public sewer cleanout to the private well has been approved. The approved separation
distance is a 74 foot horizontal separation from well to proposed sewer clean-out on
Bailey Drive.
This waiver approval applies to the proposed sewer to private well separation only. Any
future upgrades to the sewer system or changes in proposal will require all separation
distances be met or another approval from this department.

Sewer Clean -Out
Any and all sewer main or Clean -Outs located within 100 feet of the
lot 3 well radius will have pipe joints positively connected by field lock
gaskets. And all pipe connections and joints will be wrapped with
water tight seal. A water tight seal will consist of a layer of
polyethylene encasement material 8 mils thick and conform to
ANSI/AWWA C105 A21.5
Well Data
Unfortunately there is no well log on record for this well. However
there are enough well logs for the area to give a good idea of the soil
strata. Steve Pannone provided a number of soil logs for the waiver
submittal. Most of the well logs seamed to have more or less the
same soil strata. For the purposes of calculating the points according
to the D.E.C. guideline, Rolling Hills Estates Block C Lot 2 well log
was chosen. The proposed sewer line is going to be 6 feet deep.
The soils from the bottom of the sewer line for 61 feet is Gravelly Silt,
then 18 feet of Silty Gravel, thn 11 feet of Sandy Silt, then 7 feet Silty
Gravel, and then 4 feet of water Sand and Gravel. Water samples
were taken and showed the well currently has no nitrates detectable.
Please see permit SW050364. This permit was issued on September
22, 2005 for a well on Rolling Hills Estates Block C Lot 5. The well
was issued by Dan Roth On-site Program Manager with a special
construction technique as a provision. This provision was added to
the permit because these encroachments were anticipated for
multiple lots because of a sewer extension plan west 73r1 up Bailey
Dr.

I am writing to request that a waiver be issued for the construction of a new sewer main in Bailey Street. This request is
for a waiver of the separation distances between a new extension of the sewer line to the existing well on Lot 3, Block
C Rolling Hills S/D.
1. Soils. Typically the soils in this area are poorly graded sands to silty sands. The well on Lot 4 does not have a
log. I have included in this request available well logs from surrounding lots.
2. Waiver Request: The proposed sewer main will connect to an existing manhole in Bailey Street. It will run
north up Bailey Street approximately 100 feet and terminate in a main line clean out. The pipe joints will be positively
connected by the use field lock gaskets. Further, each pipe connection will be wrapped to provide a watertight seal
using material specified in AWWU Design Criteria Manual. The existing manhole currently has all mechanical joints
inside the manhole and is watertight. The proposed clean-out will be watertight with a locking lid. See the attached
plan set. These plans have been submitted to AW WU (on 8/8/06) for review and comments. I request the following
additional waivers: Well to main line clean out — 74 feet
3. Topography: The average topography in the area of the proposed sewer main is approximately two to three
percent sloping to the southeast.
4. Water Analysis: I have performed a water analysis of the well water on this and surrounding lots. The water
results are attached.
The proposed installation will not affect the future development of the surrounding or existing lots. If you have any

These waiver approvals apply to the existing septic system to
well and adjacent pond. Any future upgrade to either will
require all separation distances be met or another approval

