RE: Septic System replacement for Lintner Lot 2
Dear Curtis,
OSP 201284 permit conditions required that an existing well inside the home be decommissioned and
that percolation test results be submitted.
The well, which is inside the home, was reportedly decommissioned, according to the property owner.
That was apparently done by removing electrical components and welding a steel cap to the top of the
pipe. It was not properly decommissioned by qualified personnel until 11/2024. Future permit conditions
may require well decommissioning logs be submitted prior to proceeding with construction.
In this case, with the well being inside the home, and an AWWTS being used, the risk of contamination
was much lower than the previously installed seepage pit system on the lot. The exact location of the well
relative to the septic is unknown, however, it appears that the absorption field was greater than 50' from
the well.
A percolation test was performed on site in accordance with MOA requirements near the north end of the
trench at the top of the siltier layer shown on the 7/1/20 soil log. The results are shown below:

All construction shall be in accordance with:
1. The attached approved design.
2. All requirements specified in Anchorage Municipal code Chapters 15.55 and 15.65 and the State of Alaska
Wastewater Disposal Regulations (18AAC72) and Drinking Water Regulations (18AAC80)
3. The wastewater code requires inspections during the installation. The engineer shall notify the Development
Services Department per AMC 15.65. Provide notification by calling (907) 343-7904 (24/7).
4. From October 15 to April 15, a subsurface soil absorption system under construction during freezing weather
shall be either:
a. Opened and Closed on the same day, or
b. Covered, sealed, and heated to prevent freezing
Special Provisions:

1. The &Rtife soil strata from 4 ft to 12 ft was
not percolated. An additional percolation test is required prior to construction of the proposed drainfields,,4 tom
in the lower soil strata. If results require a design change, construction shall
stop pending review and approval of a change order. Please submit results with the inspection report (or change
order, if required).

Dear Reviewer,
The owner would like to install a new septic system on the subject lot.
We are proposing to install a new septic tank and a new drainfield. The system will be sized for 4
bedrooms.
The existing septic system and wells on the lot have been taken out of service. The well near the house
will be permanently decommissioned and the well near the road will be brought back into service.
Included with this letter is a permit application and design package, including plans, and calculations.
A test hole was excavated and revealed good soils with no groundwater encountered.
The Homeowner may install the septic system himself and will submit the appropriate paperwork in
advance of doing so.
The proposed improvements will have no apparent adverse impacts on adjacent properties.
A test hole revealed silty soils on the lot. Additional percolation tests will be performed during construction
and the design will be subject to modification.

(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as ADVANTEX

2. Maintenance, Repairs and Alterations.

hroughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
�61 Owner agrees that only maintenance and repair personnel approved by the Municipality

or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

Owner acknowledges that the Municipality may request records of maintenance and
„^ repairs from the manufacturer's representative or maintenance provider.
PQ Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
XOwner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
5 guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be

Completion of Required Well and Septic Conditions to Sell Without a COSA
Final Report
This report completes the MOA requirements allowing the subject property to be sold without a COSA.
The details shown below indicate all of the requirements have been satisfied.
1. Septic System:
a. Septic tank: It was completely removed from the property and disposed of at the MOA
landfill. The hole was backfilled to be level with the existing ground surface.
b. Drainfield: Originally it was thought to be a crib, but was discovered to actually be a
trench, which was abandoned in-place.
c. Asbuilt Survey: A copy of the existing Lintner Lot 2 asbuilt (Duane Mark Seward, dated
1-14-91) is attached to this letter.
-2. Water System
There are two wells on the property. Both wells have been taken out of service, are currently
non -operational, and will not be allowed to be put back into service until a new septic system is
installed on the property. The MOA required conditions to render the wells non -operational
have been completed as detailed below.
a. Well 1
i. Location: In the front yard alongside the driveway, approximately 30 feet from
the street.
ii. Water Quality: (lab report attached)
1. E. Coli and Total Coliform Bacteria: Negative
Note: The initial sample came back positive for total coliform. The well
was chlorine shocked by Sullivan Water Wells and resampled.
2. Nitrates: Non -Detect
iii. Electrical: All excess wiring cut off and removed.
iv. Casing Cap: %" steel plate continuously welded onto the top of the well casing.

