Dear TJ Justice:
An On -Site Water/Wastewater Permit, number SWO50401 issued by this office for a single-family
system, will expire on 25 October 06. Permits are valid for 365 calendar days from date of issue.
If this was a well permit and the well has been drilled, a well log must be sent to this office for
documentation of the installation and to close the permit.
If this permit was for a wastewater disposal system, an original as -built inspection report must be
sent to this office for review, approval and documentation. This as -built inspection report must be
signed by the licensed Professional Engineer who inspected the installation of the system. As -built
inspection reports are required to be submitted within 30 days of the completion of the system.
If no system was installed under this permit, and you are still planning to install a well or wastewater
disposal system, a new permit must be obtained from this office. A one-time renewal fee for a
second year may be issued for a $115.00 if the renewal application is received on or before the
expiration date of the original permit. When applying for a new permit, the fees are $460.00 for a
wastewater permit and $175.00 for a well permit.

Ref: Proposed Septic Upgrade for hidden Ilius Subdivision; Lot 19, Block 1,
To whom it may concern:
The existing 3 bedroom house is served by a class "C" well and private septic system. We are proposing to
install a nc%%- 1000 gallon septic tank and a deep trench type drainfield. One test hole was excavated on the
property. The drainfield will be designed around the 30 foot radius of this test hole. Prior to the installation of
the septic system the water line that serves Lot 20, Block 1, will need to be relocated along the south end of the
property. A 100 foot waiver from the class "C" well to the proposed septic system has been granted by
ADEC (copy of waiver attached). Comments regarding the design are summarized as follows:
1. SOILS: See the attached logs which shows the soil classifications, groundwater monitoring, and the
percolation test results.
2. DRAINFIELD DESIGN: See attached design drawing for drainfield specifications.
3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic system.
4. TOPOGRAPHY: As can be seen on the attached design drawing the average topography around the
proposed drainfield is a 1-5 percent slope running approximately west to east. In short, there are no slope
concerns.
5. LOT LINE WAIVER: We request your department grant a 5 -foot lot line waiver from the proposed
drainfield to the east lot line.We are unaware of any adverse impacts this installation would have on adjacent
wells or septic systems.

Public Water System Well and Private Septic System
Dear Mr. Gamess:
On lune 7, 2005 this office received your submittal requesting a waiver of the required 150 -foot
separation distance between the Class C public water system well and a private septic system both
located on Lot 19 Block 1 of Hidden Hills Subdivision. The waiver was requested to a minimum
distance of 100 feet. A separation distance waiver was previously granted to 100 feet for this well to
a septic/absorption field located on Lot 19 Block 1 of Hidden Hills Subdivision in a July 15, 2005
letter from this office.
The Class C well was given final operation approval on March 9, 1985. The proposed location of the
septic system is the furthest possible given the lot size and existence of other Class C and private
wells in the area. The septic system is downgradient from the well and is in a highly visible area
should failure of the system occur. The well is drawing water from an aquifer approximately 200 feet
below ground surface and is somewhat protected with silty sands, gravels, and clay.

Block I Hidden Hills Subdivision.

addressed the separation distance to septic systems In evistence at that time. Due to the comparatively small
lou and surrounding development, it is trot possible to construct is septic system on Lot 41 that meets current
minimum separation distance requirements to ft Class C well on Lot 19.

This SHARED WELL AGREEMENT entered into as of the I"dayof May, 20US, between
Peggy Ocrhardson and Colleen Johnson, hereinafter celled Owncrs.
WHEREAS. Owinors own Lots 19 and 20, Block I, Hidden Hills Subdivision its shown on Plat
No. 700338 in the records of the Anchorage Recording District, Thiel Judicial District, State of
Alaska;
WHEREAS, that is located on lAit 19 an operuting water well, pumping facilities and water
supply facilities sufficient to serve Lots 19 and 2n, all as rctlected in Exhibit "At hereto which is
inwxporatcd herein by reference, provided that said Exhibit "A' docs not uccur•alely rellect the
septic system ural absorption ficitl;
WHEREAS, the pnrtics by this Agreement desire to agree to joint use of said water well and
water system for the use of water therurrum upon their respective Parecls and to define their
rights and obligations relative to such use; and
NOW, THFAEFORE, the parties agree us t'ullows:
1. EFFECTIVENESS: This Agreement shall not bo effcclive unless and until it is recorded.
Either party In this Agreement may record it.
2. GENERAL: The owners under this Agreement shAl have equal rights to pump, transmit,
and use water from the well and wtaer supply facilities, including tim water lines located
on said Lot M put•suunt to the provisions of this agreement.
3. USE OF WATER: Said well shall he used solely for domestic purlinses for Residowes
(one single family residence each) on Lot 19 and Lot 20.
OPERATION AND MAINTENANCE:
A. ACCESS: Whoever shall at any 0mehe the ownerof the well and
water supply faciliticsshall provide retwonable access to said well
and water supply facilities in said Lot 19 for tnuhttatance and
operation.

