Septic Tank Replacement Permit Request/System Documentation
Ladies and Gentlemen:
I am writing to request that a permit to install a new 1500 gallon septic tank be issued for this existing four bedroom
house on the subject lot and to document the existing drain field serving this property. The house was constructed in
1964 and extensive research has not turned up record information concerning the installation of the original septic
system. Information from your files date back to 1983 when a request was made to gain approval of the four
bedroom system and it was discovered the septic tank was only a 1000 gallon tank (sized for three bedrooms.) A 500
gallon septic tank was installed after the 1000 gallon tank and the system was approved for a four bedroom house.
This request/Documentation is to replace the two tanks with a single 1,500 gallon septic tank. The existing tanks will
be abandoned per code. This lot is served by a private well that is located approximately 65 feet from the existing
1,000 septic tank and approximately 90 feet from the existing drain field. See below for the tank replacement request:
1. Upgrade Tank Design.
a. See Sheet 1 of 1 of the plan set new 1,500 septic tank
2. Surface Water: There is no surface water within 100 feet of the existing system. The proposed septic tank
will maintain at least 100 feet from all surface water and drainage ditches.
3. Topography: Lot 5A slopes from east to west at approximately 11.7% in the area of the tank replacement.
The proposed installation will be located in the northern portion of the lot, to the north side of the existing house.
4. Waiver Requests: The proposed septic tank will be located approximately 70 feet from the existing well.
The proposed area is relatively flat and in the area of an old driveway no longer in use. This is the optimum location
for the tank in that this fully developed lot had old-growth trees nearer the drainfield. The location is also down
gradient hydraulically and geographically from the well and is not like to cause contamination of the water source.
The existing crib is inside the 10' utility easement on the northwest corner of the lot. The crib is also 3.4' off
of the north lot line and 5.4' off of the west lot line. I am requesting a waiver for the crib to be 3 feet off of the
property line.
The existing soil absorption system is locate 90.9 feet from the well on Lot 5A and 92.1 feet from the well
on South Lakewood Hills, Block 6, Lot 8 located across Ridgecrest drive. I feel no waiver is required as the Code in
affect when this soil absorption system was installed stated that the system needed to be over fifty feet (50') from a

private water source. This system was constructed to the standards and Codes in affect at the time of installation.
As the well across Ridgecrest Drive located on South Lakewood Hills S/D Addition No. 1, Block 6, Lot 8,
was constructed AFTER the soils absorption system on Lot 5A was constructed, that property should be required to
obtain a waiver at the next COSA. However in the attempt to get this project closed and by no means setting any
precedent, I submit the following and request a waiver be granted for a lesser separation distance between the well on
South Lake wood Hills No.I Block 6, Lot 8 and the soil absorption system on MacBeth S/d Block 2, Lot 5A of 92
feet. There are numerous mitigating circumstances in favor of granting this waiver: The situation has existed since
1969 and no health effects are evident; the separation distance is 92 feet, just shy of the required 100 foot required;
there is a road between the well and the SAS with ditches and a structural section that will prevent effluent form
reaching the well; and the most recent COSA on South Lakewood Hills show a nitrate level at 0.24 mg/l. If the well
was going to be contaminated by this SAS, it would have happened by now, which it has not. The SAS is down
gradient hydraulically and geographically from these two wells and is not like to cause contamination of the water
sources.
5. Drain Field Documentation: PES exposed the existing crib and found it have four foot diameter concrete
rings, six feet tall in the center of a field 15 feet by 15 feet of gravel. There was visqueen placed over the top of the
gravel as was the practice in 1964. As mentioned earlier, PES researched extensively for documentation on this
system. This house and septic system were in operation before MacBeth Subdivision existed. PES performed a sails
investigation and found the soils adjacent to the crib to be Gravel and sand with some silt. The soils have a -G',, J t, �
percolation rate of 3 minutes per inch (mpi). Soils on Lot 5B were recently tested to have a percolation rate gp@g
than 1 mpi, which required the system to have a filter layer. In the practice of the engineers in the years between
statehood (1959) and the early 1990's (see Contractors Bulletin 90-5 dated October 12, 1990 revising this practice
and the ADEC Installer's Manuals of that time frame) the soils were visually rated with the best soils having an
application rate of 85 square feet per bedroom (sf/br). The soils encountered in the two test holes performed on this
lot by PES and on the adjacent lots by other Engineer would all have fallen into the 85 sf/br visual rating. That is the
application rate which was used to verify the size of this crib and approved it for a four bedroom house.
Additionally, your record have numerous test performed by various Engineers stating that this system passes for a
four bedroom house. PES conducted a recent adequacy test and found that this soil absorption system is able to
safely absorb in excess of 600 gallons per day as required by the COSA guidelines.
The proposed installation will not affect the future development of the surrounding or existing lots. Approval of the
existing soil absorption system that has been in operation since 1964 will not affect public health. Approval of the
waiver to the New 1,500 gallon septic tank will not affect the public health of this subdivision. If you have any