Request to Sell Without a COSA
Required Conditions
The owner is deceased and her son, Brian Rathbun (Executor) is in the process of preparing the property
for sale. The home is in poor condition and Brian believes the only time efficient cost-effective way to
sell the property is to price it to attract buyers who would want to demolish/dispose of the house and
build a new one in its place. As such, we will be requesting below that the MOA allow the property to,
be sold without a COSA if the listed conditions are satisfied.
History
1. Septic System
Although there is no documentation on file indicating this is an approved system, it was
approved by the department for at least two prior property sales. Currently, the septic tank is
substantially collapsed and as well as no longer working properly is also considered a serious
safety concern. The water elevation in the drainfield (crib?) is approximately 2.5 feet below the
ground surface, which given this is a gravity fed system on a relatively flat lot, it's likely
submerged in shallow groundwater and not just plugged by sewage. The septic system is
obviously failed and would need to be upgraded prior to any future use.
2. Water System
There are two wells on the property.
® Well 1: Per the Executor, it has never been operational during the time his mother
owned the property. Currently, the electrical wires to it are cut off and it is not
operational. It is approximately 50 feet from the septic system.
® Well 2: It is currentlyprovidingwater to the home and is 100+ feet fromtheseptic
system.
Required Conditions
Due to the poor condition of the home and the condition/issues discussed above regarding the septic
and water systems, we are requesting the following conditions be satisfied so that the property can be
sold without the need to acquire a COSA.

Request to Sell Without a COSA
1. Septic System:
a. Decommission the septic system in place by pumping the septic tank, removing its top
and backfilling it and the.associated excavation with soil to match existing grade.
b. Submit a copy of the Lintner Lot 2 asbuilt (Duane Mark Seward, dated 1-14-91) to the
MOA. Note: It shows the current location of the septic standpipes and would be helpful
information to have when designing a new septic system.
2. Water System
The intention is to render the wells unusable until a new approved septic system is installed by a
future owner, while at the same time not degrading their potential value to prospective buyers.
Further, it is our intention to provide the new owner with the utmost flexibility in deciding which
well(s) to either use or fully decommission in accordance with the code.
a. Well 1 and Well 2
i. Electrical
1. Remove all excess electrical wiring coiled up inside the well casing and
cut it off at least 1 -foot below the top of the casing.
ii. Well Cap
1. Weld a %" minimum thickness steel cap on the top of the well casing.
3. Inspection Report
a. In lieu of obtaining a COSA, an engineer's report indicating the conditions outlined
above have been satisfied shall be submitted to the MOA.

A sewer system adequacy test was performed on the system located
on the referenced property as you requested. The septic tank was
pumped and verified to have a capacity in excess of 1000 gallons.
The drainfield was tested by continuously flowing water through
the system at a rate of approximately 10 gallons per minute.
The system accepted a full charge of 500 gallons without any adverse
effect. ~
It can be concluded from this. test that the waste water disposal
system serving the three bedroom residence located on this property
is still functioning adequately. However the system cannot be

At your request of March 17, 1978, we conducted a test of the septic system
on the above described property.
During this test the liquid level in the septic tank was monitored as water
was added to the system. The measurements are summarized in the following

The meter used during the test was a Rockwell 5/8" standard water meter which
had previously been calibrated by R&M Consultants, Inc.
If the 3 bedroom residence on the property is to house 6 people, the average
load on the system can be expected to be 450 gallons per day or .31 gallons
per m~nute. During the test, the system accepted 210 gallons in 82 minutes.
This indicates an average effluent acceptance rate of approximately 2.6
gallons per minute at the time of the test.

Because the house on the lot is occupied, we assume that the leach field was
at its normal degree of saturation. We can therefore conclude that the
system is disposing of effluent at an adequate rate for a 3 bedroom resi-

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and

HUNTER WMTESELLAND REVETOMI_INl , herein the "OWNER," and the Municipality of
Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as ADVANfEXTREATT fENr SYSTEM

2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
Y� Throughout the term of this Agreement, the Owner shall enter into a service agreement
Ho with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
I It shall be the responsibility of the Owner during the term of this Agreement to pay for all
V4 repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be

assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
�W AWWTS. The Municipality will give at least 24-hour notice.
S Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
ANVWTS approval.
3. Term. The temi of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
,vhile the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.
