Dear Ms. Oswalt:
Per the stipulation on permit #900143 I have reinspected the subject property on this
date. Mr. Milner reports that he has not had to have the holding tank pumped since we
prepared the as-built drawing dated 7/2/90. On September 5 there were 17 inches of
Huid in the holding tank, which is the same depth I measured in June. On September 5
there was no measurable fluid in the cleanouts of the lower soil absorption trench, and
there were 49 inches of Huid in the monitor tube at the east end of the upper soil
absorption trench. Based on these observations, I believe the hybrid soil absorption
trench - holding tank system is continuing to function as intended.

Per the request of Sandy Milner I am submitting a site plan prepared last year
depicting a proposed recol.~.igura[ion of the holding tank serving his residence on Lot 8,
Block 3, Kimberley Manor S/~. ~he reconfiguration would allow it to receive effl6ent ohly
~when the soil absorption system is beyond capacity. As you may recall, the test hole dug
prior to installation of the holding tank indicated a stabilized water level at 7 feet below
ground surface in the location where the holding tank was installed. Because of concern
that the-water level observed in this test hole may have been affected by the presence of
the soil absorption trenches just uphill from it, Mr. Milner had a second monitor tube
installed last year in a location 13 feet uphill from the upper trench, at a location where
the ground surface is 5.5 feet higher than at the upper trench. I monitored the water
level in this tube during this year's breakup, with the following results:

Based on this data, il' one accepts the hypothesis that the natural groundwater profile
parallels the ground surface, one can conclude that the existing soil absorptk)n trenches
do have the required 4 foot vertical separation from groundwater, so reconnecting them
to the system would not violate the wastewater ordinance. I have indicated on the site
plan how I would propose to reconfigure the plumbing leading to the trenches and the
tank. If this co~ffiguration is acceptable, please issue the requested permit to Mr. Milner.

Dear Mr. Milner:
The purpose of this letter is to summarize my measurements and
observations with regard to soil conditions and depth to groundwater at your
residence on Lot 8, Block 3, Kimberley Manor #2, located at 7701 Our Own Lane. I
have attached copies of pertinent soils logs and other relevant material.
Soils tests conducted in July, 1979 at the toe of 70% slope that characterizes
the north portion of your lot showed a depth to groundwater of 13 feet, and a
visual soil rating of 210 square feet per bedroom for the overlying material. A
three bedroom soil absorption system was accordingly installed in August, 1979,
consisting of two parallel trenches extending to 9 feet below ground level.
My first involvement with the system was in 1985 when I conducted
adequacy tests, first in February and then again in August. On both occasions the
trenches were nearly full at the start of the test, and after being brought up to
completely full, they absorbed water at an adequate rate for a two bedroom
residence only. At your request, I forested the system in February, 1988. On that
date the trenches were again nearly full at the start of the test, and I measured the
absorption rate to be adequate for only a one bedroom residence. I understand
that you subsequently contracted with another engineer to retest the system, and
that he found it to be adequate for a two bedroom residence.
In June, 1988 1 conducted additional soils tests for a possible upgrade to the
system. The first test hole was located approximately 13 feet downhill from the
lower absorption trench, and at a'point where the ground surface was 40 inches
lower. This test hole showed a dense gravelly silt down to 10.5 feet, overlying a
gravelly clay. The groundwater level stabilized at 7 feet below ground level. A
second test hole dug 44 feet further downslope at a point where the ground
elevation was an additional 67 inches lower than at the first test hole. Here the
gravelly silt stratum extended down to only 5.5 feet, and the groundwater level
stabilized at 40" below ground level. I conducted a perc test in the vicinity of the
first test hole which indicated the perc rate to be in excess of 60 minutes per inch,
and accordingly I designed and oversaw the installation of a holding tank in
September, 1988.
We have had numerous discussions regarding the feasibility of using the
holding tank in conjunction with the original soil absorption system, wherein it
would act as an overflow only at times when the trenches were unable to handle
the wastewater stream emanating from the residence. Since you found the original
system to be adequate for most of the demands imposed by your household, the
hybrid concept ought to greatly reduce the frequency of necessary pumping. Such
a system has been successfully installed elsewhere in the Municipality, but this
approach is only applicable where tight soils are the cause of septic system failure
and not groundwater.
The stabilized water level measured in test hole # 1 is of particular concern
because it is only 10.3 ft. lower than the ground surface at the lower trench. We
discussed whether or not it could be influenced by the presence of the trench
located only 13 feet uphill, and also by the septic s~/stem located on the neighbor's
lot immediately to the east. I suggested that another test hole drilled on the uphill
side of your field might clear up that question, so you arranged to have that done
this spring. That hole is located 13 feet uphill from the upper trench and at point
where the ground elevation is 5.5 feet higher than at the upper trench. I checked
the water level in this new test hole two times; on May 30 it was 15.5 feet below
ground level, and on june 12 it was 16.1 feet below ground level.
On the basis of these measurements, I feel one can safely surmise that the
natural groundwater level somewhat parallels the surface topography, becoming
gradually shallower as the ground levels out into the Rabbit Creek floodplain. It
appears reasonable to conclude that the original groundwater level measured in
1979 for the design of the original septic system was accurate, and that the higher
level measured in in 1988 in the test hole below the lower trench was in fact a
result of the influence of the nearby trench. Certainly the fluid levels measured in
the trenches during the adequacy tests could not have been reflective of
groundwater depths, but instead were high due to the poor percolation
characteristics of the soil. These same poor percolation characteristics of the soil,
while being undesirable from the point of view of septic system construction, do
tend to protect the underlying groundwater from septic contamination. Thus, it is
my opinion that reconnection of the original septic system trenches to the house,
with a bump in the line causing the holding tank to serve as an overflow, would not
constitute a health hazard.
You should be advised that any such change will requh'e a permit and prior
approval from the Health Department. I suggest that you bring this letter and
discuss the idea with Susan Oswalt at the Health Department, since she is familiar
with the previous installation. If she approves of the concept, I can provide
whatever additional engineering or inspections they may require.

