Septic System Upgrade Permit Request
Ladies and Gentlemen:
I am writing to request a permit to install a septic system be issued for this property. The proposed
systems will serve a proposed four (4) bedroom house. Currently the lot is undeveloped. The lot was
developed at one time, but all development has since been removed or abandoned per code. The
proposed well will be over 100' from this septic system and over 100' from surrounding septic systems.
The proposed septic system will be located over 100' from the proposed well on this lot and over 100'
from wells on the surrounding lots.
1. Soils. One test hole was excavated in the area of this drain filed by Pannone Engineering Services
in August of 2013, and groundwater was encountered in the test hole 4.0 feet below the ground surface.
It is my opinion, based on the results of the percolation tests and overall soils appearance; an application
rate of 6 gallons/day/square feet should be used for a CAT 111 wastewater system.
2. Soil Absorption System Design.
a. See Sheet 2 of the design package.
3. Surface Water: There is no surface water within 100 feet of the proposed drain field. The
proposed drain field upgrade will maintain at least 100 feet from all surface water and drainage ditches.
The proposed septic tank is located approximately 85' from a stream. See waiver request.
4. Topography: The existing topography slopes from the east to west at approximately 15%-20% in
the area of the proposed drain field. There are no steep slopes in the vicinity of the septic system.
5. Waiver Request: I request that a waiver of 80' from the septic tank, lift station, and drain field to
surface water be granted for this lot. The tank will be located directly adjacent to the house and the
occupants would notice an overflow immediately. The drain field will be located 50' uphill of the house.

There is a natural low ridge between the proposed area of development and the stream. The likely path
of an effluent overflow from the tank to the nearest point of contact with surface water is over 200'.
Granting this waiver will not affect the safety or health of this lot or surrounding lots.
The proposed installation will not affect the future development of the surrounding or existing lots. There
are no surrounding wells within 100 feet of the proposed septic location.

MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this )

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perforin as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:
a. Owner:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

During our inspection of the above property on July 17, 1984,
the following items were noted in the area of the two travel
trailers.
(1) The facility designated a "holding tank" by Mr. Skruggs
is still buried with no air tight cap.
(2) The sewage disposal lines from both trailers have been
physically disconnected.
(3) The gallery collection water system from the creek is
operational, although the hose was not in the creek.
(4) The privy appears to encroach on the required 100 foot
setback distance from the creek.
Next to these two travel trailers are one travel trailer and
one mobile home. No source of potable water was found and it
is likely water is brought in by barrel. There was no evidence
of a sewage disposal facility at either trailer. I was unable to
inspect beneath the mobile home due to the skirting.
At this time, your client has complied with the conditions
set by this Department on July 2, 1984. As long as no sewage is
allowed to flow upon the ground, we will extendthe compliance
date until such time as Mr. Cutbirth obtains legal access to
his property. This extension will be automatically revoked
should conditions change such that a serious health hazard exists.
This agreement is made with the full understanding that ownership
and possession is expected to be settled within sixty(60) days.

Dear Mr. Brennen:
This letter recapitulates the meeting between the
Municipality's Zoning Enforcement Division and the Department of
Health and Environmental Protection and Harry Cutbirth with
counsel, on June 29th, as well as the subsequent telephone calls
between the aforementioned parties on July 2, 1984.
The violations taking place on the land concern three travel
trailers and One mobile home% on the subject property in
violation of A.M.C. 21.40,240 (E)(3) and the sewage system which
serves those units. Said violations are described in letters
from Zoning Enforcement and the Health and Environmental
Protection dated December 19, 1983 and March 20, 1984,
respectively.
All parties agreed repeatedly that Mr. Harry Cutbirth, the
apparent owner of record, is not the perpetrator of these
violations. He has, in fact, acted in good faith throughout the
conflict and is at least as much an injured party as the
Municipality.
Mr. Cutbirth signed letters of eviction prepared by Smith,
Coe & Patterson and delivered the last of those :Letters
personally on July 3, 1984, Those letters were necessary to
initiate compliance with the Municipality's above-mentioned
letters and still be within the bounds of applicable state laws,
to wit: A.S. 34.03.180, A.S. 34.03,280 and A.S. 34,03,310,
Mr. Cutbirth desires to achieve the same ends as the
Municipality to remove the mobile homes on his property and have
the bootleg sewage system dismantled and removed. Thirty days
after deliery of the eviction notices, he will attempt to effect
those results. If the current trailer occupants refuse to move,

determined that the sewer System serving two trailers is not
approved. There are a number of deficiencies in the existing
system., including improper piping to the holding area and no
cleanout and cap on the tank. There is also no inspection of the
system in our file. The permit issued in 1903 for a holding tank
expired December 31, 1983 and will not he renewed.
You are hereby ordered to (1) disconnect both lines froi . the
tank; (2) pump the tank; and (3) properly abandon the tank. We
will require the first two items to he accomplished no later than
March 31, 1984. You must notify this office when the work is
complete so we can reinspect the facility. The third item. Must
be done by June 1, 1984 and an inspection also wade.
Any privies maintained in use must be at least 100 feet from the
stream or anysurrounding private well.

The length dimension is the length(in feet) of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet).
