RE: SEPTIC SYSTEM UPGRADE PERMIT
LEGAL: HERITAGE HILLS BLOCK 4, LOT 3
The owner has requested that we upgrade the aged septic system on the above referenced lot. We propose
to install one deep trench with and Advantex system to serve the existing 4-bedroom residence. The design
is conservatively based on area soils and groundwater found within MOA record documents. A confirming
testhole will be completed prior to construction. The slopes are moderate at 3-7% at the proposed upgrade
location.
The lot and the adjacent 5 lots are served by a water well located on Heritage Hills Block 4, Lot 8. Per the
file Heritage Hills Water System file located in the MOA on-site database, this well was approved by ADEC
in 1973 to serve 6 lots (Lots 1, 2, 3, 6, 7 and 8 of Block 4). For the most part per the record docs, the well
has been classified and treated as a Class C well, but also noted as a Class A on some other occurrences.
Although currently Class C wells are considered private shared wells, the most recent designations have
been as a Class C per waivers granted by Bill Reith, P.E. of the ADEC in 2009 for a conventional septic
upgrade on Lot 1 and for a tank on Lot 8. A 2017 MOA approved and installed septic upgrade on Lot 7
shows this well as a private shared Class C well.
In any case and to mitig ate any impact to this well and any other wells of the area, an advanced wastewater
system is to be installed. The source water of these wells is further protected by the area;s silty and clay
soils. Nitrate levels appear to be low for the area. Water samples have been taken, but are pending final
analysis. This design will improve the current condition of the on-site septic that has been in operation for
several decades. The proposed design will not impact any of the neighboring properties. Please contact us

on procedures outlined in the Certificate of On -Site Systems Approval Guidelines for this application, shows that the
on-site water supply and/or wastewater disposal system is (are) safe, functional and adequate for the number of
bedrooms and type of structure indicated herein. I further verify that based on the information obtained from the
Municipality of Anchorage files and from my investigation and inspection, the on-site water supply and/or wastewater
disposal system is (are) in compliance with all applicable Municipal and State codes, ordinances, and regulations in

Comments: This investigation was completed in compliance with MOA guidelines, regulations,
and best industry practices / methods. The assessment of the condition of the well and septic
applies only to the conditions as of the day tested. The flow and absorption rates may change
due to subsurface conditions that may not be observed from the surface, changes in land use,
local soil characteristics, groundwater levels that may fluctuate during the year, quality of
construction (workmanship & materials), the water usage of the family being served by the
system and maintenance. The operational life of all well and septic systems are subject to

MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and

Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),

2. Maintenance. Repairs and Alterations.

if Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
TL It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
,('-a- Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
r� Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
"Y-4 Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
_LZL Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of Health Authority
Approval (HAA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of Health Authority Approval are required for the transfer
of title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or
water supply system. DSD also issues HAAs upon request to homeowners. Certificates of Health Authority
Approval are valid for 90 days from the date of issue for properties served by a private or Class C well and may
be reissued with new water samples. (Certificates may be reissued for a period of up to one year with valid
water samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water
system. The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's
work.

In conducting this evaluation, GEG, Ltd. attempted to provide a thorough,
conscientious engineering analysis of the system in accordance with ADEC and MOA
DSD Guidelines 8 Regulations. The reported results described the performance of the
system under the conditions encountered at the time of the test, and separation
distances measured to readily Idontiflable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG, Ltd. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the
operational requirements of the ADEC or MOA DSD. The content of this report Is for

Dear Ms. Favorite:
Our files indicate you own a well on Lot 8 Block 4 of Heritage Hills Subdivision. Our files indicate
this well serves lots 1, 2, 3, 6, 7, and 8 of Block 4 Heritage Hills and that Lot 1 of Block 5 may also
be connected to this system. According to the Municipality of Anchorage records, the total number
of bedrooms on the lots 1, 2, 3, 6, 7, and 8 of Block 4 is 16. The ADEC Drinking Water Program
uses maximum design capacity for assessing water system classification. Residential homes have a
maximum design capacity of 2 people per bedroom. Based on this, the system is designed to serve 32
people (16 bedrooms x2 people). Drinking Water Regulations define a Class C water system as
serving less than 25 people. Class A systems are defined as serving more than 25 residents. Based on
these definitions, your public water system is a Class A public water system.
Your water system will be required to meet the minimum construction standards of a Class A public
water system. You will need to hire an Alaska -registered Professional Engineer to submit a request
for approval to operate a Class A public water system. This request will need to address the
construction standards as well as separation distance requirements of a Class A well. The checklist
for Drinking Water Engineering Plans should be used for this submittal. It can be found on our
website at http://www.dec.state.ak.us/eh/dw/dwma i n/en gineerinp htm1. This request for
operational approval will need to be submitted to our office by December 15, 2005. In addition
to this, routine sampling will now be required of the well. Jamie Stazel of our office will be in
contact to help you with these requirements.

Any person who disagrees with this decision may request an adjudicatory hearing in accordance with
18 AAC 15.195- 18 AAC 15.340 or an informal review by the Division Director in accordance with
18 AAC 15.185. Informal review requests must be delivered to the Division Director, 555 Cordova
St., Anchorage, Alaska 99501, within 15 days of the permit decision. Adjudicatory hearing
requests must be delivered to the Commissioner of the Department of Environmental Conservation,
410 Willoughby Avenue, Suite 303, Juneau, Alaska 99801, within 30 days of the permit decision. If
a hearing is not requested within 30 days, the right to appeal is waived.

