RE: SEPTIC TANK UPGRADE PERMIT
LEGAL: SUSITNA VIEW ESTATES BLOCK 3 LOT 8
The owner has requested that we obtain a septic permit to upgrade the existing aged steel septic
tank on the above referenced lot. We propose to install a 1000-gallon HDPE deep-burial tank
per the attached design to serve the existing 3 -bedroom residence. We would recommend a
1500-gallon HDPE tank be installed for current functionality and future consideration or
flexibility.
An existing deck is greater than 30” high and is in close to the existing & proposed septic tank.
Any deck supports within 5’ of the tank must be installed or driven to the same elevation of the
proposed tank.
The location is very limited and there is a steep hill going upgradient that then goes downhill on
the other opposite side to a drainage way that eventually empties into Little Survival Creek.
There is no possibility of effluent interaction and the actual surface flow is approximately 100’+.
Please see note on the design. The surveyor will add this drainage pathway to the as-built survey
after tank installation and a waiver without MOA fee will be requested at that time if necessary.
No groundwater was noted in the MOA on-site file, but if groundwater is encountered during
installation an epoxy coated steel septic tank may be required. The lot and area are served by
private water and any encroaching wells, easements, … must be staked prior to construction.
The design will not impact any of the neighboring properties. Please contact us if you have any

AEC5 made an slte evaluation of the subject property, to deterr~ne the
available area for the on-slte septic system (diagram attached). The
available area is over 100 feet from neighboring wells and greater
than 30 feet from neighboring septic systems.
The proposed system (perr~t #840753) requires a 5 foot wide
drainfield, with 2.5 feet of gravel, and a total length of 53 feet.
As evidenced by the attached diagram, it is unlikely that this system
could be installed in the available area. The area is limited by the
location of the house (north), the driveway (west), the bank and slope
(east), and the south property line. The east bank is approximately
10-12 feet in height, and was establishedduring the excavation of the
foundation.
The driveway has been established and utilized, due to the slope,
reconstruction of the driveway would involve major expense. The soil
in this location could have been corRoacted due to traffic.
To install an adequate system (in the area available) would require
encroachment on the southern property line. Lot 9, the adjacent lot
on the south, ls approximately 141.73 feet in width (n-s). The lot
lfne between 8 and 9 ls platted at 167.22 feet. Ir~osing the system
of lot 8 on the southern lot line would not restrict lot 9 from
development. There is sufficient area to establish well, house, and
septic system on lot 9 (area approximately 27,003 sq. ft.). The well
on lot 8 has not been drllled at this tlme, the proposed well locatlon
meets separation requirements from ~djacent systems.

providing that modification of the permit design is practical and
fulfills MOA requirements (i.e.-separation distance from groundwater
and bedrock, valid soils test/perc, modification of design contingent
upon soils ratings, etc. ).
2) Provisions mode such that the driveway does not interfere with
the installation of the system or in~3ose on the system after
installation.
3) Providing that redesign of the system moximize separation
distance from the south property line.

THIS ENCROACHMENT AGREEMENT made and executed this 11t21

99674-7902, ifereinafter referred to as "Powers," and MARILYN J. SCARBOROUGH, a(n)
Mr e,r r led person, whose address is 927 Crown Court, Fruita CO 81521, hereinafter
referred to as "Scarborough." This Encroachment Easement shall become effective on the date it
is recorded, shall run with the land and shall inure to and be for the benefit of all owners and
future owners of the subject real properties.
WITNESSETH
WHEREAS, Powers is the owner of the following described property:
Lot 9, Block 3, SUSITNA VIEW ESTATES, according to the official plat thereof, filed under
Plat Number 70-287, Records of the Anchorage Recording District, Third Judicial District, State
of Alaska.
hereinafter referred to as"Lot 9"; and
WHEREAS, Scarborough is the owner of the following described property:
Lot Eight(8), Block Three(3), SUSITNA VIEW ESTATES, according to the official plat thereof,
filed under Plat Number 70-287, records of the Anchorage Recording District, Third Judicial
District,State of Alaska.
hereinafter referred to as"Lot 8."
NOW, THEREFORE, for and in consideration of the covenants and conditions set forth herein,
the parties do hereby declare as follows:
The parties hereto agree that the driveway presently serving the residence located on Lot 8
encroaches onto the property of Lot 9 and a driveway easement for the benefit of Lot 9 will
encroach onto the property of Lot 8. Powers as the Owner of Lot 9 and Scarborough as the
Owner of Lot 8 grant encroachment easements for said driveways as set forth on the attached
Exhibit and designated as "A."

The parties hereto agree that a portion of the septic system servicing Lot 8 encroaches onto Lot 9
and Powers as the Owner of Lot 9 and Scarborough as the Owner of Lot 8 grant an encroachment
easement as set forth on the attached Exhibit and designated as "B." Said easement is for the
purpose of the existing septic system servicing Lot 8 and a portion of the driveway access for Lot
9. Should the septic system fail and/or be replaced for any reason, the parties agree that the new
septic system servicing Lot 8 shall be placed entirely on Lot 8.
This encroachment easement shall run with the properties described herein and shall be a benefit
to and binding upon the undersigned and any person who shall hereafter acquire title to said
properties.
