Ne are in receipt of your letter of Oecember 14, 1970
regarding Tracts A and B in a resubdivision of lteritage
Hills Subdivision.
The seven (7) lots, which you have agreed to exclude from
development until public utilities are available, is also
agreeable with this Department.
We shall' therefore only require tile first section of the
sewer and water covenant on your plat..

located Heritage Hills Subdivision
within SE1/4 SEC. 22,T. 12N.,
R. 3W., S.M., Alaska
Dear Mr. Strickland:
This letter will confirm our conversation of December 10, 1970
regarding the above referenced property.
In our conversation it was noticed that the referenced
subdivision contained 1~ lots. According to specifications
set forth by your Department, a parcel of land having the amount'
of acreage contained in this particular subdivision could have
no more than 103 lots developed. Therefore, I agreed as devel-
oper of this subdivision that no more than 103 of the lots will be
developed ~.ntil such time as community water or sewer is made
available.
In ou~ conversation it was agreed that your Department
would approve the referenced subdivision and eliminate the
second paragraph from the covenants which you normally place
on the plat of subdivisions of this type, if I, as developer,
would develop only 103 lots as specified above.
Therefore, to conform to this agreement, I hereby agree
not to develop the following lots until such time as said
utilities are made available: Block One - Lots 2, 12 and 23;
Block Two - Lots 11, 30 and 34. Block 5 - Lot 2. It was also
agreed that if at any time I wish to substitute any other lot in
the subdivision for one of those excluded above I would have
this privilege.
If this letter satisfies your Department's requirements, will
you please acknowledge in writing.prior to December 16, so that I
might have a copy of your letter an my possession prior to the
Planning Commission Hearing.