Dear Mr Moore,
Thank you for your letter of March 12 regarding our septic
system.
I request that you proceed with the additional monitoring of
the test well above the trenchs and submit to Susan Oswalt
the site plan that was prepared last July. This site plan
has the bump to the holding tank from the line at the
beginning of the second trench. From our orginal
discussions this was the place you suggested would be the
appropriate place to connect in the holding tank if a
connection was possible in the future. This connection could
be dug by hand. From discussions with Susan Oswalt she
suggests that the additional monitoring occur in early May.
I enclose a cheque for $ 150.00 to cover the site plan
prepared last year and the additional groundwater
monitoring.

with this for her files. I have Oeen out of town recently, and thus was not able to respond
as immediately as you may have wished.
Upon receipt of Payment I am willing to submit for Municipal Approval the sRe plan I
prepared last August, but I understand from i~ormal discussions with
the interim you retained the services of another eng~eering firm to make such
submittal, and that Ms. Oswalt requested a ~uple of modlications which you were
reluctant to comply with. Sin~ you cannot legally pro~ed with any mod~ications to
your system until a permit is issued by DHHS, it would seem apPropriate for me to review
the proposal with Ms. O~alt and then to refle~ her desired changes upon the submittal,
unless we can document a good engineering reason why it should be connected otherwise.
In consideration of the known groundwater problems in this area, and t~e fact that
our monitoring program did not begin until May 30 last ye~, I feel it would be prudent
to make a couple of additional measurements of your monitor tube during late April and
May of this year, prior to submittal of the site plan, so as to further assess whether or not
there is a seasonal high groundwater problem at this particular site. ~s should not have
the effect of further delaying your conversion, as the constru~ion work would have to be
done ~ter breakup an~ay.
Assuming the permit is issued, we will, of course, have to provide DHHS with an
engineering inspection report ~irming, upon the basis of visual observations, that the
system is connected as required by the terms of the permit. I am enclosing a cost
estimate of the required work and shall await your instructions on how to proceed.

I am writing in connection with our septic system for which
I have retained you as a consultant engineer for a number of
years. As you probably recall, after digging a monitoring
tube and getting the Municipality to agree to a design in
principle, I required a site diagram filed to obtain a
permit to reconnect the drainage trenches to the holding
tank. However in view of the impending court case with the
well you felt that you were unable to supply this drawing
unless I agreed to pay lawyer fees relating to your possible
involvement through one of the parties I was taking to
court.
After discussions with Susan Oswalt, we decided that it
would be in the best interests of all concerned if we waited
to see what was the outcome of the case. Hopefully then we
could proceed with you providing the necessary paperwork to
complete the job since you had undertaken all the previous
work. The well situation has now been settled out of court
to my satisfaction (indeed all the parties involved finally
acted with some degree of responsibility) and there is no
possibility that you will become involved.
Consequently I now request that this project go forward to a
satisfactory conclusion and that you submit the necessary
site plan to the Municipality.

RE: Holding Tank Installation - Lot 8, Block 3, Kimberley Manor S/D, #3
Dear Sirs:
An adequacy test on 2/17/88 of the soil absorption system serving the
subject lot showed it to be adequate for slightly less than two bedrooms, rather
than the 3 bedrooms for which it had been designed. Soils tests performed on June
29 demonstrated a perc rate of 230 minutes per inch, which is slower than the
allowable rate for a~oil ~bsorption system, so a holding tank appears to be the only
option. We propose to abandon the existing system after the septic tank, and to
install a 3000 gallon holding tank at the location shown. An alarm will be mounted

1. That part of the absorption trench under ~our driveway
should be moved. The trench may be executed six feet
rrm the higher trench.
Z. A 90 day tenporary waiver is hereby issued to provide
for construction time.
3. Upon su¢cess~lly putting in the new trench and
abandoning the eld trench line under the drive,ray,
a full ~iver will be given to the septic system.
