Box 196650 Anchorage, Alaska 995191c,16650 Subject: Lot 1, Block 2, Sun Valley S/D Upgrade Permit Gentlemen: My firm recently conducted an adequacy test of the existing seepage bed. We found that the bed absorbed only about 198 gallons in a 24 hour period. As a result we are requesting a permit to upgrade this system. Although the original system was installed to serve a three bedroom dwelling, the dwelling was actually constructed as only a two bedroom. We inspected the dwelling and can confirm that only two bedrooms exist, and there is no potential for additional bedrooms. Therefore we are designing a two bedroom upgrade. Testholes were excavated both uphill and downhill from the existing bed; material in these holes was found unsuitable for installation. Two additional holes were excavated at the north end of the property. Satisfactory results were obtained from our percolation tests of these holes. It is our intent to install a shallow trench at the north end of the property. We plan to exhume and move the existing tank provided it is in acceptable condition; if it isn't, a new 1,000 gallon steel tank will be installed. There is adequate grade from the proposed tank site to the outfall into the trench to preclude the need for a lift station. This lot is bordered by Sun Valley Road and Hiland Road. The dwelling sits against a steep bank; portions of that bank have been cut away and utilized as fill for the parking area, driveway, and house pad. The lot has areas in excess of 25% toward the south end and the southwest side along Hiland Road, but the slope is more gentle towards the northern portion of the lot. Lot 1 Block 2 Sun Valley S/D Paul and Ami Taylor Inspection Of On-Site Septic System Our File No. 6294.002 Dear Mr. Wilson: Our law firm has been contacted by Paul and Ami Taylor regarding the sale of their home on the referenced property and your firm's inspection of their on-site septic system. Specifically, during August and September, 1986, your firm performed inspections with respect to the on-site septic system installed on the referenced property. Your engineering stamp appears on the pertinent documents. You apparently performed this work for Carl Disotell. In reliance, in part, upon your approval of the septic system, the Taylors purchased their home. The Taylors have recently put their house up for sale and have obtained a buyer. Closing on the sale was scheduled for September 29, but is currently being moved to on or before October 18. The principal reason for extending the closing date is the extensive reconstruction required on the existing septic system (which you approved) at a cost estimated in excess of $10,000. The reasons for this needed reconstruction are succinctly described in reports dated September 21 and 23, 1995, copies of which are enclosed, from KND Engineering ("KND"). In addition to determining the septic system was improperly constructed, KND has pointed out numerous deficiencies in your inspection and approval of the system. Box 211505 Anchorage, Alaska 99521-1505 Subject: Lot 1, Block 2, Sun Valley S/D Dear Mr. & Mrs. Taylor: In the late 1970's, the Mnnicipality passed on its role of design and inspection of on- site sewer systems to the private civil engineering community. The Municipality subsequently acted as a reviewing and enforcement agency overseeing the engineers' work. PIowever, the guidelines for this work are clearly established in both Municipal codes and State regulations. At the time your sewer system was installed, a newly revised ordinance (AO No. 86- 21, approved by the Assembly on May 20, 1986, and codified as AMC 15.65) was in effect. This was a major revision to previous codes, and took into account the role played by engineers in design, installation and testing of systems. The review of your permit and installation inspection was done under this authority. In general, the process for permitting was as follows. A soil and site evaluation were required (Sec. 15.65.120). The site plan had to include a diagram showing the location of the planned dwelling, driveway, parking areas, well and any other areas of potential interference to this design from either a well or sewer system on adjacent lots. It had to also show where a replacement system could be installed (15.65.120.B.1.a), as well as identify a total area designated for both systems (15.65.040.G.5). This designated area was based on the soil rating found during soils investigation. The Municipality required a minimum of one soil test, but more could be required depending on the final rating of that first test. In general, one soil test was required for each 50 lineal feet of an absorption field. In addition, any soil test performed for installation must have been "taken no further than ten (10) feet from the proposed subsurface disposal field" (15.65.040.H.3). All site plans and accompanying soil tests were required to bear an original stamp and signature of a registered professional civil engineer. Following issuance of a permit, installation was allowed to proceed, but at least two inspections by the engineer were required (15.65.135.B). Following inspection and Subject: Lot 1, Block 2, Sun Valley S/D September 23, 1995 Page 2 of 3 completion of the installation, the engineer was required to submit an inspection report (15.65.135.13) which showed all system components and which also demonstrated that the installation was "consistent with the permit and site plan...." The inspection report must also bear an original stamp and signature by the engineer, As I previously reported to you, we made a nnmber of observations during our review of the file information and our site visits. They are identified below with brief descriptions of each. AMC 15.65.060.H requires that "horizontally laid perforated pipe in a subsurface disposal field must be level." The bottom of the excavation must also be level. Although we have no way of verifying that the bottom of the system ,,vas level, we are satisfied from field data that the pipes in that field are not level. It is not likely that normal compaction and settlement would account for the degree of discrepancy observed in the field. The engineer's report indicates both the location of the system and the type and number of pipes in that system. We found discrepancies in the measured location of the system as well as in the pipes present. The soil test utilized for the permitting process was shown to be 25 feet from the south lot line and 15 feet from the west lot line. We found no evidence of excavation at that designated point. In addition, there is a discrepancy between the testhole location on the soils log vs. what is shown on the plot plan. We did note, however, that the soil test location as submitted, exceeded the allowable parameter for distance to the nearest edge of the installed system. In addition, based on the final installed length of 62 feet in the system, one additional testhole should have been excavated to confirm soils in conformance with code (15.65.040 H3). In our soils investigation we excavated two testholes, which "bracketed" the existing system. We found roughly the same material as was logged during the original soil investigation. However, our percolation records vary a great deal from the percolation record utilized for the permit. In our first testhole, which was dug upslope from the existing