will review and write requested waivers to the stream; the asbuilt will then be accepted. Installation will occur. As-built of the installation will be submitted by the engineer to PW and BHHS. 5. The HAA will be processed. The complaint was investigated (with the inspecting engineer present) and found valid; moreover, the controversial stream was in fact flowing on Lot 18. After many discussions, this department funded an engineering study of portions of Blocks 8 and 9 which clea~ly~showed the natural stream bed to flow across Lot 18...: Late~;.the stream appeared to have been re-routed across Lot 19. Still later, Chugach Electric installers came in and created a ditch aiong the north side of Lots 18, 19 and 20, and the water then flowed in this ditch. One culvert was removed from. Romania in front of Lot 18; a new culvert was installed acros:s Austria at Romania (Norm Hudec wrote this permit). The net effect was that two streams (under State regulations) were present. As a result Lot 19 was converted to a holding tank. Ne have tried unsuccessfully to work with Mr. Senkins and Mr. Hensley to bring their system into compliance. About two years ago a Public Norks permit was issued flor culverting in the roadway in front of their lot. Unfortunately, Public Norks issued the permit prematurely; subsequent to this the instalIation was bungled and the culverting was never properly completed. Ne have processed a permit for Mr. Oenkins to install a holding tank; we are currently entertaining an application from his engineer to approve a waiver to a stream, which will make his new holding tank legal. One state approved method of meeting separation distances is to solid culvert surface water. His engineer is suggesting that a solid culvert be installed from the north of his property to the ditch on Romania. This department will concur with that solution since it will capture the water (if properly designed and installed) and will allow a waiver to be written.. Page 2 Paradise Valley Under no circumstances will this department support the return of water to the ditch behind these lots. Putting water there has created a problem for Lot 19, and places the sewer system on Lot i out of compliance with the wastewater code as the system is then within a few feet of the surface water. Ne have already received a report that the system on Lot i is daylighting on occasion, and that creates direct pollution of the surface waters I would suggest that the engineer hired by Mr. Oenkins be allowed to proceed with his stated plan, in coordination with your department. I have one additional concern with your suggested reclassification at this time, Ed. The property owner of Lot 19, immediately west of the subject lot, ended up installing a holding tank because of the stream classification of the ditch. Given the above conditions, some justification is in order to protect the Municipality's credibility prior to any action to change the ditch status. The stream classification for this ditch is, in my opinion, sub- ject to change on a lot-by-lot basis in Paradise Valley. It may also be subject to change for a specific lot'-over a period of time. Note that the reasons for not accepting the work are as follows. The sketch described installation of 240 L.F. of 1/2 CMP. A com- bination of 1/2 and full culvert was actually installed. No attempt was made to ensure alignment with the road bed or an effective grade, with the result that the culvert as installed will not convey water as intended. Note also that the permittee may be subject to the costs of remo- val and reparations work. This may be forestalled by submittal of detailed construction plans to Public Works Engineering by the permittee for approval; and upon approval of those plans, comple- tion of work according to those plans and in conformance with standard workmanlike procedures. Beyond the issue of proper execution lies the larger issue of maintainability. Glaciation in roads and ditches is a fact of life in Paradise Valley Subdivision, and along this portion of Romania Drive in particular. The health agencies involved and the property owners must all be aware that a half-culvert is vulnerable to even the most delicately applied ice-ripping or grading techniques. With this fact acknowledged at the outset, it is unlikely that the South Goldenview Road Board would be willing to take responsibility for assuring the impervious quality of the half-culvert. Therefore, the technical solution could be rendered ineffective in a very short time. Susan Oswalt December 3, 1986 Page 2 Finally, it is not obvious to us in Public works how the installation will aid separation of ditch-borne run-off and possible exfiltration from the property's septic system. Conceptual approval by ADEC and DHHS may attest that such an installation meets the letter of the law, but it is worth con- sidering that the only way to realistically ensure public health in this case is to require a holding tank such as has been require of other nearly property owners. Your engineer must provide this department with assurance that the springs/curtain drain outfalls on Lot 17 are either 100 