SIGNED Date EQ-034 (1/74) STATE OF ALASKA BEFORE THE ALASKA PUBLIC UTILITIES CO~$~ISSION In the Matter of the Application of EQUITABLE, INC., for a Certifi- cate of Public Convenience and Necessity to Operate as a Water Utility U-71-72 ORDER NO~ i ORDER GRANTING CERTIFICATE On August 19, 1971, EQUITABLE, INC. (EI) , filed an application for a certificate of public convenience and necessity to operate as a water public utility furnishing service to Lots 1 through 22, Block No. 3 of the Kwik Log 'Subdivision, situated in the Greater Anchorage Area Borough. The application herein was filed pursuant to AS 42.05.221 which provides in part as follows: " (a) No public utility may operate and receive compensation for providing a commodity or service after January 1, 1971 without first having obtained from the commission under this chapter a certificate declaring that public convenience and necessity require or will re- quire the service. (c) A certificate shall be issued to a public utility which was not required to have one before July 1, 1970, and which is required to have one after that date, if it appears to the commission that the utility was actually operating in good faith on that date." Notice of the application was published in the Anchorage Daily Times and was mailed to all known interested parties. A single protest to the application wa~ received (from the City of Anchorage) stating, in essence, that EI's water system was substandard; that it was inadequate to U-71-72 (1) Page 1 provide fire protection; and that incorporating or upgrading it into a modern system would create problems of cost re- covery, as all assessments have already been paid by the con- sumers. The protestant's allegation that EI's water system is substandard relates primarily to heal~.h code requirements, although the public health authorities presumably are cog- nizant of the problems. In any event, the applicant should understand that the granting of a certificate by this Commis- sion in no way exempts the applicant from compliance with all applicable rules and regulations of the State and local governmental health agencies. The Commission notes that the two-inch pipe line that supplies water to EI's present consumers is insufficient for fire protection. In the opinion of the Commission's ~ ~ engineer, minimum ~lo~s~ as recommended~ by the American Insurance Association for a similarly developed area, could never be realized with EI's present facilities. It appears to the Commission that the applicant has grandfather rights to certification under the aforementioned statute, since it was apparently operating in good faith on July 1, 1970. However, the applicant has a concurrent re- sponsibility to see that its utility system meets accepted engineering and health standards and that its water service is of acceptable quality. FINDINGS THE COMMISSION FINDS: 1. That Equitable, Inc., was operating as a water U-71-72 (1) Page 2 utility in the requested service area in good faith as of July 1, 1970. 2. That Equitable, Inc. is entitled to a certifi~ cate of public convenience and necessity under the pro- visions of AS 42.05.221(c). 3. That the protest submitted by the City of Anchorage, although well founded, cannot be considered by the Commission as affecting the grandfather rights of Equitable,~Inc. under AS 42.05.221. ORDER THE COMMISSION ORDERS: 1. A certificate of public convenience and neces- sity to operate as a water utility'is hereby granted to Equitable, Inc., in the following service area: Lots 1 through 22, Block No. 3, Kwik Log Subdivision, in-the N 1/2 of SE 1/4 of SE 1/4 of Section 6, T12N, R3W. All the above with reference to the Seward Meridian. 2. The protest filed by the City of Anchorage in · this proceeding is dismissed.