General
1. Due to the topography between the absorption field and well, any surfacing effluent would
initially flow towards the well, but would turn and not run towards the well.
2. The nitrate sample taken from the subject well (Lot 5, Block 4) is 1.99 mg/I. This is consistent
with the nitrate level in the class C well serving the house, it's level is 1.37 mg/L.
3. This situation has existed for over 25 years.
Well
The subject well was likely drilled in 1970 when the wastewater disposal system was installed.
It was deepened to 228 feet in 1978. The static water level is 203 below grade.
Absorption Field
The absorption field, a crib, was installed in 1972. An additional trench was constructed in 1977.
The standpipe of the crib is >100' to the well on Lot 5. Any possible overflow of effluent
would likely surface at this standpipe.

Request you issue a Health Authority Approval on the referenced property and grant a waiver for
the horizontal separation distance between the crib serving the referenced property and the
private well serving Lot 5, Block 4, Heritage Hills at 85 feet. The mitigation factors involved
which support the issuance of the waivers are as follows:

1. The horizontal separation distance from the crib to the well is 85 feet. 15% of the required
separation distance is requested to be waived.
2. The samples taken from the well located on the referenced property indicated 1.37 mg/L of

3. The referenced lot is on a 5% to 10% slope. Surfacing effluent would initially flow towards
the well but would turn to the North and pass the well about 25 feet away.

4. From the well logs in the area (attached) we can see that the well depths run about 220 to 260
feet. The static water levels are around 210 to 220 feet deep. The distance between the crib and
the water table exceeds 200 feet.
SITE PLANS
5. The soils on the well logs in the area indicate predominately sand and gravel layers with clay
layers between the ground surface and the aquifer. The confining layers would prevent any
effluent from contaminating the aquifer.
ROAD DESIGN
6. The hydraulic gradient is about 5 % towards the well (see attached surrounding well logs).
The granting of this separation distance waiver would not have an adverse impact on the
surrounding properties.

In recent conversation with Mark Pearson on the subject property,
we were informed that an upgrade on the septic system might violate
separation requirements. According to Mr. Pearson, an extension
made on the drainfield line in 1977 placed it within 141 ft, from
the community well between lots 1 & 8. This work apparently
occurred two months after a regulation change was made where the
required separation went from 120 ft, to 150 ft.
In consideration of this type situation where a recent regulation
change has occurred, the Department generally allows a grace period
in which projects are allowed to conform to the older regulation.
In this case, we have found the work to have been completed within
an acceptable time period. No waiver will be required.

TESTING PROCEDURE
Residence has been continuously occupied, and presoaking was
considered unnecessary.
Standpipes used: One over the crib, one on far end of trenched
drainfield, two on each septic tank, and a cleanout after the
septic tanks.
The drainfield monitoring tube was installed in August, 1989
by Carl's Excavating, and at that time it was not clear if the
drainfield contained piping in all areas. Although Carl found
the gravel prism, he was unable to find the actual piping at
the end of the trench. Dan Roth and Dan Bowles visited the
site and it was concluded that rather than excavating the yard
in search of the pipe, an adequacy test should be performed.
Water was added to the cleanout below the septic tanks at an
average rate of 7.9 gallons per minute until over 600 gallons
had entered the system. Depth to fluid level measurements were
taken at the crib, drainfield, and septic tank. The level in
the septic tank did not vary.

The crib and drainfield fluid levels rose at the same rate
(approximately .3 FT per 20 minutes), and after filling had
stopped, the levels receded at the same rate (approximately
.1 FT per 10 minutes).
TEST RESULTS
THIS SYSTEM MEETS OR EXCEEDS THE CODE REQUIREMENTS OF THE
MUNICIPALITY OF ANCHORAGE.
This analysis was conducted to quantitatively measure the
performance of the above referenced absorption system.
While the system performed more than adequately, a
prediction of the overall operational life expectancy of
the wastewater absorption field is not herein implied.
Operational life expectancy is affected by many variables
such as homeowner maintenance, soils conditions, and
fluctuation of groundwater levels.

SUBJECT: heritage hills Subdivision
Some time ago, (approximately one month), a man, (did not give his
nacre), called we in regards to the sale of a lot he owned. The,
inan did not identify himself or tell me where the laird was.
He accused me of advising a prospective client riot to purchase the
land because it was "no good".,
This could not be further from the truth and is a direct lie.
About two montas ago a man, (do not renrermber his name), carne to
me and asked me about the, suitability of a lot in the subject
subdivision. I now know the subdivision in question because you
told me today.
I pulled tie file., obtained fire soils information from the surround-
ing lots and we platted wrrere his k+ell and sewer system should be.
Tiro man was,very_alarmed because there was not sufficient room
replace -the seepage pit on this lot sho iu d the original- frit tie
asked me what would be the proper fining to do, at the time; the
original seepage system quit. I advised him tilt it would have to
be replaced, which was obviously not possible, or he would have to
install a holding tank and pump it weekly. The man said he did not
want to purchase the property under those conditions because of the
possible great expense: of maintaining the sewer system.
I advised him that he sriould ask the seller, to obtain a valid permit
to install an on-site sewer system prior to purchase of the property.
This would insure the purchaser that he could build on his lot.
I never advised him not to purchase the property. I did advise him
that if the: soils did not pass our minimum acceptable standards he
would not be given a permit to install an on-site sewage disposal
system. This is why I also advised him to be sure the seller secured
a valid permit before he purchased the property.
