The Right of Way Division has reviewed a request for a letter of nonobjection to an existing septic
system pipes, which encroaches 4 feet into the ten (10) feet Utility Easement. On the as -built survey
dated October 19, 2006, submitted with the request, the petitioner has shown the septic system pipes.
This letter of nonobjection is issued with stipulations, and by using it the petitioner is agreeing to the
following:
1. Municipality of Anchorage (MOA) will be held harmless, now and forever, for any damages or
injury to any person as a result of the encroachments.
2. All applicable codes and regulations will be observed and maintained within the casement.
3. This letter of nonobjection will in no way preclude MOA from full use and enjoyment of its
rights within any portion of the easement.
4. Additional and extraordinary costs incurred during any future required construction, repair or
reconstruction of MOA improvements to accommodate any or all of the encroachments shall be
paid by the property owner.

Request for Letter of Non -objection to Encroachment
The Anchorage Water & Wastewater Utility received a request from you on September 6,
2007, in regards to an existing septic clean outs encroaching approximately 7' into the
easement running north to south along the east property line of ORTH LT 7.
AWWU is not using the utility easement and has no objection to the encroachment. AWWU
hereby issues this letter with stipulations to allow the encroachment of the septic clean outs,
and by using the easement the property owner(s) agrees to the following:
1. AWWU will be held harmless, now and forever, for any damages or injury to any
person as a result of the encroachment;
2. All applicable codes and regulations will be observed and maintained within the
easement;
3. This letter will in no way preclude AWWU from full use and enjoyment of its rights
within any portion of the easement;
4. The property owner shall pay any additional and/or extraordinary costs incurred to
accommodate the encroachment during any future required construction or
reconstruction of AWWU facilities;
5. AWWU's non -objection does not imply other approvals that may be required for this
encroachment; and,
6. AWWU does not provide a position for any other parcel or utility impacted by the
encroachment.

wide utility easement situated adjacent to the north and east boundary line of Lot 7, Orth Subdivision,
according to Plat No. 74-177, Records of the Anchorage Recording District, Third Judicial District,
State of Alaska.
Acceptance and use of this letter of non -objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
• Landowner/Contractor working near ENSTAR gas facilities shall contact the Alaska Digline, Inc.,
(907) 278-3121, for line locating two (2) business days prior to excavation.
• Landowner/Contractor will hand dig all excavations within 10 feet of natural gas lines.
• ENSTAR will be held harmless, now and forever for any damages or injury to any person or property
as a result of this encroachment
• Any ENSTAR facility damaged or destroyed, as a result of this encroachment will be repaired at no
cost to ENSTAR
• Any costs incurred by ENSTAR for special construction necessitated by this encroachment will be
borne by the property owner.
• All applicable safety code regulations will be observed and maintained.
• This letter of nonobjection will in no way preclude ENSTAR from full use and enjoyment of its rights
within any portion of its right-of-way.

This permit is between Chugach Electric Association, Inc., an Alaska non-profit electric
cooperative, (herein "Chugach'), whose address is P. O. Box 196300, Anchorage, Alaska 99519 and
Joseph L. Willing Jr. Revocable Taut (herein "Permittee', whose address is 1301 Cross Road,
Anchorage, Alaska 99515.
1. Vasement. Chugach is the grantee or user of an easement for the construction and
maintenance of electrical facilities, as follows:
Dedicated by the plat of the subdivision known as Orth Subdivision, according to Plat
Number 74-223, recorded on the 250 day of October 1974, on file in the office of the
District Recorder, Anchorage Recording District, Seward Meridian, Alaska,
Described in that certain written instrument recorded on the 250' day of July 1952, in
Volume 76 at Page 84, on file in the office of the District Recorder, Anchorage Recording
District, Seward Meridian, Alaska,
Described in that certain written instrument recorded on the 301i day of June 1958, in
Easement Book 3 at Page 344, on file in the office of the District Recorder, Anchorage
Recording District, Seward Meridian, Alaska,
herein "Easement") which pertains to the following described real property:
The East Ten Feet T10) of Lot 7, Orth Subdivision, according to Plat Number 74-223,
recorded on the 25 day of October 1974, on file in the office of the District Recorder,
Anchorage Recording District, Seward Meridian, Alaska.
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that
Penmlttee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Easement is adjacent:

