This is a request for a variance from Section of the Land Subdivision Regulations.
This variance is for:
Dedication of trails and a variable width vegetation buffer.
A. The existing situation is:
The State has negotiated an agreement to prochase lands for State Parks,
the preceding easements are not a part ok the agreement.
The granting of this ~tition would permit:
The State to finalize the purchase of the waterfall property without
reopening the qpAotiations and possibl~ bein8 unable to purchase
the land.
Before a variance may be ~ranted, the app/icant must prove rher each of the fei/owing four conditions have been fulfil/ed. Answer
each of the conditions in detail, using additional shoet~ if necessary.
The undersigned alleges that:
1, That there are such special circumstances or conditions affectingsa~d property that the strict application of the provisions of Ihis
ordinance would clearly be impractical, unreasonable, or undesirable to the general public. These special circumstances or
conditions are:
Lot 4A will be subdivided in the future and the easements can be
obtained then. Requiring the easements now could nullify the agreement and the
general public will loose the waterfall park.
It will provide the means to place the waterfall and adjoining
property in pa~'[~nds for the public.
3. That such variance will not have the effect of nullifying the intent and purpose of this ordinance or the Comprehensive Plan of
the Municipality for the following reasons:
The easements can be obtained upon subdivision of the remaining 15 acre tract.
4 The above listed special conditions or circumstances do not result from the action of the applicant and such conditions or
circumstances do not merely constitute a pecumary (monetary) hardship or incpnvenience in that:
The purchase agreement has been signed and the requirement o--f-i-~-ese

the Municipality for the following reasons;