B. ELECTRIC SERVICE: Whoever shall at any time be the owner of
said facilities shali not disrupt the electric service to said well.
C. OPERATION and MAINTENANCE: Whoever at any line shall
be owners of said I of 19 shall have the right and duty to keep said
well in operation and repuir and to secure electric power for
pumping water to Lots 19 mid 20.
5. COSTS
APPORTIONMENT: It is understood and agreed that the owners of lots 19 and 20 shall
each be liable for one-half (1/2) of the cost of operation, repair, and maintenance of said
well, well huusu, and pumping facilities. Will, respect to the cost of periodic electrical
charges for Ilse op=tion ot'said well mxl atr;wrtenant facilities, the owner of Lot 20 shall
pay the owner of Lot 19 Twenty Dollars (520.00) per month as that owner's share of
electrical charges, ptovidcd that if electrical charges are increased by the utility, the
monthly payment shall simultaneously Increase proportionately. For example, if
electrical charges increase by three percent (3%), the new monthly poymcni by The owner
of Lot 20 would increase to S20.60 (3% x S20,0)r-50.6(% S20.00+S0.60-S20.60).
G. PIPELINES: it is understood and agreed that a single water line serves marc than one (1)
lot and the parties using said pipclinc shall be jointly responsible for the maintenance of
said pipeline. No party hereto shall do any act which interferes with the joint use of said
pipeline unit any party cuuging damage to said pipeline shall immediately repair said
pipclinc at their sole cost. Any party disturbing the surface of the soil for purposes a
instulline or repairing the service line equipment shall he uhliguted to restore the soil
surface, as nearly us possible, to Its condition hnmcdiulely preceding any excavation. The
provisions hereof shall not prevent a party from maintaining an above -ground water
storage or pressure tank suitable for a single family residence to serve his own property,
provided said tank is located solely on his property and outside the boundaries of any
easement shown on the recorded plat.
7. COMPLIANCE WITH THE LAW: It is understood that all parties have the continuing
duty to assure that the operation of said well and said water system is done in compliance
with all the Stale and local laws and regulations. It is understood and agreed that this
entire Agreement is subject to such laws and regulations.
8. CHANGES IN AGREEMENT: It is understood and agreed that the putties to this
Agreement muy amend or revise tlus Agreement in any manner at any time, including. but
not limited to, provisions for sepurate metering of water to the Lots, provided that any
such change must be in writing and executed by all parties to thio Agreement.

Dear Mr. Blake Butler,
This letter is a follow-up to our conversation this afternoon. It is my understanding that
you are the real estate agent representing the seller of Lot 19 and a person has entered into an
agreement to purchase Lot 19. As I informed you in our conversation, certain steps need to be
taken for the title transfer and subsequent redevelopment of Lot 19. The follow sequential steps
are necessary:
1. As indicated in my April 27, 2005 letter, a portion of the on-site wastewater disposal
system located on and serving Hidden Hills Subdivision, Block 1, Lots 19 and 20 has
been decommissioned. The portion of the wastewater disposal system located on Lot 20
has been decommissioned and the remaining portion of the system located on Lot 19 is
no longer in compliance with municipal code. Therefore, the remaining portion of the
wastewater disposal system on Lot 19 must be permanently decommissioned.
Decommissioning of the wastewater disposal system will be required in order to obtain
the Certificate of Health Authority Approval required in #3.
2. It is my understanding the mobile home on Lot 19 is uninhabitable and the buyer plans to
remove it following title transfer. In the intermittent period, the mobile home should be
secured against entry and occupancy.
3. A Certificate of Health Authority Approval for the water supply system on Lot 19 should
be obtained from this department prior to title transfer.
4. A recorded agreement to run with the properties should be made between the Lots 19 and
20 property owners for the sharing of the Lot 19 water supply well.
5. A wastewater disposal system must be constructed to serve Lot 19 prior to
redevelopment. There appears to be two potential options for a wastewater disposal
system to serve Lot 19. Option #1 - A permit be obtained from this department for the
construction of an individual on-site wastewater disposal system on Lot 19. This option
would require the appropriate separation waiver be obtained from the Alaska Department
of Environmental Conservation (ADEC) for the Class C public water supply system on
Lot 19. Option #2 — A permit be obtained from the ADEC for construction of a
wastewater disposal system on Lot 20 that serves Lots 19 and 20. A 3,000 gallon septic
tank has already been installed on Lot 20 for the potential of a future shared wastewater

disposal system. This option would likely require both parties to entire into a recorded
agreement to run with the properties for the sharing of the wastewater disposal system.
Please be aware that Anchorage Municipal Code (AMC) 15.65.040 prohibits the
installation of a wastewater disposal and/or water supply system in a location that would prohibit
future residential use of an adjacent lot. Therefore, this department is unable to issue a
wastewater disposal system permit for Lot 19 because it would prohibit the installation of a
water supply system on Lot 20. Likewise, this department is unable to issue a water supply
permit for Lot 20 because it would prohibit the installation of a wastewater disposal system on
Lot 19.
Based on the site plan of the subject properties provided by Gamess Engineering Group,
there does not appear to be sufficient area for both properties to have an individual on-site
wastewater disposal and water supply system. Therefore, it is to the mutual benefit of the Lots
19 and 20 property owners to come to a recorded agreement regarding the sharing of the water
supply well on Lot 19 and potentially the sharing of a future wastewater disposal system on Lot
20. We hope that this letter aids each property owner to understand the need to work together to
resolve the wastewater disposal and water supply system issues of the subject properties.
