Dear Mr. Rob Campbell:
This is in response to your June 25, 2012, request for a jurisdictional
determination for a 0.78 -acre parcel of land described as Pennington Park.
It has been assigned number POA -2012-524, which should be referred to in all
correspondence with us. The project site is located within Section 10, T. 11,
N., R. 3 W., Seward Meridian; USGS Quad Map Anchorage Ar8; Latitude
61.0628230 N., Longitude -149.776900° W.; Pennington Subdivision, Block 3,
Lot 4; Municipality of Anchorage Parcel no. 02018131, in Anchorage, Alaska.
Based on our review of the information you furnished and available to us
and our July 13, 2012, site visit, we have determined the above property does
not contain waters of the U.S. under the Corps` regulatory jurisdiction.
However, there is approximately 85 feet of stream channel along the north
side of the property that is jurisdictional, as it is a tributary to the
Little Survival Creek. These waters of the U.S. are shown on the enclosed
drawing prepared by the Corps of Engineers and dated August 28, 2012. A
copy of the Approved Jurisdictional Determination form is available at
http://www.poa.usace.army.mil/reg/ApprovedJDs.htm under the above file
number.
This approved jurisdictional determination is valid for five (5) years
from the date of this letter, unless new information supporting a revision is
provided to us before the expiration date. Enclosed is a Notification of
Administrative Appeal Options and Process and Request for Appeal form (see
section titled "Approved Jurisdictional Determination").
DA authorization is required if you propose to place dredged and/or fill
material and/or perform work into the tributary of Little Survival Creek
mentioned above. You can refer to our website at
http://www.poa.usace.army.mil/reg/PermitApp.ht for more details on our
permit application process.
Section 404 of the Clean Water Act requires that a DA permit be obtained
for the placement or discharge of dredged and/or fill material into waters of
the U.S., including jurisdictional wetlands (33 U.S.C. 1344). The Corps
defines wetlands as those areas that are inundated or saturated by surface or
groundwater at a frequency and duration sufficient to support, and under

normal circumstances do support, a prevalence of vegetation typically adapted
for life in saturated soil conditions.
Nothing in this letter excuses you from compliance with other Federal,
State, or local statutes, ordinances, or regulations.
