We made it very clear that the warranty from the factory was 4'. It was mentioned to him what some folks had done in Wasilla, but we only warranty to 4'. For this particular case, and with you being a good business partner of Ferguson, Ferguson will warranty this tank for a period of 5 years. This is the same warranty period directly from Infiltrator. If there is a problem with the tank, Ferguson will only replace the tank, at no cost to the homeowner. Any labor to replace would be at the expense of the installer or homeowner. I talked to Jeff Garness, my boss, about our phone conversation and he did talk to Jay Holman during the installation process and he said that tanks with more than 4 feet would not be warrantied. Our design clearly stated that a maximum of 4 feet of cover over the tanks and during the installation process, we did talk to the contractor and stated that he must ensure final grading was no more than 4 feet. The contractor contacted representatives at Ferguson while you were on vacation to discuss these tanks. He told them that he was going to install 4" of insulation to make up for the excess cover. They told the contractor that J would be acceptable and there should be no issues with the tanks; so the contractor choose to proceed with the installation of the Infiltrator tanks. After final grading, the IM-1060 tank does have 4.20-4.24' of cover and the IM-540 tank has 4.4' of cover. The existing septic system consists of 1000 gallon septic tankand-a-bedType drainfield. The drainfield is currently grossly surcharged_aad--needs to be upgraded. We are proposing to rebuild the existing bed as partof-the upgrading of the septic system. We discussed this project with your department-prior to working on a solution for the upgrade and it was mandated that we performist-h�s so that the entire bed be encompassed within the 30 foot radii of these test hflles�Thesconditions of the soils are addressed below. Based upon our soi ' vestigation, we have determined the existing bed is undersized and encroa e on groundwater. Due to the spring groundwater level reading -arid-the-required separatio ance from the bed bottom, a 1250 gallon STEP tank will be required as pari of_` pgrade. Comments regarding the design are summarized as follows: 1. SOILS: See the attached logs which show the soil classifications, groundwater monitoring, and the percolation test results. On 5/4/2017, we performed two (2) test holes, one (1) on the uphill side of the drainfield (TH#1) and one (1) on the downhill side (TH#2). We returned to the property the following day to perform the percolation tests and the bench for the TH#2 had water in it. The water had a sewage smell to it and the soils were stained at 3 feet below the ground surface. We were able to perform a percolation test in TH#1 and found the percolation rate to be 40 minutes/inch. In short, we were unable to perform a percolation test on TH#2 due to flowing effluent into the bench; however, the soils visually appeared to the same as in TH#1, so it is our opinion that the percolation rate for TH#1 should be applicable to TH#2. 2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications. 3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic system. 4. TOPOGRAPHY AND SLOPE WAIVER: The topography is shown on the attached design 3701 E.Tudor Road.Suite 101 * Anchorage, AK 99507-1259 Ph: (907) 337-6179 *Fax: (907) 338-3246 * Website: www.garnessengineering.com drawing. Based upon elevation shots that we have taken, the slopes range from 5 to 7 percent in the drainfield area and run approximately South to North. The existing bed was installed perpendicular to this slope. We are proposing that the new drainfield be installed in the same fashion. We are requesting a slope waiver to allow the new drainfield to be installed on this slope. Justification for this waiver are as follows: • The existing bed drainfield was installed on this slope and it appears to have not created any adverse effect. Even with the system currently surcharged (liquid level 9" to 20" below existing grade on the downhill side), there is no indication of daylighting of effluent. • The proposed sand filter will allow for enhanced downward migration of effluent and help prevent daylighting of effluent downhill from the drainfield. • We are proposing to use pressure distribution for the drainfield. This will promote even absorption over the bed bottom. • The entire bed area and any mounded portion the bed will be capped with 6" of topsoil and seeded to prevent erosion and to prevent daylighting of effluent. Based upon these mitigating factors, it is our opinion that there is minimum risk with the granting of this waiver. 5. BED OVER TEST HOLE WAIVER, BED WIDTH WAIVER, AND BED TO SUBDRAIN WAIVER: • We are proposing to construct the new drainfield over TH#1. Given the test hole was backfilled with native material and a 2 foot sand filter will be utilized (with compaction) and that the 4" monitoring tube for the test hole will be pulled prior to placement of sand, it is our opinion that there is minimal risk with allowing the bed to be installed over the test hole. • We are also proposing that a 23 feet wide bed type drainfield be installed which is over the standard 15 feet width. We have noted on the design drawing that the contractor . . shall not "walk" equipment on the bottom of the bed until after placemenet of the imported sand. Given the scale of this project, a large tracked type excavator will most likely be used for this installation. • There is a subdrain/French drain to the North of the drainfield which may be less than 50 feet away. We are requesting that the encroachment be allowed given the proposed wastewater ordinance allows for a bed type drainfield to be installed as closes as 10 feet to a subsurface drain. In consideration of the mutual covenants contained herein, the parties to this Maintenance and Repair Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as Q(ictw) &el/ located at(legal description). 2. Definitions. Alteration. Any change to the design or function of an AWWTS that includes the installation or removal of any parts,components or pieces not included in the original construction permit and design. Certificate of On-Site Systems Approval (COSA). An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with Anchorage Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that service and maintenance provider approved by the municipality and the manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2)maintenance, (3) adjustment(s), (4)replacement costs, and(5)inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations,rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On-Site Systems Approval. H. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions,nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof,or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement,the only authorized representatives of the parties are: a. Owner: b. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. Permit. An On-Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AWWTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations,Installation and Removal of Additional Equipment. Prior to performing any alterations to an AWWTS,the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement,the Owner shall maintain their AWWTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS 8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance and Repair Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Maintenance and Repair Agreement. 9. Severability. Any provisions of this Maintenance and Repair Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Maintenance and Repair Agreement.