feet from the system on Lot 18, or obtain a waiver of the separation distance. There will be no fee for this waiver consideration. If Items #1 and #2 are met, then the department will require that the existing 1000 gallon septic tank on this property be converted to a temporary holding tank. Note that this department normally does not allow such a small unit to be used for a holding tank, but will do so in these special circumstances. We will not require an alarm installation, but will require that the end of the tank be capped off in such a fashion so that no effluent may escape. We will also require that a registered engineer inspect .this modification and submit a report to us with the HAA application. The occupants of the house must be informed of the situation and advised to take water conservation measures, including doing laundry in another facility and limiting or eliminating their use of a dishwasher until final resolution of the problem. Page 2 Lot 18, Block 8, Paradise Valley You will need to have your engineer prepare a new HAA application, and include a new water sample. We will not waive fees for the HAA review. The final approval will not be granted until such time as the engineer is able to report that the culvert is in and functioning as designed, and that all necessary waivers have been obtained. The Conditional approval will be valid until a date certain in June (exact date will be coordinated between this department and Public Works). I reiterate what I have said before about this situation: there is absolutely no guarantee that the above steps will resolve Mr. Jenkins' problems with this property. Failing the steps I have outlined above, our fallback position will be to require that a 2000 gallon holding be placed on this property in an appropriate area. There are indications that in fact it may not form a closed conduit. When we discussed the potential installation of a conduit, I noted repeatedly to you and your engineer that prior to acceptance of this remedy, your engineer would be obligated to certify to us that the culvert did in fact collect all the water in the ditch. Pending that certification, I have been holding your request for Health Authority Approval. Inasmuch as Public Works has not approved this installation, and that probably it will need to be reinstalled in the spring, we are unable to grant the HAA at this time. I have disapproved your request and am enclosing a copy of the disapproval. I would suggest that you contact Public Works regarding correcting the situation. We will require a written statement from them upon approval of the culvert, as well as recertification from your engineer (including a request for a waiver) prior to reconsidering the ~AA. Most water flow through the ditch at this time appears to be storm and snow runoff with some possible temporary groundwater coming from recent exacavation work from new construction° However, if in the future upon further investigation it is determined that flow through this ditch may be considered a stream, then all affected property owners will be subject to required state regulatory separation requirements of 100 from their septic systems to the stream and will be required to make corrections, If you have any questions, please contact me at our Anchorage/- Western District Office. When your permit application was submitted by the engineer, it contained a plot plan showing the well in the northeast corner of your lot. Although a change in location is permissable, it may only be done so long as adequate separation distances are maintained. In this case, you failed to keep the well 100 feet from your sewer system. As a result, we are unable to approve your sewer system installation. Anchorage Municipal Code Chapter 15.55.050(A) states that the permit applicant may not drill a well "less than 100 feet from all existing sewer systems." We will not support your request for a State distance waiver inasmuch as the inappropriate well location creates the need for a lot line waiver for a proposed system on Lot 19. Within ten(10) days you must drill a properly located well and abandon the existing well. Failure to accomplish this will result in legal action against you. To understand the following~ definition it is helpful to remember the importance for protecting the q~ality of surface waters in an urbanized cm~Jnity, such as Anchorage. Realizing that any pe_rsistent su~ace water has direct public contact, it · is imperative we protect these waters from contamination. Consequently, we consider %hat any surface water either manmade or natural, ~ich is not directly attributable to a rainfall or snow .melt event will be considered a surface water for purposes of prescribing set back distances from., sources of contamination. Considering the problems with stream pollution in Anchorage, it is important ~ protect all surface water sources feeding the larger streams (Ship, Chester, Campbell, Fish Creeks) to the levels identified for water contact recreation. Public contact with these smaller streams is often unavoidable and therefore the_ir protection is just as important as the major streams. :.
