RE: LAKE HILL ACRES #1 LOT 35 — ADJACENT WELL TO NEW SEPTIC TANK WAIVER
Per the attached as -built survey by John L. Schuller (JLS) November 3, 2022, the closest edge of the newly
installed HDPE septic tank was measured at approximately' 96.7' to the adjacent property's well on
Benbecca Block 1, Lot 2A. JLS remeasured the locations of this encroachment and it was determined to be
the same. It appears that the original staking setbacks at construction was not properly marked. This also
was a challenging install to maintain elevations and the 10' separation from the existing foundation and to
maintain other setbacks to existing wells and absorption systems and the tank was installed in the best place
possible.
We are therefore requesting a waiver to 96' between the referenced well on Lot 2A and from the new HDPE
septic tank be granted at this time. Granting of this waiver is justified in the fact that the attached area CAN
water samples show little nitrate influence if any — the wells on each side of this property show non detect or
less than 0.5 mg/L, the newly installed HDPE tank is of higher material quality than the decommissioned
old steel septic tank that has been in operation for around 45+ years with no known side effects and the
improved tank is across the street with gutters / swales with existing grade length of over 100' separation
and no visible manner surface flow could occur on any potential effluent tank overflow. Granting of this
waiver will not adversely impact any of the neighboring properties. Please contact us if you have any

RE: SEPTIC TANK UPGRADE PERMIT
LEGAL: LAKE HILL ACRES #1 LOT 35
The owner has requested that we obtain a septic permit to upgrade the existing aged steel septic
tank on the above referenced lot. We propose to install a 1500-gallon HDPE tank per the
attached design to serve the existing 5-bedroom residence. Per the owner there is a 4BR main
house and the MOA approved a 1BR ADU with garage as shown on the attached asbuilt survey
and design. Also, pet the owner Steve Pannone, PE tested the existing leach field recently and it
passed a septic adequacy test. All well radii, property lines and foundation are to be staked by a
RLS prior to construction. The lot and area are served by private wells. The design will not
impact any of the neighboring properties. Please contact us if you have any questions.

RE: COSA Inspection Waiver Requests for Lake Hill Acres #1, Lot 35
Onsite Water & Wastewater Reviewer,
AK Built Construction & Design, LLC has been employed to perform a COSA inspection for the subject
property. During the inspection process it was determined the existing soil absorption system does not
meet specified separation distances for field to building foundations and field to property line. It is also
noted that the field is located under a driveway and under a building foundation.

The absorption field inspected was installed in 1978 prior to the construction of the garage on the subject
parcel. The garage foundation is located over the absorption field. Note that only a portion of the
absorption field is under the building foundation; the absorption field was not installed in a straight line
but rather angles towards the building foundation, parallels under the building foundation, and then
angles away from the building foundation. It is unknown if the construction of the garage required the
field locating of the absorption field. AK Built is requesting a waiver of absorption field located under the
building foundation be granted. The garage shows no signs of impacts influenced by the absorption field.
The garage structure is a slab-on-grade construction. Based on historical performance of the structure
and slab-on-grade construction there is no anticipated adverse impact to the existing building foundation.
There is no crawl space in which effluent from the field could present a health impact on a building
occupant. Inspection of the structure’s interior shows no signs of building failure due to the location of
the absorption field. Furthermore, the absorption field is under the foundation where the structural load
is bridged via the garage door header to the side jambs of the opening. The absorption field under the
foundation is located approximately in the middle of the garage door opening.