THIS AGREEMENT, made this 25th day of March, 2015, by and between Matthew J. and
Karla K. H. Vander Bic and their heirs, administrators, and assigns, hereinafter called "PERMITTEE",
and the Municipality of Anchorage, a municipal corporation organized and existing under its Charter
and the laws of the State of Alaska, hereinafter called the "PERMITTER".
WITNESSETH:
WHEREAS, PERMITTEE is the owner of the following described real property:
MACBETH, BLOCK 2, LOT 5A, according to the official records thereof, on file in
the office of the District Recorder, Anchorage Recording District, Alaska, and;
WHEREAS, PERMITTER owns and/or maintains the real property more particularly
described as follows:
The 10 FOOT UTILITY EASEMENT located in the western portion of the
PERMITTEES property as shown on Plat No. 70-0071, on file in the office of the
District Recorder, Anchorage Recording District, Alaska, and;
WHEREAS, PERMITTEE has placed a septic drainfield upon the referenced easement which
encroaches approximately 5 feet into the PERMITTER'S 10 foot Utility Easement.
NOW, THEREFORE, it is mutually agreed between the parties hereto that:
1. The PERMITTER, acting through the Director of Community Development
Department, hereby grants to the PERMITTEE the privilege of allowing a septic
drainfield to encroach approximately 5 feet upon the PERMITTER'S 10 foot
Utility Easement, as shown on "Attachment A," included herewith.
2. The PERMITTEE agrees forever to indemnify, defend, save and hold harmless,
the Municipality, its officers. and employees, from any and all lawsuits, claims or
actions brought to any person for or on account of damage to property or injury,
disease, illness or death of persons, including all costs and expenses incident
thereto, arising wholly or in part from or in connection with the existence of,
alterations, maintenance, repair, renewal, reconstruction, operation, use or
removal of the encroaching septic drainfield, as placed upon the
PERMITTER'S Utility Easement.
3. The PERMITTEE shall not assign or transfer any of the rights granted herein to
another individual or company without first notifying and securing the approval
of the Director of Community Development Department.
4. This Agreement and Permit grants PERMITTEE no interest in PERMITTER'S
real property whatsoever, except only the encroachment rights described herein.
5. The PERMITTER reserves the right to revoke this permit upon twenty (20)
days written notice to the PERMITTEE. The PERMITTEE agrees upon such
notice of revocation, to move said encroachment(s) from the Utility Easement
in which it is placed. Should the PERMITTEE refuse or fail to comply with
said written notice, the PERMITTER may, without further notice to the
PERMITTEE, remove or cause to be removed the encroachment(s), and the
PERMITTEE hereby agrees to reimburse the PERMITTER for all costs
incidental to the removal thereof.
In addition to the mutual promises heretofore made, the PERMITTEE has paid the
PERMITTER a one-time permit application fee of $115.00. The PERMITTER hereby waives the
annual fee of $300.00.

As certified by my seal affixed hereto and as of the validation date shown below, I verify that my investigation, based on procedures outlined
in the Certificate of On -Site System Approval Approval Guidelines for this application, shows that the on-site water supply and/or wastewater
disposal system is (are) safe, functional and adequate for the number of bedrooms and type of structure indicated herein. I further verify that
based on the information obtained from the Municipality of Anchorage files and from my investigation and inspection, the on-site water supply
and/or wastewater disposal system is(are) in compliance with all applicable Municipal and State codes, ordinances, and regulations in effect at
the time of installation.
In conducting an adequacy test, I attempt to provide a thorough, conscientious engineering analysis of the system in accordance with MoA COSA
guidelines and regulations. The reported results describe the performance of the system under the conditions encountered at the time of the test,
and separation distances measured to readily identifiable features. The operational life of all wells and septic systems depend on the local soil
condition, ground water levels that may fluctuate during the year, and the water usage of the family being served by the system. These conditions
are outside the control of the evaluator of this system. All systems eventually fail and satisfactory test results do not, guarantee future
performance of the system, nor do they guarantee that there are no hidden defects or encroachments. Therefore we cannot provide any warranty
for future performance, nor can we estimate remaining life of the system. The content of this report is for the sole benefit of the owner listed

Approval for the individual sewer and water facilities cannot
be granted until the following items have been completed:

needs to be submitted to this office for our review.