system, we found and noted two layers in which we conducted percolation tests. We chose to conduct the percolation test in the higher soils strata dne to a previous encounter with groundwater by the engineer of the original system. In the most shallow of the two we found a percolation rate of <1 minute per inch drop. The second percolation test in that same testhole yielded a rate of 80 minutes per inch. Percolation rates and locations are identified in our soils logs submitted previously. In the second testhole a single percolation hole was set at 4 feet. Normally a hole is presoaked overnight and then tested. Upon returning for the test we noted Subject: Lot 1, Block 2, Sun Valley S/D September 23, 1995 Page 3 of 3 that the hole was still holding water, thereby not allowing the test. This means that in the second testhole, the percolation zone is impermeable as defined in AMC 15.65.010.O. Due to the proximity of the new test holes to the original system, the depth of our percolation tests as well as the consistency in the soils strata discovered, it is very difficult to imagine that the soil in which the original system was placed fluctuated from what we found on either side of the system. Iix essence the soil we encountered was so tight as to disallow installation at all tinder both state and municipal regulations. This is significantly different from tixe soils rated as 15 minutes per inch by the previous engineer. 5. As noted by the Municipal reviewer, the system was installed by an unlicensed excavator, who made technical errors in his installation. Normally it is the purview of the inspecting engineer to reqnire field correction of such blatant errors. It is also incumbent upon the engineer to make certain the excavator he is inspecting for is licensed. For some time it has been policy by the Municipality not to accept reports filed showing unlicensed excavators. It is unclear in this instance what arrangements were made to accept this work. Based on our site investigation, it appears that the site conditions for the permit were misrepresented to the Municipality. The engineer establishes a total square footage of land "available" for installation. In reality some of that available land is beyond the slope maximum of 25%. There was no effort made to inform the Municipality of this detail. There is also no explanation of the final, location of the well, which is not as shown on the site plan. As a result of the slope issue and the actual location of the well, there is very little space available for either an original or a replacement system. I am enclosing a copy of the Municipal code which was in effect in September of 1986 when your system was installed. Please use that to find referenced passages I have noted above. You may find other references listed in Sec. 15.65.040.J which support permitting and installation criteria. Per your request, I am providing a follow-up letter that hopefully, will provide you a more detailed explanation of what we found. The original system was installed in September of 1985, by Carl Disotell. According to Municipal records Mr. Disotell was not a certified installer when he constructed this system. Records also indicate that the system consists of a 1,000 gallon steel septic tank and a seepage bed measuring 18' x 62'. The system was approved for a three bedroom system. Based on a record of pumping the tank and field measurements, the above information appears to be accurate. However, we noted a number of discrepancies in the report as follows: A permit to construct the original system was issued by the Municipality for a 21' x 42' bed. The site plan (plot plan) showed the system was to be constructed in the vicinity of the test pit. The final as-built which was submitted to the Municipality, shows that the bed was moved approximately 35' from the original proposed position and outside a 50' radius of the test pit (50' was the requirement prior to 1990), and was 18' x 62'. This would indicate that the system was constructed with increased capacity. However, due to the improper construction the Municipality would only recognize a total effective absorption area of 744 square feet and not the 1116 square feet shown on the inspection report. Regardless, the Municipality still approved the system for 3 bedrooms. 2. The bed cleanout on the northeast side of the system ,,vas shown 38' from the dwelling. The actual measurement is 28'. Cleanouts found during the inspection do not match the number or location shown on the inspection report. We actually found cleanouts on all four corners of the bed, and two additional cleanouts sweeping in opposite directions on the north end of the system between the corner cleanouts. A monitoring tube was found on the south end of the system, but none ,,vas found on the north end. Lot 1, Block 2, Sun Valle., .~/D - Adequacy test/soils report September 21, 1995 Page2of 2 4. The bed should have been installed level. First readings taken through cleanouts indicated standing water in the cleanouts on the north end. Two inches of water were standing in the cleanout on the northeast corner of the bed; 6 inches of water were found in the northwest corner cleanout. At the same time, both cleanouts on the south end were dry. As noted in onr report previously, when water was introduced into the northeast cleanout, we observed it flow toward the northwest cleanout, then into the bed. The northwest corner of the bed appears to be the low point of the system. As a result, it may remain in a saturated condition at all times; this condition may well have contributed towards the partial failure found in your system. 5. The soil test utilized for the original installation shows soils percolating at a rate of 15 minutes/inch drop, measured in the layer designated "GM." This test is shown to be excavated 15 feet from the west lot line and 25' feet (although this number does not match the location shown on the site plan) from the south lot line. During our investigation and subsequent test pit excavation, we were unable to locate evidence of a previous test pit at that location or in the vicinity. 6. Following the adequacy test, we excavated two test pits. One is located 35 feet east of the installation; the second on is located 10 feet west of the installation. Although we did find material classified as "GM", the material failed to yield a satisfactory percolation rate. In fact, the eastern hole yielded a rate of 80 minutes/inch. A percolation test was not completed on the western hole due to the fact that the water added during the pre-soak phase of the test was still standing in the hole after 24 hours. This would indicate that the soils immediately adjacent to the existing bed have an impermeable layer of "GM", thus prohibiting installation of a system at the testhole site. Both state regulations and municipal code require a minimum separation of 6 feet between the bottom of any system and an impermeable layer. With the above in mind, it is my opinion that although there are a number of discrepancies with regards to the installation of the system, the system was probably placed in an area of inadequate soils which would most likely have resulted in the premature failure of the system. I trust this information will clarify questions you might have had about the adequacy testing and soils investigation we performed.