By means of this letter I am requesting waivers applicable to Lot 3, Block C,
Rolling Hills Estates, allowing the septic tank to be 86 feet from the well and the
soil absorption trench to be 80 feet from the apparent line of high water and/or 65
feet from the historical high water line on an adjacent pond. Copies of a site plan
and recently conducted soils tests, as well as the driller's log of a nearby well are
enclosed to assist you in your review. I have also prepared an analysis of point
allocation using the D.E.C. waiver analysis guidelines.
No records of the existing system are on file in your office, (the only record
for an adjoining lot is the seepage pit "as -built" for Lot 2). According to the owner,
the well and septic system were installed for a 5 bedroom residence in the late
1960's, before Borough inspections were required. The well is reported to be 95
feet deep, and the particulars can be expected to correspond closely with those
reported on the enclosed well log for Lot 4, Block B, Rolling Hills.
The existing wastewater disposal system appears to consist of a septic tank
of unknown construction, followed by two seepage pits. On June 22, 1989 1
measured the fluid depth in the septic tank to be 65", with the surface 54" below
ground level. The first seepage pit had a fluid depth of 69" with the surface 47"
below ground level, and the second seepage pit had a fluid depth of 112", with the
surface 50" below ground level. The owner and the buyer agreed that they would
prefer to entirely replace this existing septic system, rather than attempt to further
test it in the hopes of obtaining Health Authority Approval.
As is evident from the site plan, there are a number of constraints on the lot,
which impact the ability to install a new soil absorption system fully in compliance
with all Municipal and State regulations. The biggest constraint is the presence of a
small pond, located immediately to the east of the property. This pond is in a
depression approximately 10 feet lower than the generally level terrain of the
adjacent lots. The standpipes of present seepage pits are located 85 feet from the
apparent mean high water level of the pond, but the vegetation indicates that the
historical high water line came within 75 feet of the standpipes. The homeowner
reports that the size of the pond has been diminishing in recent years, since the
installation of storm sewers to serve Sportsman's Point S/D, encompassing the east
side of the pond.
I dug two test holes to assess the potential for contamination of the pond
from a soil absorption system on this lot (see enclosed logs). The subsurface soils
consist primarily of a tan colored sandy silt, with a measured percolation rate of 12
minutes per inch between 6.5 and 7 feet in depth. Test hole #I was dug to a total
depth of 17 feet, which is approximately 7 feet lower than the present pond
surface. No sign of groundwater was encountered during excavation, nor did any
show up in the monitor tube during the ensuing week. Based on this soil test it
appears evident that the pond is not a result of a local high water table, but rather
is simply a result of surface runoff into a low depression, which through siltation
has formed a relatively impermeable bottom containing the water. Thus, there
appears to be no mechanism for effluent from a properly functioning soil
absorption system to find it's way into the pond.
In designing the replacement system I used a 1.5 safety factor on the
measured perc rate to arrive at an adjusted soil rate of 220 square feet per
bedroom. 69 lineal feet of soil absorption trench with the gravel beneath the
perforated pipe extending from 5 feet to 13 feet in depth will provide the
necessary sidewall area. The design provides for 75 feet of trench to compensate
for the angles in the trench, and possible sidewall interference with one of the
existing seepage pits. The configuration is designed to avoid impacting the 100 foot
radii from any of the wells on the adjoining lots. The trenches will extend to within
80 feet of the apparent present high water line and 65 feet of the historical high
water line as determined by the vegetative transition from trees to grasses. Also,
in order to maximize this separation from surface water, it was necessary to
position the near end of the septic tank 86 feet from the well on this lot.
The alternative of relocating the well to the rear of the lot and installing the
septic in the front is not feasible in this case. The house has a daylight basement
with a poured concrete floor, rendering replumbing cost prohibitive, in addition to
the cost of a new well. Also the unknown underground configuration of the
neighboring septic systems would make it difficult to guarantee that the 100 foot
separation from the new well could be maintained.
In support of the waivers, it should be noted that the subsurface soils are
ideal for slow permeability and good soil treatment. From the enclosed well log it
appears that the tan silt stratum extends to 67 feet, and that the static water level
is at 72 feet, once the confining strata are pierced. We will plan to verify the total
depth and static water level of the well on the subject lot, in addition to the well
yield and water quality tests needed for Health Authority Approval, once the
concept of the waivers and replacement system design are approved.

Septic System Replacement Specifications
1. All construction practices and material specifications shall conform with
M.O.A. regulations.
2. The existing septic tank and seepage pits shall be pumped and properly
abandoned by backfilling with clean soil
3. The configuration of the replacement septic system shall be as shown on
the plans, except that minor modifications may be allowed or required by the
engineer conducting the inspections, If contaminated soil is encountered in
excavating for the trenches, the length shall be increased appropriately.
4. Special care shall be taken to maintain the required 100 foot separation
from the wells on the adjoining lots. The septic tank shall be no closer than 86 feet
from the well on this lot, and the ends of the trenches no closer than 65 feet from
the edge of the trees surrounding the pond.
5. A 1500 gallon, two compartment,steel septic tank shall be installed, with
watertight manhole covers and Calder couplings on all pipe connections.
6. The trench shall be excavated to a depth of 13 feet below ground level,
then filled with sewer gravel to a depth of 5 feet below ground level before
placement of the perforated distribution pipe. An additional 6 inches of gravel
shall then be placed around the pipe before installation of the filter fabric and
backfill. Cleanouts and monitor tubes shall be installed as shown on the plans.
7. Three inspections shall be required during construction: (1) initial
stakeout, (2) after the trench is excavated, but before placement of any gravel, and
(3) after the gravel is placed, the septic tank is set, and all pipes are laid and
connected, but before final backfill.

In response to our discussions regarding the waiver I requested on ,July 6
allowing construction of a soil absorption trench on Lot 3, Block C of Rolling Hills
S/D within 80 feet of a small runoff pond, I conducted a profile survey from the
location of the proposed trench out into the deepest part of the pond on July 31,
with the assistance of Dan Roth from your office. I am enclosing a copy of my
original site plan with the approximate location of the profile marked on it, and a
new drawing showing the profile along this cross-section.
Based on this survey information, I have been able to calculate that the
maximum gradient from the proposed horizontal distribution pipe to the bottom of
the loose muck under the pond is downwards at 6.4%, while the gradient from the
bottom of the proposed trench is upwards at 1 %. Given the fact that the soil in the
vicinity of the proposed trench does perc, I see no possibility of effluent from the
trench migrating almost horizontally through the soil to contaminate the pond.
On the date of this survey I also rechecked the monitor tube in test hole #1,
and found that, despite the recent rainy spell, it is still dry to a total depth of 17
feet, which is approximately 5 feet lower than the bottom of the pond. This is
further evidence to me that the pond is simply a cachement basin for surface
runoff from the surrounding lots with a relatively impermeable bottom, and is not
indicative of a localized high groundwater level.
I trust this will alleviate your concerns, and allow you to issue the requested
waivers without requiring the installation of an expensive bentonite dam barrier
between the trench and the pond. Please feel free to give me a call if you have