October 1974 on file in the office of the District Recorder, Anchorage Recording District,

2. Encroachment. Permittee has purchased or constructed the following improvements
on or within the real property subject to said Easement:
A septic system with two pipes, buried at an approximate depth of seven feet (7'), said
septic system encroaches into said Easement a maximum distance of approximately
Three Feet (3') for a distance of approximately Eight Feet (8'),
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its existing location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the Encroachment.
5. No Ex2ansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach., Chugach has no obligation to provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the nal property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. Thispermit
creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is teasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty (30) days ofwritten demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
S. Covenants Running with the Land. The obligations of the permittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the Permittee's
interest in the land subject to the Easement and shall benefit the Easement.
. 9. Termination. Chugach may terminate this permit alter the giving of thirty (30) days
written notice of such termination if:

a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.
b. The Encroachment is damaged by any means to an extent of more than thirty percent
(30%) of its replacement cost at the time of destruction.
C. Permittee fails to make the payment described in paragraph 7, above.
10. I -e=. This permit shall, ifnot sooner terminated by Chugach, expire forty (40) years
from the date hereof.
11. Entire Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements, oral or written, between the parties. No modifications, amendments, deletions, additions
or alterations of the permit shall be effective unless in writing and signed by all ofthe parties hereto.

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of On -Site Systems
Approval (COSA) based only upon the representations given In paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer
of title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or
water supply system. DSD also Issues COSAs upon request to homeowners. Certificates of On -Site Systems
Approval are valid for 90 days from the date of issue for properties served by a private or Class C well and may
be reissued with new water samples. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

In conducting this evaluation, GEG, LtD. attempted to provide a thorough,
conscientious engineering analysis of the system In accordance with ADEC and MOA
DSD Guidelines & Regulations. The reported results described the performance of the
system under the conditions encountered at the time of the test, and separation
distances measured to readily Identifiable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG. LTD. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the
operational requirements of the ADEC or MOA DSD. The content of this report Is for
the sole benefit of the owner listed above. Any reliance upon or use of this report by any

Ref: Orth Subdivision, Lot 7. Waiver of Separation Distance Between the Well on Property and the
Septic Tank on Property.
The existing four (4) bedroom house is served by a private well and septic system. A permit to install
the septic system was issued by the GARB on 7/29/76. At the time the permit was issued, the permitted
specified that the well must be 50 feet from the septic tank, however, at that time, the required separation
distance was 100 feet. The septic system was installed and approved by the GAAB even though the
separation distance between the tank and the well was less than 100 feet. In short, issuance of a waiver
was implied by issuance of the sewer permit and through final approval by the GAAB of the installation.
Per the as -built survey, prepared by Robert Johns, LS, the clean-out on the septic tank is only 82 feet
from the edge of the well. It is unknown what the configuration of the 2000 gallon Sunset Plastic tank is,
so to be conservative, we are assuming the cleanout is in the center of the tank. If this is the case, the
distance between the well and the septic tank is approximately 75 feet; therefore, we are requesting a 73
foot waiver between the well and the septic tank. Attached is drawing showing the location of the septic
tank relative to the well. Justification for the waiver is summarized as follows:
The GAAB appears to have approved a separation distance of less than 100 feet when they
issued the sewer permit and approved the as -built drawings in 1976. In short, issuance of an
existing waiver was implied.
The encroachment has existed for approximately 31 years and recent water samples indicated
nitrate levels of 3.7 mg/L and no bacteria to be present. Attached are well logs from three (3)
adjacent properties. The wells 81-85 feet deep. All of the drilling logs show geological layers of
either hardpan, silty gravel, or silty sand that have served to protect the aquifer.
The well head extends at least 12 inches above grade, has a sanitary seal, and has appropriate
drainage around it.
Based upon the aforementioned facts, it appears that there is minimal risk associated with granting the
requested 73 feet waiver between the well and the septic tank.
